Yates, owners of the residence at 553 N.E. 101 Street, Miami Shores, Florida, hereby respectfully petition the Village of Miami Shores for the following hardship variance under Section VII of the Zoning Ordinance No. 27 adopted May 17, 1956: Bedroom side - setback of 7' from east property line instead of 10' setback provided in Village Ordinance No. 399-77. The disia11owance_df:this variance .. by the Vi11age.wou1d. hardship on our family, which can be readily determined by considering the following: 1. The single family residence built on the lot (/ sxf Lot 18 and all of Lot 19, Block 94, Amended Miami Shores Section No. 4) in 1925, which we purchased in 1980, has an east side - setback of 7' (See page A -4 of the Appendix :to this Petition). 2. The Schedule of Regulations being a part of Article IV. of the Miami Shores Village Zoning Ordinance No. 270 states that the side set -back should be a minimum of 10' for a non - corner lot. We would direct your attention to Page A -1 of,the Appendix to.this petition depicting the location of existing single -story CBS residence together with . proposed bedroom and family room. The following must be taken into account when considering this Petition (Please refer to Article VII, Section 702, (a) through (d) of Zoning Ordinance No. 27, page 928): (a) The alleged peculiar and unusual conditions affecting the property. Our house is situated on said lot in such a way so as to make it a nonconforming structure, because its side - setback on the east is 7'. (b) The alleged reasons why such conditions make it impossible strictly to apply specified provisions of this ordinance to the property. 1. Our house was built to conform to the zoning code of its time but is now nonconforming as to the current side - setback requirements of the Village. 2. Strict application of the current side - setback requirements would constrict the reasonable function and use of the bedroom with normal furniture. PETITION (continued), p.2 3. There is no practical alternative to construct a bedroom on any other side of the house. (c) The variance in such strict application that the applicant believes to be necessary in order to enable him to make a reasonable use of the property. Strict application of the current side - setback requirements would deny us the practical use of the rear portion of our property for a needed bedroom for our expanding family. It would be impractical and contrary to our needs to break up the sleeping function of the house and put the bedroom on the living (west) side of the house. (d) The reasons why applicant is of the opinion that such variance would be in harmony with the intent and purpose of this ordinance, would not be detrimental to the existing use or prospective development of property in the vicinity, and would not give to the applicant an advantage not enjoyed by the owners of similarly situated property. 1. We are requesting this variance so that the bedroom in question, will merely extend from the east wall of the existing residence into the backyard consistent with the existing 7' side - setback (see page A -1 of the Appendix to this Petition). As existing side - setback of 7' has not posed a problem to neighboring property for the past 59 years, there is no reason to assume that there will be problems in the future. 2. In regard to the aesthetics of the proposed addition, the addition will be built in order to be consistent with the existing structure, e.g., relocation of existing windows, stucco to match, parapet lined with tile, leaded glass, french doors, etc. (see elevation drawings, page A -6 of the Appendix to this Petition,and photos of the existing structure to be presented at hearing). A final consideration regarding the aesthetics of the proposed addition, is the fact that our house has been nominated for consideration as a historic landmark. This fact notwithstanding, it is and has been our intention; to restore and make any changes to our house only in ways that are consistent with the architectural integrity of the house. An alternate plan to the proposed addition would place the addition in view from the front elevation, thereby significantly altering the original profile of the house. In order to remain consistent with the intent and purpose of the Miami Shores PETITION (continued), p. 3 Historic Preservation Board, we sought the opinion of Chairperson Marty Stofik. (see Page A -2 of the Appendix to this Petition). We have discussed our addition plans in detail with Ms. Stofik and have explained the variance we are requesting. We quote the following key passage from Ms. Stofik's letter: Mr. Yates has exhibited extaordinary care in restoring this home. 1 have reviewed the plans and inspected the property and agree with the applicant that the proposed addition is designed the only way possible to maintain the integrity of the structure. To place the addition in any other area would seriously damage significant landscaping, alter the profile of the house, and destroy the natural ventilation that was a vital design element in homes of that .period. Having been residents of Miami Shores for six years (Jim is a lifelong resident), we are committed to and appreciate the need to uphold and enhance our property value, our neighborhood and the aesthetics of our home. In conclusion, we are seeking merely to extend the existing east wall of our residence in order that we may have reasonable use of our property as well as an aesthetically pleasing addition. The disallowance of this variance by the Village would cause an undue hardship on our family as detailed above, whereas, the granting of this variance would enhance the property values of the adjoining property in Miami Shores and would be aesthetically pleasing to all concerned.
