This is Mr.Boutzilo building a wall to a small patio before our living room after the porch were broken off. MrBradford claims that the right side is to "or 12" too high. :Jell, we will break off that foot, if it is so important. .5+ ‹./ This is that the buyer or our lot was 'permitted to bury on the lot in rear. I suggested to the Building Inspector to have them put up a wall(as on the other side of the lot) in front of our REAR house, but we object to a solid concrete wall with 12" footing. As you know, it was Good Friday , but regardless you got me out from bed, as I was ill and tried to rest before going to church. I told you that Mr.Boutzilo isn't home, he was drtven by afriend to the doctor, and I could not give you any permission without him. For some reson you were in such a hurry to give Mr.Schmidt that perxhit, right away. You have no doubt seen how hard Mr.Boutzilo was working all thes month, pouring the sidewalks and fixing along the property. He told you not less than two weeks ago that the storm shutters that he has put up in front of the living room windows in the rear house, are only for the time that the trucks and the men are working there. It is most ridiculous to state that we ever intend to keep them there. We have been plagued with dirt and dust , - and rats,- for over a year since Mr.Schmidt refused to clean up the debri that he promised to remove in the contract in writing. We didn't get any help from ypu in asking him to clean up. We were living facing these conditions for TEN months. Mr. Schrhddt was finally given permission to bury all the concret collumns and the footing from our porch (that we had to break off) and the concrete from the rear wall along the alley. When his truck was removing the big tree during our absence in October, they broke the cement sidewalk leading to our house and that is why Mr.Boutzilo had to work so hard to make new ones recently. The columns were finally burried only ir. }the.end.of October and - we still had to live with most of our shutters on, on all the windows facing East. The dust on the lot was terrible. When Mr.Schmidt, finahly started to build, the trucks were driving right along our windows and that is why we have to keep these shtters in front of our rear house until the construction is finished There is at present a pile of junk and scraps of lumber right under our windows, at least these shutters give that little protection. You said that the 10 feet wall along our patio is over the 5 foot limitin hight. I told youuthat it is such a short wall that we will take off the 10 or 12 inches or whatever you find that it is over. Mr.Boutzilo didn't do it intentionally and it is there for over a year and Mr.Schmidt didn't complain. Mr.Boutzilo will do it as soon as he returns, as I told you,ke went to visit our friends for a rest as all this agravation with the colored truck drivers snooping around our pro- • perty in our absence from home and the ordeal when the cuban driver was cussing so obscenely without any reason, - allthis made him so set that he just couldn't continue with the work. Before leaving hb put up some more shutters up in front of our patio, as I am all alone this week. I just cannot see how you "apply the laws" in such an unfair way to us. We live on that very place for almost 33 years. Now we are trying to get our home fixed up and were forced to sell this lot and lose the beautiful garden and trees next to our house in order to pay off the medical bills and the taxes and morgages. Mr.Schmidt gave us only FIVE days to break off all the porch and it ran us to hundreds of extra dollars. Then for TEN months the duble was rotting in front of our' windows. Now you are so anxious to please him and ob ect,_to theahutters that we put up to protect our windows while the constIgution goes on. I called Mr.Boutzilo, and he repeated what he told you, that the shutters along the rear house are for a few more weeks until the lot is cleaned when the construction is finished. 25ft We do not object to a wall along our property, beginning 25ft from the front line back,provided that it is bmikld accordind to the code of 5 ft and other specifications. We shall remove whatever that short side of our patio wall is over the require height, to conform to the heigb We object to a concrete wall to be built along our rear house as it is very close to the property line, and the rear is only lift off. The required 12, ''footing will undermine our foundation and it is impossibl to allow. The wall to be on MrScmidt's lot not on ours. This house was there when Mr.Schmidt bought the lot and the Planning Board gave him a variance to build. But it is outrageous to allow him to build,a concrete wall right along our house and Aig the foot ing. *you said : "he ims a right to build what he pleases on his property ", and you are ready to give him a permit. There are all kinds of fences , wire or others that do not require a footing or any digging along our foundation. I showed you the fence that Mb.Morgan put up along his line, which is of concrete jalouzies and ventilated and on cement poles. Mr.Schmidt can build such a fence along our rear house. We object to any digging along our foundatio Please notify us if you are still determined to give MrSchmidt a permit to build a solid concrete wall along our rear house. Mr.Boutzilo will go before the Village Council to protest such a permit. I do hope that you will find a solution for a wall that Mr.S. wants to build in a fair manner. Our house was there so long before he bought the lot. Mr.Schmidt is not a resident of the Village, doesnt VOTE here or pay taxes. He is not building this house to live in, but for specu- lation and profit, still he is getting such a consideration in his undertakings. I hope that you will get that straightened out with him. You will see from the enclosed Iopy of my letter to Il1r.Bradforc what they up to now. Mr.Boutzilo took all the insults so very hard last week and was !suite ill. Our friends took him along for a short vacation. I am all alone at home at present, for I desided not to leave our house, white the construction is going on. It is most ridiculous to state that we ever intend to keep them there. We have been plagued with dirt and dust , — and rats,— for over a year since Mr.Scbmidt refused to clean up the debri that he promised to remove in the contract in writing. We d. 1d.n' tt any help from ygu, in asking him to clean up. We were living facing these conditions for TEN months. Mr. Schmnldt was finally given permission to bury all the concret collumns and the footing from our porch (that we had to break off) and the concrete from the rear wall along the alley. When his truck was removing the big tree during our absence in October, they broke the cement sidewalk leading to our house and that is why Mr.Boutzilo had to work so hard to make new ones recently. The columns were finally burried only in the end of October and we still had to live with most of our shutters on, on all the windows facing East. The dust on the lot was terrible. When Irir.Schmidt, finally started to build, the trucks were driving right along our windows and that is why we have to keep these shtters in front of our rear house until the construction is finished There is at present a pile of junk and scraps of lumber right under our windows, at least these shutters give us that little protection. You said that the 10 feet ° wall along our patio is over tfte 5 foot limitin hight. I told younthat it is such a short wall that we will take off the 10 or 12 inches or whatever you find that it is over. Mr.Boutzilo didn't do it intentionally and it is there for over a year and Mr.Schmidt didn't complain. Mr.Boutzilo will do it as soon as he returns, as I told you'Re went to visit our friends for a rest as all this agravation with the colored truck drivers snooping around our pro— /2 perty in our absence from home and the ordeal when the cuban driver was cussing so obscenely without any reason, - allthis made him so Upset that he just couldn't continue with the work. Before leaving he put up some more shutters up in front of our patio, as I am all alone this week. I just cannot see how you "apply the laws" in such an unfair way to us. We live on that very place for almost 33 years. Now we are trying to get our home fixed up and were forced to sell this lot and lose the beautiful garden and trees next to our house in order to pay off the medical bills and the taxes and morgages. Mr.Schmidt gave us only FIVE days to break off all the porch and it ran us to hundreds of extra dollars. Then for TEN months the duble was rotting in front of our windows. Now you are so anxious to please him and object to the shutters that we put up to protect our windows while the const4,ution goes on. You told¥lpe that you were ready to issue him a permit to build a wall 6ft. high all along our property. I called Mr.Boutzilo, and he repeated what he told you, that the shutters along the rear house are for a few more weeks until the lot is cleaned when the construction is finished. 25ft We do not object to a wall along our property, beginning 25ft from the front line back,provided that it is bamld accordind to the code _allft and o *her specifications. We shall remove whatever that short side of our patio wall is over the require height, to conform to the heigh We object to a concrete wall to be built along our rear house as it is very close to the property line, and the rear is only lift off. The required 120 will undermine our foundation and it is impossibl to allow. The wall to be on MrScmidt's lot not on ours. This house was there when Mr.Schmidt bought the lot and the Planning Board gave him a variance to build. But it is outrageous to allow him to build ,a concrete wall right along our house and gig the foot ink;. ou said "he kas a right to build what he pleases on his property ", and you are ready to give him a permit, There are all kinds of fences , wire or others that do not require a footing or any digging along our foundation. I showed you the fence that Mt.Morgan put up along his line, which is of concrete jalouzies and ventilated and on cement poles. Mr.Schmidt can build such a fence along our rear house. We object to any digging along our foundatio Please notify us if you are still determined to give MrSchmidt a permit to build a solid concrete wall along our rear house. Mr.Boutzilo will go before the Village Council to protest such a permit. I do hope that you will find a solution for a wall that Nir.S. wants to build in a fair manner. Our house was there so long before he bought the lot. Mr.Schmidt is not a resident of the Village, doesnt VOTE here or pay taxes.
