Dear Mr. Lubien,
November 7, 1990
Per our 11/06/90 phone conversation it is my understanding the
installation of an electronically controlled fence at the Hegedus
residence, 940 N.E. 95 St. did not require a licensed survey and /or
a village building permit as long as you as building inspector
determined the fence is well within Mr. Hegedus'property line. Per
the same conversation, Mr. Hegedus was free to remove a live
Florida Holly because the tree is listed as undesirable by the
State of Florida. The tree, groomed for seventeen years, was
located well within the easement I am required by law to maintain.
Monday's was the third call I have placed to Miami Shores Building
and Zoning regarding these issues. Your assistant, Mr. Rodriguez,
has assured me he can not locate any record of a building permit
or licensed survey within Mr. Hegedus' file for work done on his
premises. The last documentation is a 04/26/90 request for a
variance which was subsequently denied.
Mr. Lubien, your reasoning in these matters is in violation
of my legal and civil rights. Your inconsistent and untimely
enforcement of local zoning ordinances leaves a number of questions
in my mind. Your statement that "Mr. Hegedus is a contractor and
therefore knows what he is doing" prompts me to suggest that you
check actions filed and docketed with the court on behalf of and
against "contractors ". Until your code enforcement is on a
consistent basis "Villagers" will continue to question your
motivation in such matters.

RE: Your letter dated November 7, 1990 and telephone conversa-
tion of November 6, 1990
Please be advised that at no time during our conversation did I indicate to you
that the installation of the fence at 940 Northeast 95th Street did not require
a permit. I also advised you that Mr. Rodriguez is a Code Enforcement Officer
and not a building inspector, and therefore not required to have expertise in
the area of examining building files in detail. I advised you that Mr. Rodriguez
was not able to find the required documentation for Mr. Hegedus's fence and that
I would look into the matter myself. If you recall your comment at that point
was that, "I suppose you will find a permit dated today ". I examined the file of.
Mr. Hegedus's property and your property. I am enclosing copies of the pertinent
information. As you can see a permit was issued on July 24, 1990 and bears a
cash register validation. I trust this will satisfy your concern over the permit.
The surveys indicate that the fence is well within Mr. Hegedus's property. In
regards to the Florida Holly tree in the right of way in front of your house,
Mr. Hegedus advised me that he removed the tree at his own expense, at your request.
He also removed a second Florida Holly tree that was in front of his property, Both
these trees were endangering the utility pole and utility lines. This together with
the fact that Florida Holly is considered to be a trash plant, Mr. Hegedus's actions
were appropriate.
I regret that you perceive my enforcement of the code as inconsistant and untimely
and that I have violated your civil rights. My statements regarding Mr. Hegedus
were to the affect that he had, at all times, complied with code and permit re-
quirenents, and at no time was he given any perferential consideration. My actions
as Code Enforcement Director rarely please everyone. It is a difficult task, but
I have always tried to consider all. aspects .of all parties involved in these problems.
I apologize if I have agreived you in my conduct in this case.
