In addition he faxed me a copy of the letter yo stating that the contractor had "indicated" to Mr. Charles Escher that the homeowner requested that the driveway be moved. I am the contractor Mr. Escher spoke to and I am writing to inform you that I did not "indicate" that the homeowner made this request. What I said was that the homeowner wanted the driveway to be eve.n bigger than it currently is. I told Mr. Escher this to emphasize the point that iil tight of the problem we currently have, it would have been an even bigger problem had we poured the driveway the size the homeowner . originally wanted it. I in no way "indicated" that the client asked my company to phy i a lv hang the parameter stakes after the form inspection because it did not ha n. Practically speaking, no reputable contractor ctor would do this and run the risk of not getting a final and e added cost that accompanies having to change a completed pour. With this client as well as all homeowners we do business with, we advise them what is possible and pour the driveway to conform to the necessary specifications outlined in the code. In fact, the homeowner knew nothing of codes, setbacks, and form inspections until this problem arose. The fact of the matter is the forms were laid incorrectly and the inspector for whatever reason didn't catch it. It appears to me that the basis for your decision was based on erroneous information. Therefore, the purpose for this letter was to clarify what was said in the conversation between myself and Mr. Escher. I sincerely hope that the Winstons aren't penalized for a mistake that was made between our two offices. Since receiving your initial letter, I have spoken to both the Building Official and the Planning & Zoning Director. The Building Official advised that he reviews the structural aspects of the proposed job, i.e. whether the forms are laid correctly; and the Planning & Zoning Director reviews the project in terms of meeting the zoning requirements, i.e. setbacks. In addition, I had asked that our Building Official, Mr. Charles Esher, speak directly to the contractor who completed the work for you. During this conversation, your contractor indicated to us that you expressly requested that he move the driveway parameter stakes and not adhere to the plans as submitted to complete the project. Based on this information, I have no choice but to advise you that you must remove the portion of the driveway which infringes upon the established setbacks. This should be done as soon as practical. Plans were submitted to the village via the contractor. Prior to the pouring of the concrete, while the forms were in place, an inspector came by the site to ascertain that the concrete met specifications. There was no mention about the driveway being to "big". After the concrete was poured, stamped and had hardened an inspector came by and left a pink form stating that the driveway was too "big". I called the contractor's representative and he took the form to Miami Shores Village. The representative then brought back a "Building Inspection Request" dated 07 February 2002 with the word approval circled and the words "OK for final driveway" hand printed on the form. (Enclosure 1). On 06 March, 2002, I received a "Courtesy Notice" stating that the "Installed driveway does not conform with approved plan. Please configure driveway so as to conform with approved plan on file ". (Enclosure 2) At all times during this process, I have attempted to follow the rules of the Village and maintain compliance with the Village codes. Now through no fault of my own, I might be asked to fix something I had little control over. I'm confused -please advise me as to the proper way, if there is one, to deal with this situation without having to dig up the installed driveway. CC: Director, Building Department H.T.
