Lubien, Building Director Dear Mr. Lubien: December 23, 1997 Re: Nelson Apostol 278 N.E. 101st Street Miami Shores, Florida 33138 Our File No.: 97 -5891 I represent Dr. and Mrs. Nelson Apostol who own the property located at 278 N.E. 101st Street in Miami Shores. I wrote to you on September 30, 1997 about obtaining a final inspection of the property and was advised by an official of the Village of Miami Shores that the actual contractor had to request the final inspection before the Village would send out its inspector. Both Dr. Apostol and I have tried to contact Richards Roofing concerning obtaining the final inspection both by telephone calls and in writing and I have received no response. Certified Return Receipt Requested letters have not been claimed. Thus, Dr. and Mrs. Apostol are caught in a Catch 22 situation in that only the roofer can request the final inspection and the roofer has apparently disappeared. We are writing to you at this time because basically we do not know what to do. Dr. and Mrs. Apostol have relocated to Mississippi and need to sell their house. However, to get the fair purchase price, they need to produce the final inspection of the roof work. I would appreciate someone from the Village contacting me as to what can be done in this type of situation where the roofer will not respond. The Village of Miami Shores December 23, 1997 Page 2 Should you have any questions concerning any of the above, please do not hesitate to contact me. Lubien, Building Director September 30, 1997 Re: Nelson Apostol 278 N.E. 101st Street Miami Shores, Florida 33138 Our File No.: 97 -5891 I represent Dr. Nelson Apostol who owns the property located at 278 N.E. 101st Street in Miami Shores. Dr. Apostol purchased the house shortly after Hurricane Andrew. A new roof on the front of the house was to have been completed prior to his closing. Building permits were pulled and the work completed but never inspected by the Village of Miami Shores. Dr. Apostol was not aware of this until such time as he executed a Purchase and Sale Agreement to sell the home as he was relocating to Mississippi. His purchasers in doing a roof inspection noted problems with the roof and also noted that the roofing work had never received a final inspection from the Village of Miami Shores. They subsequently canceled the contract. Demand thereafter was made on Richard's Roofing Company, the roofer who had pulled the building permit to correct the roof work and the work was completed this August. However, Dr. Apostol advises that he has not been able to get a final inspection of the roof work from the Village of Miami Shores. This is a major problem for Dr. Apostol since he is negotiating to sell the house and purchasers when doing their inspections are noting that there is not a final inspection for the roof work from the Village of Miami Shores. Essentially, Dr. Apostol may not be able to sell the house until he receives a final inspection of the roof work. The Village of Miami Shores September 30, 1997 Page 2 Dr. Apostol has asked me to contact you in hopes of your getting one of your inspectors to go out to the property and give a final roof inspection so that he can sell the house and get on with his life. Should you have any questions concerning any of the above, please do not hesitate to contact me. JER /td Very 1 my yours, .
