Sec. 6 -3 Air Conditioning Regulations.
(a) All individual air conditioning units installed in walls or windows shall be securely anchored
to the walls by approved methods. Units installed over public property, paths of egress or more
than ten (10) feet above grade shall be secured to the structure by bolts or screws to resist horizontal
wird loads. Such units cantilevering more than eight (8) inches on the exterior of a building shall
be supported by steel angle brackets secured by bolting. Bolts to masonry shall be set in lead shields
or similarly rot - resistant fastenings.
(b) Tie following special requirements shall apply to the control and regulation of noise nuisance
from air conditioning machinery.
(1) All equipment, existing or hereafter installed, regardless of location, shall be
maintained in good working order. Equipment so located that normal operating
noises create a nuisance to adjacent owners or occupants shall be provided with
soundproofing, or sound- absorbing baffels, or enclosures, as approved to insure
maintenance of a reasonable noise level.
(2) All equipment on outer walls, on roofs, or in the other exposed locations, which are
unduly noisy, and which causes valid complaints from adjoining property owners or
occupants may be required to be relocated, redesigned and/or enclosed in noise-
retarding materials when, in the opinion of the building official, such enclosure is
necessary or would be effective.
Special consideration shall be given to the planning of all future installations to
minimize the noise nuisance to adjoining property owners or occupants and the
budding official cha11 have authority to reject or require the redesign of any system
which, in his opinion, would cause such a noise nuisance.
(c) Violation of this section shall be punished as is now or may hereafter be provided by law
(Ord. No. 299, Sec. 1 -3, 2- 21 -61).

All buildings shall be generally harmonious in character and
appearance, including exterior color, with existing buildings in
the neighborhood and shall be appropriate to their surroundings.
In the event that an application is made for a building permit for
the construction of a building, or the performance of work on an
existing building, that, prima facie, would be inharmonious or
inappropriate in the manner indicated above, such permit shall
not be issued except on recommendation by the planning board
and approval by the village council, as provided in Article VI.

RE: Exterior Color Selection
Dear Board Members:
I have personally dealt with you regarding color in the past, and now I find myself
in the position to present before you the same difficult and subjective question of color for
my own residence.
We have a home, which I consider boring, with no style and no identifiable notable
features. It was build in 1955, and lacks all the beautiful details and architectural
elements of a Mediterranean Revival or any historical home. I feel that it is my duty to
embellish the home with other tools. The only tools that are left without changing the
architectural integrity of the house, are color and landscaping. One without the other
would still leave the house as it now stands, barren and non - descriptive.
To understand my color choice, you must understand the materials of the home. My
goal is to achieve obvious contrast between the vertical stucco surfaces and the accent
brick all around the house. By keeping the accent (brick) white, the roof white, and the
roof overhang white, what would remain of the contrast color would be insignificant. For
the contrast color I am choosing an earthy color that is appropriate for our climate and our
surroundings, a light terracotta, that would create a stunning backdrop for greenery and
landscaping that will later be planted.
The proposed color is neither inappropriate nor offensive to the adjacent properties.
None of the houses that surround us are painted Terracotta; but then again, none of the
houses that surround us even resemble the architecture or materials of our home. So the
question of context should not only apply to the colors of the structures, but also
architecture, materials, massing, and landscaping. Our home is the only one with a huge
Ficus in the front yard, it certainly stands out, but I would never even entertain the idea
of cutting it down.
I believe that the question put forth before you should be approved
because the house will be harmonious in character and appearance with
existing buildings in the neighborhood and will be appropriate to its
surroundings.
The current non - existing color code is unjust. It does not provide a single non -
subjective and clear choice of colors. Every resident must face at least 2 subjective
opinions when going through the process of color selection. In my opinion, there is no
reason for you to deny my petition as presented. Our ultimate goal is to improve our home
and our surroundings, and the first step is COLOR.
