Village is concerned with this problem. You did not permit

to Mrs. Sweat for the condition of the house.

We need your advice as to how to proceed in a situation
existing at 1228 N. E. 98th owned by Mrs. Mary T. Sweat. The
house was constructed in 1952 and several months ago the walls
on either side of the double garage developed large cracks. We
contacted the original builder who did some excavations and poured
additional concrete under the footings; he paying for the labor and
Mrs. Sweat, for the material. She did not permit him to fill the
cracks or separations. I heard no more of the matter until last
week and after inspection of the property along with Mr. Rudnick
we concluded that maybe we should have an unbiased engineer make
a study along with the various testa that might be required.
The question now arises as to what position the Village
would be in after we have paid for such a study and report. If
faulty construction is found, can we be charged with negligence
for permitting such construction? I would appreciate your answer
as soon as possible.

After test holes were dug and investigation was made to determine size
of footing, photographs were taken of 9 test holes.
Test holes were filled and grass replanted, also inspected under house.
Results All test holes indicated 10 inches or deeper, footing bearing on a stable
'sand and lime .. rock soil.
The settlement crack in the garage area does not appear to have increased
in the last,few years. Marks have been placed on the wall to determine if
settlement occurs in the future.
Separation of shoe mold from floor appear; to be due to normal shrinkage,
'and a concentrated load (a large radio) mid span at floor joist. ' There are
no cracks in the wall in this area, and it is sate to say that there are no
structural failure in this area
At. 3 a.m. September' 19, 1966, Mr. Markel, former Chief Building
Inspector, Mr. A., T. Strother, Product Control Supervisor, and Mr. W. R.
Bradford, investigated settlement mentioned above.
Mr. Markel stated that the cracks were no greater now than they were
several years ago. • Mr. Strother stated that he could . see nothing that would indicate negligence
on the part of the Building Deptrtt ent, and that he would be glad to testify
for the Village 'in the event of court action.

to fill cracks with stucco, eliminating possibilities of water infiltra-
tion, and prohibit shelter for insects, vermin etc.

At your request, I made an inspection of the referenced job with you and
Mr. C. H. Markel, former Chief Building Inspector for Miami Shores on
September 16, 1966.
A check of your records shows a permit was issued December 30, 1952 on
the plans prepared by Mr. Gerard Pitt, AIA. In reviewing the plans and
the residence, I could find no discrepancies or any evidence that the
Building Department was negligent in inspecting this job. This building
does xcr- comply with the approved plans.
As for the settlement crack to the northeast wall of the garage, it appears
there was some unstable soil condition that developed seffie 2 -mss_ after this
job was completed. The foundation for this wall was in accordance with the
plans and no further settlement has occurred since a concrete pad was placed
under the footing.
The settlement of the living room floor on the west wall is between to 3/4
of an inch. The owner stated this house had been badly infested with termites.
The floor joists could have been weakened by these termites and caused this
settlement. The protection of a building from termites is the responsibility
of the owner.
It should be remembered this residence was built in early 1953 and the
complaint of the owner was only recently called to the attention of the
Miami Shores Building Department.

Residence at 1228 N. E. 98th Street - Cracks in Northeast
This home was constructed. in 1952 and. was sold. new to Mary
T. Sweat and. Beni DiMascolo. In 1959 Mrs. Sweat asked. us to examine
the garage wall that had. d.eveloped. cracks at the northeast corner. The
cond.ition was examined. by several people including Councilmen and., I
believe, the Village A.ttorney. The Village A.ttorney advised. that there was
no liability to Mrs. Sweat for the cond.ition of the house and. on July 13,
1959, she was so advised.. At some time during that year the original
contractor did. some additional concrete work underneath the footing of
that section of the garage at her expense.
Recently Mrs. Sweat called. to say that she had. been ill for
several years but was now renewing her claim that the Village was liable
for the alleged. cond.ition of the foundation of her garage stating that she
did. not believe the Village had. rend.ered. proper inspection during construc-
tion. With Mrs. Sweat's consent we mad.e a new inspection of her property
in September which is record.ed. in the attached copy of report (pictures
referred to in report on file in Village Manager's office) and also letter
from the Metropolitan Dade County Building Department.
Mrs. Sweat insists that the matter be again brought before
the Council and that the Council as a group view her garage wall condition
and that her claim for compensation be granted..
