APPEAL
Applicant is appealing the decision of the Building Official denying the
color selection for the house.
STAFF ANALYSIS/RECOIVIMENDATION
The applicant seeks to have the color of the house approved by the Planning
and Zoning Board. The house came before the Board last April on a paint
appeal and passed by a 3 -2 vote. A paint permit was taken out on 4/25/00
and the house was never finished. For several months, the house remained
incomplete and on July 13, 2001, Mr. Michot was notified that his permit
had expired (6 months) and that he would need to obtain a new permit and
finish painting the house. Mr. Michot chose to finish painting the house
without getting a permit. The Historical Board approved his paint
application and he now must obtain approval of the Planning and Zoning
Board. Staff does not feel that this paint color is harmonious with the houses
in the neighborhood.

I am writing with regard to the expired paint permit on your house. Because
the permit is expired and the house has not been completed (permit issued
4/25/00), a new permit is required. While I can understand certain delays, I
cannot understand why a house should be left half done for over a year.
Please apply to Village Hall for a new permit and paint the house
completely.

A regular meeting of the Miami Shores Village Historic Preservation Board was
held at Village Hall on Tuesday, October 9, 2001. The meeting was called to order at
7:40 p.m. by Chairman Bittner with the following members present and absent:

Ms. Collins moved to approve the minutes. The motion was seconded by Mr.
Tenney and passed unanimously.
PUBLIC HEARING ITEMS

Maintenance or Repair: Recover Awnings with new Canvass Material;
Renew Expired Painting Permit
Mr. Michot appeared and indicated that Code Enforcement had cited him for
recovering his existing awning frames with new material and required him to obtain a
permit. This, in turn, required him to apply for an after - the -fact Certificate of
Appropriateness. Mr. Michot used a solid Navy Blue Canvass and indicated that the
work had already been paid for. Mr. Bittner cautioned Mr. Michot that in the future he
not do work to the exterior of the home without first obtaining a Certificate of
Appropriateness. In addition, Mr. Bittner indicated that, had Mr. Michot not already
completed the work and paid for it, he would not have voted to approve the use of the
material chosen by the home owner, and would have encouraged to Board to require a
stripped canvass material. Mr. Bittner indicated that it was the policy of the Board to
utilize a stripped material on the 1920's Mediterranean homes because this was more
appropriate to the 1920's time period. After some discussion, Ms. Temkin moved to
approve the color of the awnings, seconded by Ms. Blas, which motion passed
unanimously.
On the issue of the renewal of the paint permit, Mr. Michot indicated that his
permit had expired and he just wanted to finish painting the house the same color the
Board had earlier approved. Ms. Temkin moved to approve the Application, seconded by
Ms. Collins, and the motion passed unanimously.

to 5:00 p.m. No inspections will be conducted on weekends or holidays.
2. All construction of demolition areas MUST BE MAINTAINED IN A CLEAN, NEAT AND SANITARY CONDITION free from construction debris.
3. STREETS AND NEIGHBORING PROPERTIES SHALL BE KEPT FREE FROM DIRT AND DEBRIS.
4. SWALES MUST BE PROTECTED FROM BEING DAMAGED BY EQUIPMENT OR VEHICLES, AND MAY NOT BE USED FOR STORAGE. A bond is
required for work in or near the street/sidewalk.
5. CONSTRUCTION TRAILERS ARE PROHIBITED ON SINGLE FAMILY RESIDENTIAL CONSTRUCTION SITES. Other construction may have a trailer
which requires a separate permit.
6. PORTABLE TOILETS for a construction site require a separate permit.
7. DO NOT DISCHARGE WATER INTO THE RIGHT OF WAY OR STORM DRAINS without approval from the Building, Planning and Zoning Department.
8. EQUIPMENT AND MATERIALS SHALL BE STORED at least 10 feet from the edge of pavement.
9. Department of Health and Rehabilitative Services (HRS) approval is required for applications involving septic tanks. Department of Environmental Resources
Management (DERM) and/or Miami -Dade Water and Sewer Department (MDWASD) approval is required for applications involving sewers.

This memo will serve as confirmation of a conversation that I had with Maria Temkin,
Vice Chair of the Historic Preservation Board. I contacted Ms. Temkin because I had
received an application for a Certificate of Appropriateness from Mr. Michot of 61 N.E.
96 Street to paint his house trim. The color choice matched the existing paint color.
After reading the applicable code section, I contacted the Village Attorney and advised
him that I did not think that a certificate of appropriateness was necessary. He
suggested that I contact Mr. Bittner, Chair of the Board. When I tried to reach Mr.
Bittner, I learned that he was on vacation for the week. I then contacted Ms. Temkin to
get an opinion as to whether or not she felt the Historic Preservation Board would need
to rule on this request. She concurred with my opinion that a certificate of
appropriateness was not necessary.

Good Afternoon.
Enclosed is my reapplication packet for our home at 61 ne 96th street, an Historical
Miami Shores home built in 1925.
Our original permit for color and painting was #46676 approved by by both the
Historical board and the Village board.
I am in front of the board because the permit expired before the entire project was
completed. Upon notification I took off several days of work to complete the final
coat of paint on the second floor east side bedroom and chimney. the eastside was
painted with the 3rd coat but did not have the fourth and final coat while the
chimney had the flat white 2 coats of primer. this work was completed in a very
timely manner,but in violation of the time constraints of the permit. My reason for
was that i was breaking some of the tiles to the new high S tile roof that was
put on at the same time. Being a little nervous up there, none the less, I completed
project after the first "nudge notice." I do regret not having finished the project in
time period, but I first sandblasted the exterior then applied two primer coats and
two finish coats all by hand, and all with a four inch brush!!! (this is the best method
for the lime base paint that is typical of Spanish -Med homes of the period.) Also,
this paint costs approximately $70. per gallon.
My problem is probably trying to do to much at the same time....new roof, installing
11 mature palms, repainting inside as well. Guilty of trying to improve everything
simultaneaously.
Constantly we recieve compliments on the house color, addition of the tropical
landscape by both neighbors and people driving by

I am writing with regard to the expired paint permit on your house. Because
the permit is expired and the house has not been completed (permit issued
4/25/00), a new permit is required. While I can understand certain delays, I
cannot understand why a house should be left half done for over a year.
