THE PHOTOS WE ARE SUBMITTING WILL SHOW OUR NEIGHBORS HAVE ALREADY ACCOMPLISHED FENCING AND PLANTING FOR SECURITY AND PRIVACY REASONS. WE HAVE JUST RECENTLY PURCHASED OUR PROPERTY AND WANT TO UPGRADE IT TO HELP IMPROVE OUR INVESTMENT. WE WOULD LIKE TO PUT UP A 5' HIGH GREEN VINYL WRAPPED CHAIN LINK FENCE AND THEN PLANT A HEDGE IN FRONT OF IT ALONG WITH OTHER PLANTINGS. OUR AIM IS TO ENHANCE OUR PROPERTY AND OUR NEIGHBORHOOD. DIVISION 7. QUALITY OF BUILDINGS Section 523. [Quality of buildings generally.] All buildings shall be generally harmonious in character and appearance, including exterior color, with existing buildings in the neighborhood and shall be appropriate to their surroundings. In the event that an application is made for a building permit for the construction of a building, or the performance of work on an existing building, that, prima facie, would be inharmonious or inappropriate in the manner indicated above, such permit shall not be issued except on recommendation by the planning board and approval by the village council, as provided in Article VI. (Ord. No. 503, § 2, 1 -6 -87) DIVISION 8. NONCONFORMING USES Section 524. [Continuation.] Except for nonconforming signs as provided in Section 527, a building in which a nonconforming use is conducted may be: (a) Continued at the extent of occupancy of land and floor area and intensity of use at which it existed when it became nonconforming; (b) Kept in repair, provided no structural alterations are made that would enlarge the floor area of the building; (c) Altered, but not enlarged, on a finding by the planning board that the alteration will reduce the degree of dishar- mony between the building and other buildings and uses in the neighborhood and will not materially prolong the life of the building; (d) Reconstructed, but not enlarged in bulk or capacity, within six (6) months after damage from any cause to an extent not exceeding fifty (50) percent of the value of the building above the foundation at the time of the damage; but if Supp. No. 8 1604 § 518 MIAMI SHORES VILLAGE CODE business or commercial district may be erected to a height not exceeding eight (8) feet (1) along any rear plot line, or (2) along any side plot line rearward from a point ten (10) feet distant from the front plot line; (2) No such feature higher than three and one -half (3V2) feet shall be established or maintained, whether pre- viously existing or not, on any corner plot within a distance of twenty (20) feet, measured along plot lines, from the point of intersection of the street lines bound- ing the plot; (3) In A -1 zones which abut on property lying outside village limits the council may permit a wall of not more than five (5) feet in height with a minimum five -foot setback on the front property lines if the sur- rounding circumstances in the judgment of the council so justify. Under the same circumstances the council may also allow a chain link fence to be erected around tennis courts with a maximum of twelve (12) feet in height and a ten -foot minimum setback from the front property line of property in such zone and similarly situated. (4) On Biscayne Boulevard where fences and walls are five (5) feet and hedges are seven (7) feet. Maximum height of hedges in any required side yard or rear yard is seven (7) feet and maximum height of fences or walls in any required side or rear yard is five (5) feet. (b) All walls and fences in any front yard shall be approved by the planning and zoning board and shall be constructed of ornamental masonry, ornamental metal or wood pickets, but not including any wire fence. Walls or fences in any side yard or rear yard, including the margining thereof, shall be constructed of chainlink, wood, ornamental iron or aluminum, precast concrete, concrete block, stucco, or or- namental masonry, except as hereinafter provided. The use of all other materials such as slats, fabric, reed screening, etc., is prohibited.
