To Whom It May Concern:
This letter is to inform the Miami Shores Village I am respectfully requesting a hardship variance
on the setback requirements for placing a shed on my property. It is impossible to apply strictly
these requirements to my property because of the existence of peculiar and unusual physical
conditions affecting my property. My appeal to the planning board is as follows:
a) The peculiar and unusual conditions affecting my property:
My property is on a 75 x 129 foot lot. Prior to our recent purchase of the home there were
several additions to our home as well as the conversion of the garage. The remaining available
land is minimal (See attached sketch). The only available space between my home and the
Property lines are: between the east and west sides of the house (9.5 feet), over the septic tank,
between the alley and the patio (11 feet) and between the side property line and the cement carport.
b) The reasons why the unusual conditions make it impossible to strictly apply the
provisions of this ordinance to my property:
As the setback requirements on sheds is 15 feet from the main house, 5 feet from the rear
property line, and 10 feet from the side, the dimensions on all of the above mentioned potential
shed site locations are such that it is impossible to meet all the setback requirements.
c) The variance is necessary in order to make reasonable use of the property:
Due to the above mentioned garage conversion, there is no viable means on the property to
store and protect lawn maintenance equipment (ie. lawn mower, edger, clipping sheers, fertilizer
spreader, rakes, ect.) tools, and house maintenance supplies (ie. paint, wood, ect.), ect. A shed
would provide me with a means to safely store the fore mentioned items and allow me a reasonable
use of my property.

d) The reasons why the variance would be in harmony with the intent and purpose of the
ordinance:
As described above my intentions for use of the shed are clear. A variance would permit me
the means necessary to make reasonable use of my property (the intent and purpose of the
ordinance). The variance would in no means be detrimental to the existing use or prospective
development of the property nor would it give me an advantage in the use of my property that is
not enjoyed by other Miami Shores owners of similarly situated property. The use of a shed
would not only provide safe storage for my belongings but, also neighborhood safety and
beautification.
I will attend the next Miami Shores Planning and Zoning meeting to present my case.

less than 20 ft. from the center thereof.
Coverage: not more than 20% of
the area of a rear yard, except that
any structure that is part of a swim-
ming pool installation and that does
not exceed 3 ft. in height need not be
included in computing said coverage.
Fences, walls and hedges shall con-
form to the provisions of Article V.
