The products ordered in this contract are to be custom -built to fit customer's
requirements, and this order therefore is NOT CANCELLABLE. Order is subject to
credit and.installation approval at seller's home office.
No statement, representation or agreement, written or verbal, not appearing
upon the face of this contract is binding or acceptable.
Seller reserves title to the articles covered by this contract until full payment is
made, and the same shall remain and be considered for all purposes as personal prop-
erty and not attached to or becoming part of the realty, regardless of the method or
manner of installing the same in or upon the property or improvements of customer.
Seller expressly reserves all contractor's, mechanic's and materialmen's liens which Deposit
may be asserted under any provision of law to secure payment of the contract price
and may, at seller's option, assert and fix the same as liens upon the real property on Balance due on installation $
which installation is made. In the event payment is enforced through attorneys or by
suit or in bankruptcy or probate proceedings, seller may recover reasonable attorney's
fees and costs of court. All sums not paid as due shall bear interest at the maximum
legal rate.
This contract is binding upon seller only upon acceptance by an authorized executive of the company at the home office. All agree-
ments are subject to prior sale, government regulations and requirements, strikes and other factors beyond seller's control which would
prevent or delay delivery.
The products sold hereby are warranted for 90 days from date of delivery against defects in material and workmanship. Where in-
stallation is made by seller, defective materials and parts will be repaired or replaced at seller's expense. Where installation is made by
others, seller's responsibility shall be limited to repair or replacement of defective parts.
In the event of default by purchaser suit hereon may be prosecuted at MIAMI, FLA.
The above named parties, other than company, shall supply necessary survey or corner stakes to properly locate fence.
The company assumes no liability for property infringement.
