E. 2nd Ave. Miami Shores, Fla. 33138 Dear Mr. LuBien: Some other problems I've encountered are: August 15, 1978 On January 31 of this year, I contracted Air -Flow Industries to construct a pool, patio and enclosure. Work was begun in March and according to our contract, work was discontinued until such time as I could draw on my construction fund to make progress payments. However, there have been other delays after payments were made to them -- the most recent being following a $2500 payment on June 24. At that time I was told that the patio would be poured and the pool completed (except for the screening) by the end of the following week. After hearing their full repertoire of excuses including "bad weather ", "unable to locate their crews ", "concrete not available ", "ran out of materials ", they began pouring my patio 5 weeks later. On August 8th I attempted to telephone the Company's president,• Gene Latham, and was told he was out of the office. I left a message to have him call me regarding replacement of a piece of border tile on an outside corner of the pool. This is required to correct the obvious poor workmanship where the grouted joint is 3/4" wide. Even a layman knows that there is a corner "bullnose" piece of tile that should be placed to turn the corner. I was told by their scheduler, Oscar Padron, that Gene Latham said they would not fix the tile and work would be stopped until the next payment of $3300 was received, which will make a total of $9,873 paid to date. I told Oscar to tell Gene that I would not make another payment until Gene returned my phone call to resolve this problem. Oscar said he would relay the message to Gene. On August 10, I received a Mailgram advising me of the work stoppage. I then telephoned Oscar and told him I was prepared to make the payment when Gene returned my call. I still have not heard from Gene. 1. They refused to remove the sod before placing gravel fill on the patio. As you know this could result in a cracking of the slab when the sod converts to compost. r Mr. Frank J. LuBien Page 2 August 15, 1978 2. The pool was supposed to be poured at the same level as an existing cabana floor slab and doorway to my garage. However, the pool was poured 32" below this level and I will now have an unwanted step -up to these areas. The patio is poured unevenly across the front of these doors and I simply want to be assured the chattahoochee will at least level this off. I could not begin to tell you the personal inconveniences and dissapointments my family has needlessly endured but am certain that you would want to know from a building and permitting aspect as an official of our Village.
