SETTLEMEN'1 AGREEMENT
WIIEREAS, Plaintiffs have bLruyht the within- c ;.Fuse of action
against Defendant seeking various and alternAtive forms of
relief, including the right to build phe or more residences on
the real property owned by Plaintiffs, and described as:
Lots 15, 16 and 17, in Block 30, of'MIAMI
SHORES SECTION 1, according to the Plat
thereof, as recorded in Plat Book 10, Page
70, of t Public Records of Dade County,
Florida;
WIIEREAS, Defendant contends that the change in zoning of
Lots 15 and 16 enacted by Defendant, as set forth in Ordinance
No. 498 -86 on December 2, 1986, prohibiting'tlre erection of any
dwellings on said real property, was lawful, and that paid
Ordinance is valid in all respects; and
WIIEREAS, Plaintiffs contend that the application of
Ordinance 498 -86 I Plaintiffs' property above - described was
improper and invalid under the circumstances applicable to
Plaintiffs' property; and
WIIEREAS, the parties agree that at the time of the enactment
of said Ordinance, Plaintiffs, by proper application, were in the
process of obtaining the required building permits for the
erection of two dwelling units on said real property in accord
with the planning and zoning procedures of Defendant as
authorized prior to the enactment of Ordinance No. 498 -86; and
WIIEREAS, it appears to be in the' best interests of the

parties hereto to treat Plaintiffs' application for appropriate
building permits to permit the erection of two dwellings on said
real property, as authorized by the Defendant prior to the
enactment of the aforementioned Ordinance, as an equitable basis
for the issuance of the requested building permits;,
THEREFORE, the parties agree to the following:.
1. Defendant shall issue to Plaintiffs appropriate building
permits' to erect two single family dwellings on the subject real
property upon the payment of appropriate fees and charges as same
would have been imposed prior to the enactment of Ordinance No.
498 -86.
2. The parties hereto shall bear their own respective
costs.
3. This Agreement shall be binding on the parties only upon
the entry of an order by the Court approving same and the
provisions of this Agreement shall be binding upon the parties,
their heirs, Personal Representatives, beneficiaries, successors
and assigns.
4. Upon the entry of an order by the Court approving this
Agreement and issuance of the building permits as provided
herein, the within cause of action shall be dismissed with
prejudice.
IN WITNESS WHEREOF, the parties hereto have hereunto set
their hands and seals on the dates hereinafter indicated.
