It mu.t be noted that my application to the Miami Shore. Planning Board for information in Iden- tifying my violation were .;ubrogated in a motion to deny a variance. At thi. time I re.pectfully a.k the Council to review my cage referring to ..ection. 524 and 526 of the code. I a.k for an interpretation of thee Statues. I believe what I have done i. alter a nonconforming building completely complying with all condition,- of thee 'sections. What I recon,tructed wa.. le.,. than 50% of an exiting noncomforming buil- ding altering an eye..ore to a ..tructure more harmonious to the neighborhood. The exiting foundation , .lab, three .ided cement wall approximately four ft. high and the ..creep dJor were left in place. I replaced the exiting . creen and wood framing becau.e of it extremely deteriorated condition with new .creening an aluminum framing. The exiting roof wac a compo.ite of five different material. (corrigated fibergla... and tin, tar , wood and chickenwire) which I replaced with an aluminum roof. I did all the work my.elf over a four month period. I choo..e the material. u..ed becau.e of it clean appearance and the variou. .imilar.tructure. in clo.e proximity to my home.(Ex. 16 N.E. 100th St.) One can argue that no permit was applied for; I will pay the appropriate penaltie and make application. One can al- .o argue that an illegal aluminum material wa. u.ed in the roof con.truction; I will replace the roof with a conforming material. It cannot be argued that violation exi..t. ba.ed on the pure exi.tance of the gtructure baled on exi..- ting code.,. I did not materially prolong the life of the dwelling, nor did I enlarge it or increa..e it.- value in exce..., of 50 %. I altered a limited portion of it retaining harmony. And making it not a ..ounce of complaint by my neighbor.- but one of prai.e. In conclu. ion I re.pectfully ..ubmit that the violation of the ,etback wa-- perpetrated to the beat of my knowledge ..ome twenty to twenty -five year.: ago by the former re..ident and allowed to remain in exi.tance for thi.- pe- riod a..umably attaining tolerable acceptance.
