Mrs. Thelma Richardson contracted Rich Co. on January 27, 2000 to fabricate and install a fence on her property (Address: 225 NE 96 St., Miami Shores, FL. 33138). Per signed contract, contractor would pull fence permit and bill customer at County cost + processing fee. After we had the permit, fence was fabricated and customer called to set up installation date. Twice, installation was scheduled. First time installation was scheduled, customer ok'd date, then called a few days later stating something had come up and no one would be at location. The second time installation was scheduled, the installation crew was running late and when they arrived at location Mrs. Richardson stated that 5 pm was too late for her to be waiting for the installers. We continued trying to schedule an installation date but every time we gave the Richardson's a time and date, it was not good for them. Finally, it was agreed that on May 3, 2000 we could install the fence. On that day, as the installers were half way through installing the fence, one of Mrs. Richardson's sons arrived and told the installers to stop the work. Mrs. Richardson's son called the office and stated that the fence being put up was not the fence ordered. He wanted spears on top of the fence. It was explained to Mr. Richardson that the contract did not show spears on the fence. We were willing to finish the installation of the fence and go back another day to weld on the spears. Mr. Richardson refused and demanded we refund deposit paid at time of contract signing. It was explained to Mr. Richardson, based on contract, Rich Co. was not obligated to refund any money since company had done the work in good faith. Mr. Richardson was very verbally abusive when he heard that and came to the office looking for the company owner to have a face -to -face conversation. The owner was out at different job sites. Finally, the Richardson's called and stated they would be getting another company to fmish the work started by Rich Co. and they would keep in place the fence installed by us. Since Rich Co. pulled the permit on the fence, we want to make sure that our part of the fence is inspected and approved so that we can close the permit.
