As requested on June 27, 1993, I met with a superintendent from Witters
Construction at referenced address to observe a damaged window lintel on the west
wall of the home.
Subject lintel supports a block bearing wall, presumably supporting the roof and
second floor of the structure. Probing into the lintel revealed extremely
deteriorated concrete with no appreciable structural strength.
This office recommends shoring the second floor and block wall to relieve all
load on subject lintel, then removing the lintel and any associated reinforcing
steel. The first block course above the lintel should also be removed to provide
depth for the new lintel. This work should be done along the length of the
window, plus 12" on either side to provide bearing.
A new lintel of approximately 8" x 18" must then be formed and poured in intimate
contact with all remaining block work. Reinforcing will consist of 2 #6 bottom
bars and 2 #5 top bars with #3 ties at 8" o.c. throughout. Masonry units at
either end of the window should be filled with concrete and reinforced with 1
#4 bar in the cell adjacent to the window. Shores should remain in place until
concrete has attained a strength of 3000 psi.

Presently, the home is equipped with jalousie windows that had been
installed by previous owners in the 1950's or 60's. There is only
one (1) window that appears original to the home, and it is located in
the storage room in the rear of the building. Since late summer, I have
been researching several manufacturers in the area who would be able to
replace the jalousies with something that would be more appropriate, using
the original plans for the home. I found several carpenters and door
makers who could make wood casement and single -hung windows. However,
these windows would not meet "code ", and therefore, I was told that I
would not be able to have them installed. I then researched several
window manufacturer s who informed me that they could make wood casement (cont.)

windows, but because of the unusual sizes of the windows, and because of the
specifications indicated in the plans (i.e. the number of lights on each window),
a 33 x 48$ window would cost me approximately $550.00, without installation
or the requisite storm panels. I propose to replace the jalousie windows with
white, aluminum single -hung, 1/1 windows, as well as with casement windows that
will be custom -made for the home, per the plans. Though this is not the ideal
situation, these windows would be in keeping with the original style of the home,
and they meet code. In addition, they are a fraction of what the wood casement
"code" windows would cost. The company that I will be using to replace the windows
also replaced all the windows on the Freedom Tower in downtown Miami. I assure the
Board that the windows on the front of the house will be casements, per the plan.
Finally, I would like to say that this "window situation" has presented me with
nothing but headaches. For the past several months, I have hit brick wall after
brick wall. I have spoken with building people from the City of Miami, Metro -Dade
County, the city of Coral Gables, and Miami Shores. Though everyone was sympathetic
to my situation, I was told that rules were rules, and that I had to conform with
the building codes. I was also quite upset when I learned that I would have to
install storm panels over the "code" windows that I replaced, despite the fact that
this would alter the look of my historic home. I have approximately thirty (30)
windows and doors that I must replace in my home, and I simply cannot afford to
spend between $18,000. and $20,000.00 for materials alone.
I am very happy to live in the Miami Shores Village, and I am proud of my home
and all the work that my husband and I have done, and will continue to do. I
want our home to�a "grand lady" on the boulevard, and will continue to work hard
to ensure that it is.

SUBJECT: Appeal of the Preservation Board's Decision
After speaking with you this afternoon, I have decided not to continue with
the appeal regarding the Board's recent decision not to approve a Certificate of
Appropriateness for aluminum single -hung windows.
Due to the present window situation in my home, I cannot wait any longer to
replace the windows in my child's room, and am therefore replacing the jalousies
with the previously approved wood casement windows, despite the fact that they are
quite costly.
I ask that the Council be given a copy of the letter that I had originally sent
you regarding my desire to appeal the Board's decision, and ask that they make
note of my disagreement with the Board's decision.
Finally, I would like to thank you for time and patience, and I sincerely

On Monday, December 29, 1997, I appeared before the Historic Preservation
Board for a Certificate of Appropriateness to replace jalousie windows (which are
not original to my home) with white aluminum, single -hung windows on the rear,
and sides of the structure. The Board denied my application, stating that the
windows were not in keeping with the original plans, and that I should consider
replacing the jalousies with wood casement windows. I informed the Board that the
windows which I had placed a $600.00 deposit on met code, were more appropriate,
would not effect the front facade of the home, and were each approximately $300.00
cheaper than the wood casement windows.
At present, some of the jalousie windows are broken, and as Mr. Lubian can
tell you, would be quite unsafe in the event of a hurricane or other severe storm. In
addition, I had informed the Board that I would replace the jalousies on the front
facade of my home with aluminum casement windows that would like identical to
the wood casement windows in the original plan. In addition, though wood
casement windows can be made to meet code, I was informed by a manufacturer
that there was "always the possibility that they could warp or rot over time." I
simply cannot afford to risk having to replace the windows again in five or ten
years, nor can I afford the $20,000.00 that some of my neighbors are willing to pay
for the wood windows.
In closing I would like to say that I thought that having my home designated
historic would be a good thing for my home and the community, and I now regret
the situation. If I had to do over again, I would probably opt to have the home
designated after I made the necessary repairs. I have four children in my home,
three of whom are five years old, and I cannot go on with this "window situation."
In addition, I am a foster parent and an adoptive parent, and my home will not pass
licensure with the broken bedroom windows. Furthermore, I ordered the required
egress windows which would allow my children to safely escape from the bedrooms
in the event of a fire. The jalousie windows do not allow for escape. Also, on very
cold days, my son cannot sleep in his room because of missing panes on the jalousies.
Both Margarita and Mr. Lubian can attest to the fact that I have worked
very hard over the last few months to "do the right thing" and go through the
proper channels. I think that the Board was unsympathetic and unrealistic in their
suggestions. In good faith, I had originally stated that I would replace the windows
with wood, however, I now find that I cannot afford them, nor can I replace them
"one at a time" as the Board suggested, without placing my family at risk. I only
ordered the windows after speaking with your permit staff and finding out that they
would meet the stringent Dade County codes for both wind and fire, and now I
stand to be out several hundred dollars.
I recognize that the council may rule in favor of the Board's decision, but I
wanted to go on record with this situation in order that someone else not have to
follow the same path.
