(i) A variance to permit the eastern portion of our pool deck to encroach on about 2 -1/2 ft. into some of the setback on the eastern portion of our property; and (ii) A variance to permit the construction of a basketball court /play area which will encroach on about 5 ft. of some of the setback on the western side of our backyard and about 4 ft. on the northern portion. I. Background Information. Our lot is shaped peculiarly. It is a parallelogram, which results in a gain in property at the front portion of the house and a loss of property in the back portion of our lot. Our backyard is "L" shaped, with the long part of the "L" running north -south and the short part of the "L" running east -west. The septic tank and drainfield are located in the middle of our backyard and stretch from the northern portion of the yard clear to the southern portion. This means that the septic tank and drain field work to cut our backyard in half. The peculiar shape of our lot and backyard, and the existence of the septic tank and drain field required the pool to be located where it is shown on the plans. These conditions resulted in our not being able to get much deck area around the pool. If we are permitted to add an additional 2 -1/2 ft. onto the decking on the eastern portion of the pool, we would have a deck of about 5 ft. on the eastern side and about 5 ft. on the western side of the pool. Although this deck would still be small, it would accommodate an umbrella, and allow for a reasonable amount of space so that grass would not constantly be tracked into the pool each time someone entered it. In addition, we plan to put in more landscaping in that area to privatize our yard. As you will see from the architectural drawings we will present, it is our intention to create a garden -like environment in our backyard. We have no intention of ever enclosing the pool area or yard, so there would never be any screen enclosure backed up close against another property owner's yard. Further, enclosing the pool would destroy the intent of our plans, and would be enormously impractical for any future owner of our site to execute. II. The Basketball Court /Play Area To further the garden -like environment we would like to create in our backyard, we will be staining the concrete play court green to blend in with the grass. As you will see from the attached drawing, our plan is to separate our yard in two areas. On one side of the drainfield, we would have the pool and terrace environment which will enhance the view from our living room, and on the other side of the drainfield we would have the basketball court /play area to be viewed from the alley and our family room. The basketball court /play area, as previously mentioned, will encroach on about 5 ft. of the western setback of our property and about 4 ft. on the northern portion. The western portion of our property, which abuts an alleyway, will be enclosed by a wall to be constructed in accordance with code requirements. (We currently have a wall and landscaping on the northern portion.) III. Summary We hope you can envision from the plans what we are attempting to accomplish. We are planning, what we think, is a beautiful environment in our backyard. The decking and terrace will be Spanish terra cotta tile. The tile inside the pool will be hand painted Portugese tile. Our backyard, as planned, will make it possible for the adults to socialize in one area while the children play in another. The play area will be substantially removed from any living areas of our neighbors' property. We believe that if the Board were to impose the setback requirements strictly at our site, that we would not be able to have a reasonable use of our backyard because the decking portion of the pool would be so narrow as to make it virtually impossible to make any use of it and we would have to tell our son that he can't have the play area because the area would have to be located right up against the sliding glass doors of our family room and over the drain field. In essence, this would prevent us from creating the play court. Members of the Planning and Zoning Board January 18, 1994 Page 3 Again, we have no intention of ever enclosing the backyard property. As we understand it, the purpose of the setback ordinance is to maintain a reasonable amount of space between property owners and to create an orderly, planned environment for the Village. We do not believe that these variances would have any detrimental effect on the existing uses of the surrounding property nor would give us any unfair advantage with respect to the use of our property. In fact, our neighbors are thrilled with the improvements we are making to our property. We believe that a pool and play area in our backyard, privatized as we have described, is a reasonable use of our backyard. We are long time residents of the Shores and plan to continue living here. My husband was born and raised in the Shores and lived at 640 Grand Concourse, a home his parents built in 1950. We are in favor of enforcing Code requirements to enhance the beauty and value of Miami Shores property.
