E. 2ND AVENUE MIAMI SHORES, FLORIDA 33136 (305) 754 -5424 This is in response to an inquiry of the planning board with reference to approval of an accessory structure, as same appears in the planning board minutes of April 27, 1989 and being item number 6 thereof. In my opinion, the skateboard ramp as described in the minutes is contrary to ordinance number 270, as amended. Section 205 of Ordinance number 270 defines a building as any combination of materials forming any construction, the use of which requires location on the ground or attach- ment to something having location on the ground. Therefore, the structure in question is a building under the code. Section 225 of the Code requires masonry construction in the erection of all buildings with the exception of those structures specifically enumerated in the sub sections thereof, including carports, trellises, arbors, and pergolas, etc.. A skateboard ramp does not fall within any of the definition which appear as an exception to masonry construction under section 225.
