We have had several conversations about the warrantee which you provided to us at that time. Basically the contract which you gave us guaranteed your work for a period of 12 years, but when the flat roof failed 3 years'ater, you would not repair it because the damage was, in your estimation, caused by Hurricane Andrew. When confronted by expert testimony that was not the case, you told me, in the - presence of the Miami Shores City Manager, Mr. Michael R. Couzzo and Mr. Frank Lubian, the Miami Shores Building inspector, that Dade County had cancelled all roofing contracts, due to the hurricane. I subsequently called Dade Country and was told that the statement is not true. Contracts covering workmanship are valid at all times. I of course will produce written evidence to support this fact. And I will produce a statement from the roofer who subsequently fixed the roof, stating in unequivocal terms, that the roof failure was due to shoddy installation. Now, in the course of a home evaluation for a pending real estate transaction, the inspectors, one a professional roofer, have found loose cape tiles on the crest of the roof on the east end of the house. illegal footings for the solar heat collector, and improperly installed roof tie -ins with the chimney and the second story structure. Once again, the professional has stated that the workmanship is at fault, not a hurricane. Incidentally, that roofer's price to repair the poor workmanship is in excess of $3,600.00. Since these are violations of the Miami Shores /Dade County Building code, I am sending a copy of this letter to the below named individuals, advising them of the facts referenced above. Further, if you continue to maintain that this is not your responsibility, as defined in the contract, I will seek remedies at law for my injuries.
