Lavigne in connection with a certain orchid house located upon his property at 320 N.E. 96th Street Miami Shores, Florida. Mr. Lavigne retained me to represent him in August of 1972 in an effort to try to find an amicable solution to the problem. As you may know, subsequent to the erection of the orchid house it was found to be in technical violation of the zoning laws of Miami Shores and an application for a variance was denied because of the objections of Mr. Lavigne's next door neighbor, Mr. S. M. Lion. Since last summer I have been making efforts to try to get together with Mr. Lion and his attorney to try to reach an amicable solution so that Mr. Lavigne might reapply for the necessary variance. Mr. Lion was represented by John Manning, Esquire, whose untimely death caused a protracted delay in our attempts to get together. Mr. Manning's partner, Barry Swope, has now familiarized himself with the situation and, after some difficulty, caused by my prolonged absences from this area on other business, we have now been able to get together for the desired conference. As a result of this conference, Thomas H. Anderson, Esquire May 17, 1973 Page Two held May 16, 1973, I believe that we have resolved all of the problems between these neighbors and that. we will shortly be in a position to file a new application for a variance with Mr. Lion waiving any objection that ,he might have previously made. I notified Village Manager John McIntyre of this state of affairs last August and perhaps I have been remiss in not keeping him advised of the status of the matter. A copy of my letter to Mr. McIntyre is enclosed for your information. In any event, it now appears that we are able to reach a solution to the problem and that we will shortly be filing for the necessary variance to permit Mr. Lavigne to maintain the orchid house at its present location upon his property. The document marked, designated, and known as the "South Florida Building Code, " which is made a part hereof by reference, is hereby adopted as a minimum standard for the purposes expressed therein and shall be known as the "Building Code of Miami Shores Village ", and this document shall be as fully effective as though every word, phrase, sentence, or section of the South Florida Building Code were fully incorporated herein, except as modified or added to in sections of this ordinance which follow. SECTION 2. AUTHORITY Wherever the terms "Building Official ", "Plumbing Inspector ", "Electrical Inspector ", "jurisdiction ", "regulatory authority ", or similar terms .shall appear, they shall refer to the properly designated inspectors or assistant inspectors of the Building Department of Miami Shores Village, and to the author- ity and jurisdiction of Miami Shores Village and its officials and employees. SECTION 3. QUALIFICATIONS OF INSPECTORS AND PERSONNEL. The qualifications of the Building Inspector, Plumbing Inspector, and Electrical Inspector, and other personnel of the Building Department, shall be established by the Village Manager. SECTION 4. APPLICATION FOR BUILDING PERMITS. No person shall e_rgst or construct or proceed with the erection or construction of an y build_n or structure, nor add to enlarge, move, improve, lamer, convert, extend, or demo ish any i ding_ or tructure, or f buildings and /or structures under one or joint ownership whether on one or more lots or tract of land; or cause the same to be done, where the cost of work is Tweuty -five pollars ($25.00) or more in value; and on any remodeling or alter- ation job of any value, without first obtaining a building permit therefor from the Building Department. SECTION 5. BUILDING PERMIT FEES. The payment of such increased fee shall not relieve any person, firm, or corporation from fully complying with the requirements of this Code, nor from other penalties prescribed in the Plumbing Code. Upon failure of any person, firm, or corporation to pay such increased fee, such person, firm, or corporation shall be prosecuted in the Municipal Court and charged with failure to secure a permit before commencing or proceed- ing with work, The Building Department shall charge and collect for electrical permits at the following rates, to wit: (a) The minimum permit fee that can be written shall be $1.50. (b) Double Fee: In the event that any work for which a permit is required by this ordinance is started or proceeded with prior to the obtaining of said permit by the duty authorized person, the fees specified for such work shall be doubled. The payment of such double fee shall not relieve any person from fully complying with the requirements of the Electrical Code in the execution of the work nor from any other penalties prescribed therein. The entire Village of Miami Shores, Florida, is hereby declared to be and is hereby established a Fire District, and said Fire District shall be known and designated as Fire Zone 2 -B according to Section 1603. 3 of said Code. Wherever reference is made to any Fire Zone, it shall be construed to mean the Fire Zone designated and referred to in this ordinance. SECTION 10. ZONING ORDINANCE, Before any permit is issued, all provisions of the Miami Shores Village Zoning Ordinance No. 270, and any amendments thereto shall be complied with, and the provisions of the Building Code shall not be construed to repeal, super- sede, or modify any part of the said Zoning Ordinance No, 270 or amendments thereto. SECTION 11. PENALTIES. Any person convicted for violating any of this ordinance shall, upon con- viction thereof in a municipal court of Miami Shores Village, be sentenced to pay a fine not exceeding the sum of Five Hundred Dollars ($500, 00) or serve a •term not to exceed sixty days in the Village jail, or both such fine and sentence in the discretion of the Municipal Judge. SECTION 12. SEPARATE OFFENSES. Each day's violation of any of the terms of this ordinance shall be deemed . and considered and is hereby specially declared to be a separate and distinct violation of the terms of this ordinance and punishable as such. In the event that any portion of this ordinance shall be held to be void, inconsistent or of no effect by a court of competent jurisdiction, such holding shall in no wise affect or distrub the remaining portions of this ordinance. After discussion Mr. Denham moved that the Board recommend that a variance be granted for the separation between the building and the accessory building. This motion died for lack of a second. Mr. Astor then moved that the Planning Board feels that it is in a very difficult position in this matter and requests the advice or action of the Council to straighten out the problem in the interest of Village harmony. This motion was seconded by Mr. Moyer but failed to carry with Messrs. Horsey, Denham and Smenner dissenting. Mr. Smenner moved that a variance be granted to permit the waiver of distance between the two buildings. The motion was seconded by Mr. Denham but failed to carry with Messrs. Moyer, Horsey and Astor opposing. Mr. Astor moved that the Board defer action on this until the next meeting and urge each member of the Planning Board to visit the site and view the location of the orchid house. Mr. Smenner moved that this be referred to the staff of members who may be concerned with the annexation, notably, the Village Manager, Director of Planning and Zoning, Fire and Police authorities, County Club Association, and further- more that these staff members be asked to point out any problems that might be encountered that might make the annexation undesirable. The motion was seconded by Mr. Astor and passed unanimously. (3) A request was made by Mr. Gordon Moyer for permission to demolish an old house at 60 N. E. 99th Street on a 50 ft. lot next to his home. After a review of the plans Mr. Smenner moved that permission be granted to tear down the old house and that this plan be approved for the 50 ft. lot.
