STRAHM SUBDISTRICT MANAGER Re: Application #DF 13- 43625 -6E; Riprap at Toe of Seawall, Biscayne Bay Pursuant to Sections 403.087, 258.165 and 253.123, Florida Statutes (F.S.), and Sections 17 -4.07 and 17- 4.242, Florida Administrative Code (F.A.C.), the Department of Environmental Regulation hereby gives notice of its intent to issue a permit for the following: To place 450 cubic yards of boulder riprap (2 -5 feet in diameter) along 300± feet of existing seawall. The riprap would extend from one foot above mean high water on the face of the seawall to the natural bottom on a minimum 2:1 (_horizontal:vertical) slope. The project is located in Biscayne Bay at 1500 Northeast 101 Street, Miami Shores, Dade County, Florida. This project was reviewed at the Biscayne Bay Aquatic Preserve hearings on June 17, 1981. An on -site inspection was conducted on June 8, 1981. No significant long- or short -term adverse impact on water quality or biological resources is expected to result from the placement of the riprap. Furthermore, the placement of riprap is expected to have a beneficial impact on Biscayne Bay by providing additional marine habitat and improving water quality. Several objections to this project were reviewed by the Department and were found to have no substance in law for recommending denial of this application. This permit shall be issued with the following conditions: 1. If turbidity exceeds 50 J.C.U.s beyond a 50 -foot radius of the work area, which would be in violation of Section 24 -11 of the Metro Dade County Code, turbidity controls, such as but not limited to turbidity curtains, shall Page 1 of 2 Protecting F" and Your Quality of Life Page 2 Mr. Ben Pumo July 23, 1981 be implemented at the construction site and Metropolitan Dade County Environmental Resources Management (MDCERM) shall be notified immediately. If turbidity levels do not drop below 50 J.C.U.s within one hour after implementation of the controls, all construction shall be halted. Construction shall not be resumed until the contractor has implemented additional control methods and has received authorization from MDCER1.5. 2. Written notification shall be provided to the DER South. Florida Subdistrict office in West Palm Beach and MDCERM a minimum of forty -eight (48) hours prior to commencement of construction and a maximum of forty -eight (48) hours after completion of construction. This Department shall issue- -the subject permit unless an appropriate petition is filed for a hearing pursuant to the provisions of Section 120.57, F.S. At such formal hearing all parties shall have an opportunity to present evidence and argument on all issues involved, to conduct cross - examination and submit rebuttal evidence, to submit proposed findings of fact and orders, to file exceptions to any order and to be represented by counsel. Any petition for a hearing must comply with the requirements of Section 28- 5.201, F.A.C., (copy enclosed) and be filed with the General Counsel of the Department of Environmental Regulation at 2600 Blair Stone Road, Twin Towers Office Building, Tallahassee, Florida 32301, with a copy to this office within fourteen (14) days from receipt of this letter. First, let me state that I am the owner of the property adjoining Mr. Pumo's at 1491 N.E. 102nd Street. I have three immediate matters of concern regarding Mr. Pumo's proposal to place riprap along his currently existing seawall. They are as follows: 1. Navigability of the Canal: As a yachtsman and as an owner of property fronting a navigable waterway (the canal), I must state that I would totally oppose any project which would impair access to the canal by boat from Biscayne Bay. I do not necessarily view this project as having this effect, but make the statement as a matter of record. Other property owners along the canal have expressed this concern to me. 2. Engineering: I question the cross - sectional drawing labelled Section A -A included in Mr. Pumo's application as being a valid representation of the contour of the bottom from the seawall outward inside the mouth of the canal. The canal is quite deep - approximately thirteen to eighteen feet. As I know the canal, once you move three to five feet away from the base of the seawall the bottom drops away quite precipitously. Given this contour, I do not believe that boulders could be placed on this "shelf" so as to give the intended 2 -to -1 slope and still reach a height at the seawall of one foot above mean high water. A rough sketch is attached to demonstrate my point. If my assumption is correct, then I want to know what alternative method of engineering would be used to place the riprap. 3. Increased Hazards to Navigation: In this project, I see two potential instances of increased hazards to navigation. First, consider a situation where a vessel is navigating the entrance to the canal, loses power and is being blown down upon Mr. Pumo's property. With the seawall as it currently exists, this would generally not present a dangerous situation in that members of the crew could fend the boat off the seawall. If the riprap were in place, the vessel's hull would likely strike the rocks before members of the crew could reach the seawall either by hand or with a boathook. The potential for damage to the hull in this case is obvious. Secondly, I am concerned about boulders of the size proposed for the project ending up in the shallow waters outside the entrance to the canal. The waters in this area are shallow. I frequently run with a foot or less 04 water under my keel when entering or leaving the canal. On the positive side, the riprap would be a very attractive addition to Mr. Pumo's property, would indeed be beneficial to aquatic life in the area and would likely reduce wave action in the canal in addition to solving the problem that wE' all have in the area of maintaining the structural integrity of our seawalls. The canal waterway maintains an 80 foot width to the bay. The crane -barge that will place the boulders has a beam width of only 24 feet. The navigability of the wa will remain navigable during and after completion. lit The submitted plan - "Representation of the Bottom Contour" Your cross - section reflects the bottom contour several yards within the canal beyond the dogleg entrance. There are numerous conditions in many areas of our Bay that may become hazard- ous in an emergency. The responsiblity of coping with emergency situa- tions lie with the vessel's captain. With respect to losing a boulder during placement of the Riprap, the boulders will weigh upwards of three tones each - a boulder of that size you just don't lose. I live on and use the canal where this material would be placed, therefore, I have a vital and rightful interest in any changes that are made to this canal. I view any changes to the approach enterance of this waterway as a change to my property and to its value. The drawing, as submitted with the application, states that it is not drawn to scale. Obviously it is not. If you will check the indicated water depths, I believe you will find them much deeper at the seawall and in the canal than shown. If this is so, the rip -rap must be extended much farther than indicated on the drawings. The West shore of Biscayne Bay from Coconut Grove to North of Keystone Point has been bulkheaded for years. The seawall construction is mainly concrete piling with precast slabs between the pilings and secured with a tieback system. This system has been adequate for miles of waterfront property as noted, others have not seen a need to change it. As you are well aware, the placement of breakwaters, groins, or any other protrusion into water where there is a tidal flow effects the depth of the water adjacent to the protrusion. Historically, a build up or washout area will follow. Have you considered the possibility of causing a washout under the existing seawalls to the West? As you can see from the enclosed copy of NOAA chart 11467, water depths at the enterance of this canal are critical to anyone operating a vessel that draws more than 2'. At extreme low tide all but the most shallow draft vessel must enter from the intercoastal at Marker 21 and then proceed along the seawall to the canal enterance. Are you sure that rip -rap at the bay side enterance and the effects of tidal current will not change this all ready limited access? The seawalls in this area are twenty five years old. The current and water flow is established. There are twenty -six homes located on this waterway other than this applicant. None of them have seen a need to change from the existing and - 2 - conventional type of seawall construction. The proposed protect is of concern to me because I am a canal resident, one house removed from the applicant, on the same side of the canal and use the canal for my boat. The proposed project should be held in abeyance until further evaluations are made. Specifically: If common Florida boulders are used, will they he displaced into the canal in the event of a hurricane? This type of boulder is very porous and light in the water. I have seen them moved considerable distance after hurricanes. The canal, at my property line, is about.28 feet deep in the center and the bottom slopes approximately li5 degrees from my seawall to the canal center. If the same situation exists at the applicants property, will the boulders slio into the canal and create a navigation problem? The boulders will create some obstruction to the normal tide flow. Will the tide diversion create undermining at adjacent locations? There is a serious problem with flotsam at the west terminus of the canal. This garbage is pushed into the canal by strong easterly winds and pushed out by weaker westerly winds and tide flow. The boulders will create little obstruction to the in- coming flotsam because of the superior driving force, however, the boulders may entrap the outgoing trash because of the weaker propelling forces. The placing of tons of rocks or "rip -rap" along the sea wall would pose needless real and potential hazards to boating. It would create problems of egress of the large amounts of trash which already is a nuisance during several months of the year. It would be an eye -sore at low tide. It would also set a bad precedent for others who might also consider the same project. As you know, property values on a canal are greatly influenced by its access to deep water, polution factors, esthetics, etc. It is my opinion, and that of many of my neighbors, that the placement of these tons of rocks is a real and potential threat to not only our best interests hut the boating public at large. Will this prevent the sewage from - leaving the canal on a tide change? 2 -Will this ultimately cause a buildup of sand in the canal which will become a hazard to navigation? The values of the houses on this canal are largely based on the accessibility to the bay by boat. 3 -How can some one,be allowed to block off and restrict the use of a public waterway? This'certa:inly would limit the usable width of the canal. How would this be indicated to boat traffic in order that they not incur considerable damage by hitting the rocks? 4 -What guarantees can be made that the rocks will not shift with a strong tide change? This could certainly cause a definite hazard to navigation. 5- Assuming a twelve foot water depth and the riprap exceeding the water level by one foot, a five foot depth clearance would not be available unitl approximately twelve foot from the sea- wall in the canal area. Would this not be dangerous? As both a property owner on the subject canal, and an active boater, I would like to have answers to the above questions. Please advise me of any action that is being taken on this matter. The proposed project, which is located at 1500 NE 101 Street, Miami Shores, Florida involves the placement of 450 Cubic yards of riprap beginning at least one foot above mean high water, along the toe of a portion of a seawall. A permit application for this project has been filed with this Department. An inspection of the land and water areas adjacent to the proposed . site was conducted by this Department on June 9, 1981 at 9:40 a.m. The shoreline is presently bulkheaded with a concrete seawall. There is a break in the seawall on the northeast side of the property. From a point 15 feet southeast of the break in the wall to the west end of the wall, the canal bottom.appears to be too steep to support riprap as proposed. The water depth was approximately four feet at the seawall on the northeast side, three feet on the east side, and two and one half feet on the southeast side of the property at the time of inspection (low tide). The substrate is sand -silt with rocks scattered on top of it. Black Tunicates (Ascidia Nigra); orange sponges and a red alga'(Aconthop hora'Spicifera) have colonized the seawall. Schoolmaster (Lutjanus'A odus)'and gray snappers (Li.Itjanus Griseus), sergeant majors' udefduf. Saxatilis) and a bluehead wrasse (Thala.ssoma'Bifaseiatum) were observed in the area. Dade County Environmental Resources Management has no objection to the issuance of a permit for this project to the following stipulations: 1. If turbidity exceeds 50 J.C.U.'s beyond a 50 foot radius of the - work area, which would be in violation of Section 24 -11 of the Metro Dade County Code, turbidity controls, such as but not ' limited to turbidity curtains, should be implemented at the con- struction site and Dade County Environmental Resources Management should be notified immediately. If turbidity levels do not drop below 50 J.C.U.'s within one hour after implementation of the controls, all construction should be halted. Construction should not be resumed until the contractor has implemented additional control methods and has received authorization from Dade County Environmental Resources Management. AJC:cLm 2. During construction the contactor should take all necessary precautions to prevent debris from falling into the waterway. All material which may fall into the canal should be removed immediately: 3. Written notification should be provided to Dade County Environ- mental Resources Management and the Florida Department of Environmental Regulation, a minimum of forty -eight (48) hours prior to the commence- ment of construction. We believe that if these conditions are made a part of this perTnit and adhered to by the applicant, this project should not have an adverse effect upon the water quality or aquatic organisms in this canal or Biscayne Bay.
