SECOND AVENUE MIAMI SHORES, FLORIDA 33138 (305) 758 - 8000 Re: Lots 12, 11, 10, 9 and 8, Block 80, Miami Shores Section 3, Plat Book 10, at Page 37, Public Records of Dade County, Florida. In 1977 the owner of the above described lots, Dean R. Claussen, requested approval of Waiver of Plat dividing Lots 8 -9 -10, Block 80, into two building sites of 75 ft. each. On lots 11 and 12 there was an existing house, 910 N. E. 99th Street, which he planned to remodel. On March 1, 1977, the Village Council approved the Waiver of Plat on Lots 8 -9 -10, Block 80, M. S. Sec. #3, conditioned on removal of encroachments and with knowledge of the non- conforming setback on the existing building on Lot 11. The Waiver of Plat was approved by Dade County on March 18, 1977, thereby creating two building sites: Lot 10 & the west half of Lot 9, and Lot 8 and the east half of Lot 9, Block 80, Miami Shores Section 3 The existing house at 910 N. E. 99th Street was subsequently remodeled. There exists a non - conforming setback of 5 ft. on the east side of Lot 11 which was permitted to remain since it was existing. The only restriction on the property would be in attempting to enlarge the non - conformance of that setback which would require a variance. Construction on Lot 10 and the west half of Lot 9 will require 10 ft. side setbacks. A copy of the Waiver of Plat on the property to the west of Lots 12 and 11, showing the encroachments that previously existed, and approval by Dade County with requirements for removal of the encroachments, is attached. VILLAGE MANAGER r A regular meeting of the Miami Shores Planning and Zoning Board was held at 7 :30 p.m. , February 10, 1977, at the Village Hall, with the follow- ing members present: present. MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING February 10, 1977 Mr. James O. Denham, Chairman Mr. Gordon H. Moyer, Jr. Mr. Kenneth R. Phoenix Mr. Albert R. Toussaint Mr. Robert Stobs, II Mr. William R. Bradford, Building and Zoning Director, was also Minutes of the last regular meeting were approved as written by motion made by Mr. Toussaint, seconded by Mr. Stobs and passed unanimously. (1) A request was made by Mr. Dean R. Claussen for approval of Waiver of Plat dividing Lots 8 -9 -10, Block 80, Miami Shores Section #3, into two building sites of 75 ft. each. Discussion arose over encroachments that were shown on the survey and what the setbacks are on the house to the west. Mr. Toussaint moved that the Board defer action on this request until such time as the builder can advise the Board of the disposition of the garage and wall that is encroaching and of the setback of the existing buildiing on Lot 11. The motion was seconded by Mr. Stobs and passed unanimously. (2) The lighting for Dr. Jay Ellenby's tennis court, 1009 N. E. 94th Street, was again discussed. Since the last meeting members of the Planning Board had reviewed some lighted residential tennis courts. Mr. Moyer moved that the request be granted providing that proper shades be applied to the lights, that full wind screening be provided, that a time be set for night play not to exceed 9 :30 p.m. and that final plans be submitted for approval of the Board. The motion was seconded by Mr. Phoenix and passed 3/2 with Messrs. Toussaint and Stob s •dissenting. The meeting adjourned at 8:00 p. m. The motion was seconded by Mr. Davis and carried unanimously. Mr. Jack Shafer objected to the ordinance, Mr. Lou Sauber, who was organizing a membership drive, and other citizens present. Planning & Zoning Board minutes. A request was made by Mr. Dean R. Claussen for a Waiver of Plat dividing Lots 8- 9 -10., Block 80, Miami Shores Section #3, into two building sites of 75 ft. each. Because of certain encroachments shown on the survey, the Planning Board deferred action until disposition of these encroachments is known as well as the setback of the existing building on Lot 11. The Village Manager recommended that if some satisfactory guarantee can be given by Mr. Claussen as to the encroachments, with a bond or letter of intent, that the Council would have the choice to approve the request. After some discussion Mr. Condit moved that it be deferred until the Planning Board acts on it. The motion failed for lack of a second. Mr. Davis then moved that the Council allow Mr. Claussen to proceed if he gives a letter of intent or bond for the encroachments. This motion failed for lack of a second. Mr. Fann advised that consideration of the Waiver of Plat was not before the Council at this time since the Planning Board had not acted on, it. r r present. MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING February 24, 1977 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7 :30 p. m. , February 24, 1977, at the Village Hall, with the follow- ing members present: Mr. James O. Denham, Chairman Mr. Gordon H. Moyer, Jr. Mr. Kenneth R. Phoenix Mr. Albert R. Toussaint Mr. Robert Stobs, II Mr. William R. Bradford, Building and Zoning Director, was also Minutes of the last regular meeting were approved as written by motion made by Mr. Moyer, seconded by Mr. Toussaint and carried. (1) A request was made by Mr. & Mrs. Tom Fitzgerald of 801 N. E. 91st Terrace, for permit to change the roof covering on their residence from cement tile to asphalt shingle. This request was based on a financial hardship due to the fact that the cost estimate of a tile roof is $3500. 00, whereas the shingle is $1840. 00. The Fitzgeralds contended there were other compo- sition roofs in their area as well as on more expensive homes in other areas of the Shores. This was brought before the Board because it has been an established practice that re- roofing must be of the same type as the original roof. After discussion Mr. Toussaint moved that the request be denied. The motion was seconded by Mr. Moyer and passed unanimously. (2) A request was made by Mr. David D. Lococo of 10707 N. W. 1st Avenue, for permit to erect a 4 ft. chain link fence in the front and side yard. In remodeling the house in 1968 the Village permitted the address to be changed from 107th Street to N. W. 1st Avenue on which there is only a 10 ft. setback. This now creates a question as to the established front and side yard, Zoning regulations restrict front yard fence height to 3-1/2 ft. , of ornamental masonry or ornamental metal but not including any wire fence. Mr. Lococo presented a letter signed by 10 of his neighbors consenting to the chain link fence and height. After discussion Mr. Stobs moved that the Board deny Mr. Lococo's request for a 4 ft. chain link fence in his front yard. The motion was seconded by Mr Toussaint and carried unanimously. . (3) The request made by Mr. Dean R. Claussen for Waiver of Plat on Lots 8 -9 -10, Block 80, M. S. Sec. #3, was again reviewed for information on the encroachments and setback of the existing building on Lot 11. Mr. Claussen assured the Board that he intends to remove these encroachments when required and reported that the setback on the house on Lot 11, is 5 ft. After discussion Mr. Phoenix moved that the Board approve the Waiver of Plat creating two building sites from three 50 ft. lots (8, 9, & 10 of Block 80), with no restrictions on the new east lot, and that when the west lot is being built on that Mr. Claussen give some assurance that the encroachments will be removed, and that the setback on the property to the west be maintained since it is existing. The motion was seconded by Mr. Moyer and passed 4/1 with Mr. Toussaint dissenting because of the 5 ft. setback it will . be creating. (4) The Board reviewed the plans prepared by Mr. Bradford for the new public works facility at 103rd Street and 17th Avenue, and the addition to the Village Hall. The motion was seconded by Mr. Davis and passed 3/2 with Mayor McIntosh and Councilman McLeod dissenting. The Planning Board denied a request made by Mr. David D. Lococo of 3/1/77 10707 N. W. 1st Avenue, for a permit to erect a 4 ft. chain link fence in the front and side yard of his home. Mr. Lococo was present to appeal this decision. The house originally faced on 107th Street but in 1968 the address on N. W. 1st Avenue was approved by the Village. The question now presents itself as to which is the front yard, on which there is a height limit of 3-1/2 ft. , and, a restriction against chain link as fencing material. Mr. Davis moved that the Council postpone any ruling on this request until Mr. Bradford is present at the meeting. The motion was seconded by Mr. Condit and passed unanimously. The request made by Mr. Dean R. Claussen for Waiver of Plat on Lots 8 -9 -10, Block 80, M. S. Sec. #3, was approved by the Planning & Zoning Board, conditioned on removal of encroachments. Mr. Davis moved that the Waiver be approved as recommended by the Planning & Zoning Board. The motion was seconded by McLeod and passed by four affirmative votes, with Mr. Claussen abstaining. Request for lighting of Dr. Ellenby's tennis court at 1009 N. E. 94th St. , was brought up for Council action, previously approved by the Planning Board. Mr. Condit moved that the lights be approved as recommended by the Planning & Zoning Board. The motion was seconded by Mr. Claussen and passed 4/1 with Mr. Davis dissenting.
