The Code Enforcement Board was created pursuant to
Chapter 80 -300, Laws of Florida 1980, and Ordinance No. 422 -80
of Miami Shores Village. The purpose of this Board is to facilitate
the enforcement of certain codes /zoning ordinances of Miami Shores
Village by creating a Board of six citizens who may quickly and
fairly render decisions concerning violations of these codes /zoning
ordinances.
You are hereby formally notified that on the 6th day
of October , 19 88 , at 7:30 p.m. there will be a public hear-
ing at the Miami Shores Village Council Chambers, 10050 N. E. 2nd
Avenue, Miami Shores, Florida, concerning your violation of Section

BUILDINGS AND BUILDING REGULATIONS*
Sec. 6-1. Adoption of technical codes.
The document marked, designated and known as the "South
Florida Building Code," which is made a part hereof by refer-
ence, is hereby adopted as a minimum standard for the purposes
expressed therein and shall be known as the "Building Code of
Miami Shores Village," and this document shall be as fully effec-
tive as though every word, phrase, sentence or section of the
South Florida Building Code were fully incorporated herein, ex-
cept as modified or added to in sections of this chapter which
follow.

Building Official that the design and/or working drawings are in compliance
with the Code.
(d) Compliance with this Code is the responsibility of the permit holder
until the issuance of a Certificate of Occupancy; at which time it shall become
the responsibility of the owner.
304.3 TIME LIMITATION:
(a) Permits shall expire and become null and void if work. as defined in
Paragraph 304.3(0, authorized by such permits are not commenced within 180
days from the date of the permit or if such work when commenced is suspended
or abandoned at any time for a period of 180 days.
(b) If the work covered ' y the permit has not commenced, or has been
commenced and been suspended or abandoned. the Building Official may ex-
tend such permit for a single period of 180 days from the date of expiration of
the initial permit, if request for extension is made prior to the expiration date
of the initial permit.
(c) If the work covered by the permit has commenced. is in progress,
has not been completed and is being carried on progressively in a substantial
manner in accordance with Paragraph 304.3(0, the permit may be in effect until
completion of the job.
(d) If work has commenced and the permit becomes null and void or
expires because of lack of progress or abandonment, a new permit covering the
proposed construction shall be obtained before proceeding with the work.
(e) If a new building permit is not obtained within 180 days from the
date the initial permit became null and void, the Building Official shall require
that any work which has been commenced or completed be removed from the
building site; or he may issue a new permit, on application, providing the work
in place and required to complete the structure meets all applicable regula-
tions in effect at the time the initial permit became null and void and any
regulations which may have become effective between the date of expiration
and the date of issuance of the new permit.
(f) Work shall be considered to have commenced and be in active pro-
gress when. in the opinion of the Building Official, a full complement of work-
men and equipment is present at the site to diligently incorporate materials
and equipment into the structure throughout the day on each full working day:
weather permitting. This provision shall not be applicable in case of civil com-
motion or strike or when the building work is halted due to legal action.
(g) The fee for renewal, reissuance and extension of a permit shall be
as set forth by the administrative authority
304.4 REVOCATION OF PERMIT:
(a) The Building Official may revoke a permit or approval issued under
the provisions of this Code in case of any false statement or misrepresentation
of fact in the application or on the plans on which the permit or approval was
based.
(b) Whenever the Building Official reasonably believes the work for
which a permit has been issued is not being performed in conformity with
plans. specifications or descriptions, or approved plans are not being kept at
the site. it shall be the duty of the Building Official to notify the contractor, or
owner. or their agent, in writing, that the permit is suspended. Written notice
shall be mailed or given to the permit holder or his agent, and it shall be
unlawful for any person or persons to perform any work in or about the build-
ing or structure except such work as may be required for the correction of the
expressed violations. And if. in the judgment of the Building Official, there is
imminent danger that requires immediate action, the permit may be revoked or
suspended verbally and written notice served later.

Chapter 10
HEALTH AND SANITATION•
Sec. 10-1. Property to be maintained in safe, clean and sightly
condition.
It shall be the duty of all owners of lots, parcels and tracts of
land within the village to keep such property in a safe, clean and
sightly condition and to remove therefrom all surplus grass, weeds
and other growth and all trash and rubbish and to fill in all
excavations and depressions thereon.

Sec. 10-2. Failure of owner to maintain property — Service
of notice to comply.
(a) If the owner of any lot, tract or parcel of land within the
village fails or refuses to keep such property in a safe, clean and
sightly condition as provided in the preceding section, it shall be
the duty of the village manager to give notice as provided in
subsection (b) of this section to the owner of such property to
comply with the requirements of section 10 -1 within ten (10) days
after the service of such notice.
(b) The village manager shall give such notice to the owner of
such property at his last known mailing address as disclosed by
the files in the village office or upon any occupant thereof, or
upon any agent or employee of the owner thereof, and if the
address of the owner is unknown to the village manager and if
the property is unoccupied and the owner thereof has no agent or
employee available for service of such notice, the posting of a

include the total amount thereof in the statements submitted to
the owner of such lots, tracts or parcels of land.

Sec. 10-5. Maintaining source of noxious odors or gas, dis-
turbing noise or other nuisance.
It shall be unlawful to maintain any source or cause of noxious
odor or gas or of any loud, disturbing noise or other nuisance, or
to cause the same to exist.

Sec. 10-6. Excavations, removal of soil —When prohibited.
It shall be unlawful to remove the soil from any property
located within the village to such an extent that water will
remain in the place from which such soil has been removed, or if
any such excavation is of such a depth or covers such an area that
the same creates a hazard or is detrimental to surrounding prop-
erty, or if such removal shall in any way be detrimental to the
public welfare, health and safety.

HEALTH AND SANITATION § 10 -7
Sec. 10-7. Same — Application for special permit.
It shall be the duty of the village manager, upon proper request
being made, to ascertain if such removal of soil as may be desired
by any owner of property within the village conflicts with the
provisions of section 10 -6, and if he so finds that such removal is
of a nature that does not conflict with the purpose and intent of
such section, he may in such cases issue aspecial permit for the
removal of such soil, the extent and amount of such excavation to
be determined by the village manager. The issuance of such
permit and the determination of removal of soil and excavations
resulting therefrom shall be first passed upon and approved by
the council after written application for the same has been made
to the village manager as aforesaid.
