I would like to request a variance to the ordinance based on the reasons listed below. I am also attaching a petition signed by my neighbors regarding our pool. Please note that no one has ever complained about the pool, instead everyone has been very supportive and, in fact, surprised that there is such an ordinance in Miami Shores. My husband, Angel Muniz and I, have lived at this address since September 6, 1988. We have had an above ground pool in our backyard since the summer of 1990, when our first son was a year old. We chose an above ground pool both because of price and safety. Without the access ladder in place, no child may enter an above ground pool, thereby preventing children from falling in the pool and drowning. We find this type of pool to be safer for our children, and any other children who may be in our backyard. During the course of 1997, we had construction done in the back of our home to add a cement porch. During this time, members of the Zoning Department's staff visited our home for inspections of the ongoing construction. During this entire time also, the above ground pool was present and in use at my home. Never at any time did anyone mention to us that it was against any code. This pool was never hidden from view to the rear alley and in fact code enforcement officers have been down the alley many times over the years and never mentioned it. The above ground pool has not been an issue with our neighbors nor has caused any discomfort to the community. As I read the pertinent ordinance, no direct mention is made of prohibition of an above ground pool. We strive to keep our property and our home attractive and safe. We are an integral part of our community also and wish to continue to be good neighbors. We feel that this pool Diane V.
