Dear Mr. Miller: I regret to have to advise you that in addition to those leaks on areas repaired by your firm a few months ago, the work recently completed by one of your associates on the front porch of our residence at 1096 N.E. 97th Street, in Miami Shores, is leaking. This latest extended waiting period, followed by a partial repair, which needs additional work, has brought me to the conclusion these patchwork repairs are not the answer to our problems. Furthermore, they are totally unacceptable. We have waited patiently for more than two - months for the work to be completed, trying to understand your position due to Joe Castresana's alleged misconduct. However, the damage being incurred in the ceiling and walls inside of our house cannot be ignored any longer. Enclosed please find copies of all the Miller Roofing contracts signed by Joe, as well as, copies of all the cancelled checks made out to your firm. Legally, as you well know, your firm is responsible for the work accepted by and paid to Miller Roofing, regardless of which crew completed the work. Please forgive my seeming lack of tact; but your personal problems with Joe, although taken into consideration, remain your problems. At this time,in order to finalize this situation, as amicably as, possible. I am hereby countering your latest offer for a completely new roof (a copy of which I have enclosed) costing $9,900.00, by offering you $8,000.00, with the same conditions remaining in effect. In considering this offer, please take into account the amount of money we have already spent on faulty repairs, the expenses you will have to incur to correct said repairs and the additional repairs we will have to pay for in order to correct the damage to the plaster and the stucco inside and outside the house. 1 trust that you can find a way to handle the job under these conditions. We cannot continue living like we have, fearing every new rainstorm. This matter has to be resolved, as soon as, possible. Please be advised that I will wait ten -days for your reply.
