These events are: (1) Lots 6 & 9 were purchased June 1978 (2) Ordinance 404 became effective August 15, 1978 (Enclosure A) (3) E. Pedinielli purchased house on Lots 7 & 8 in Oct.1979 (Enclosure B) In view of the above, Lots 6 & 9 are legally entitled to the rights and privileges of any other 50' lot in Miami Shores prior to Ordinance 404 (dated 8- 15 -78). However, Mr. Baron, attorney representing E. Pedinielli, stated at the March 22 meeting that it was his legal opinion that Lot 9 was not a buildable lot, because of the wording of Ordinance 404 (Enclosure A): "where permanent improvements have been erected on both side lots contiguous thereto," - the Board responded to Mr. Baron's comments by ignoring the previous time- table of events, (purchase dates, Ordinance 404 effective date, etc.) as well as the recommendation for Variance approval by the Building Inspector. My request was tabled once again saying that it was now a legal matter and the Board members present needed counsel from the Village Attorney. A/ It is interesting to note that right on NE 96 Street there exists two identical situations. See Enclosure C. The first is situated 100' away from Mr. Baron's residence. Lots 4 & 5, Block 81. The second is diagonally across from E. Pedinielli's residence. Lots 21 & 22, Block 99. Mr. Baron further stated that E. Pedinielli purchased her house from Dr. McMillan, which would lead one to believe that it had to be purchased about the time I bought lots 6 & 9. This is not true, as E. Pedinielli bought her house in October 1979 from John Kilpatrick et al., 14 months after Ordinance 404 became effective and this information was available to any and all interested parties. See Enclosure B. Property taxes have been paid on Lots 6 & 9 for the past twelve years at comparable assessed valuation rates of building lots in Miami Shores. See Enclosure D. I expect this matter to be resolved at least by the next meeting of the Board on April 12, 1990, which will be my third appearance before the available Board members. However, due to long standing plans to be on vacation this week, they are unable to attend Thursday night's hearing. As they will be the most knowledgeable witnesses available to me, please consider this letter as my request to defer this matter until the next zoning board meeting. I don't believe Mr. Denton would be prejudiced by an additional two week delay. Mrs. Pedinielli contacted Mr. Denton before her departure asking him to agree to a postponement. His response was that if she were having a baby or there was a death in the family he would acquiesce to a deferral, but because her reason was a vacation, he would not. A fallout or bomb shelter may be constructed within five feet of the rear property line in all districts and without regard to the spacing require. ment applicable to buildings located on the same premises if such shelter is attached to an existing building or accessory to an existing building; provided, that such shelter shall otherwise conform to all other setback requirements prescribed for the principal building and further provided, that such shelter shall be designed and constructed in accordance with the provisions of the South Florida Building Code, approved by the planning board and the council, and in accordance with the minimum specifications and requirements es prescribed in the pam- phlets published by the office of Civil and Defense Mobilization desig- nated as Fallout Shelter Surveys; Guide for Architects and Engineers, MP -10.2 National Plan Appendix Services, May 1960; Family Fallout Shelters of Wood, NP -21, December, 1960; The Family Fallout Shelter, MP -15, June, 1959; and Clay Masonry Family Fallout Shelters, MP -18, February, 1960, which pamphlets are hereby adopted as a part hereof by reference. 11.
