At your request I have looked into the issue of whether or not a signature by the property
`•owner" should be required in connection with permit applications from AT& T to install facilities
in the Village right of away. After reviewing correspondence from AT &T counsel and having
discussed this matter with our building official, I am of the opinion that these permits can be
processed without any "owner" signature.
It is my undersnanding that the primary purpose for requiring the owner signature is to protect
the Village from claims by third pang owners that the Village issued permits to contractors without
the consent and approval of the owner of the property. Plainly, the Village does not need its own
signature to assure itself that it will not bring any future claims against itself in connection with this
permit. In addition, counsel for AT &T has raised substantial issues about whether or not the Village
consent is even required for the use of this right of way (an issue which need not be resolved for
purposes of this opinion).
