I was told that my application would be refused because of an ordinance stating that structures of that type are only permitted in the rear or back of a residence. I am now applying to the Planning Board for a variance to allow me to install the carport for the following reasons: (a) The peculiar and unusual conditions affecting the property: There is not an alley way at the rear of my residence. (b) The reasons why such conditions make it impossible strictly to apply specified provisions of this ordinance to the property: Without an alley way there is no access to the rear of the property. (c) The variance in such strict application that the applicant believes to be necessary in order to enable him to make a reasonable use of the property: I believe a variance to the ordinance is necessary to provide access from the street to a carport and convenient access from the carport to entry point of my residence. There is no convenient point of entry from the rear of the house suitable for use on an every day basis. (d) The reasons why the applicant is of the opinion that such variance would be in harmony with the intent and purpose of this ordinance, would not be detrimental to the existing use or development of the property in the vicinity, and would not give to the applicant an advantage with respect to the use of his property that is not enjoyed by owners of similarly situated property. The house is constructed with an entry point at the side designed for every day use and is in fact used as my family's primary point of entry. We currently park our vehicles in the driveway at the side of the house therefore installing a canvas carport would not change the use of the property but only provide a protective cover for the car and cover for my wife and infant during bad weather. The canvas carport would not be offensive in appearance and would not be in view from any angle other than directly in front of the driveway. Stan Comstock 1079 N.E. 94 Street Mr. LuBien stated that the applicant was informed of the provisions of the Code regarding fabric carports. He noted that the first consideration is the location of the carport which requires a variance. As a secondary consideration, the Board must look at the setback requirements. It was noted that the driveway is currently non - conforming as it extends into the setback. Mr. Ulmer stated that the Board must consider two variances regarding this application. The first is the side yard setback requirement and the second is the roofing material. Mr. Comstock was present on his own behalf. He explained that due to the lack of an alleyway, it is almost impossible to comply with the Code which requires the carport to be in the rear of the property. Discussion regarding the setback ensued. Mr. Caldwell noted that the applicant has not provided the Board with enough information to make a sound decision. Mr. Caldwell moved that the application be denied. Mr. Forney seconded the motion. Mr. Blum noted that he was in favor of the proposed improvement to the property. Mr. Caldwell suggested that the applicant return to the Board with more information regarding the proposed side setback encroachment. Mr. Forney withdrew his second to the motion and Mr. Caldwell withdrew his motion. Mr. Caldwell then moved that the application be tabled until such time that the applicant submits more detailed plans. Mr. Forney seconded the motion and the vote was unanimous in favor. ITEM #4 DISCUSSION AND POSSIBLE ACTION - UTILITY SHEDS Mr. Forney moved that this item be tabled until such time that a full Board is present. Mr. Caldwell seconded the motion. He noted that his concern was with the setback requirements for utility sheds. Mr. Blum agreed and added that consideration should be given to the maximum size for a utility shed.
