E. 92nd St., Miami Shores, Florida is in very poor condition. We have recently received several complaints about this cottage, and we have been notified by the Code Compliance Division of Dade County to take action in this matter. I' inspected the property on November 18, 1991 and found the property in a hazardous condition, Evidence of termite infestation, rot, and decay is everywhere inside and outside. Sections of the roof are completely rotted through. as are sections of the ceilings and the floors. Portions of exterior walls have decayed away exposing frame work of the building. I couldn't help but wonder why the building was still standing. I could make a detailed list of all the problems and discrepancies in the structure, but suffice to say that this building cannot be repaired, or rebuilt. It is necessary for this building to be demolished. I have taken preliminary steps toward the condemnation of the building. This process is quite lengthy and expensive for all parties concerned. Therefore, I request that you authorize Miami Shores Village to demolish this building, remove the debris, and bill you for the cost. I am enclosing a copy of the complaint from Dade County and my response. Please let me know as soon as possible of your decision to allow us to demolish the building. In a telegram earlier this year, she asked the village to delay the process but offered do explanation, said Building and Zoning Director Frank LuBien. Miami Shores paid $1,100 to board up the house last fall and will pay at least'$1,900 in demo- lition and processing costs, LuBien said. Soltis will get the bill in the mail, and the village will place a lien on the property until it is paid. E. 92nd St., Miami Shores, Florida is in very poor condition, We. have recently received several complaints about this cottage, and we have been notified by the Code Compliance Division of Dade County to take action in this matter. I inspected the property on November 18, 1991 and found the property in a hazardous condition, Evidence of termite infestation, rot, and decay is everywhere inside and outside. Sections of the roof are completely rotted through. as are sections of the ceilings and the floors. Portions of exterior walls have decayed away exposing frame work of the building. I couldn't help but wonder why the building was still standing. I could make a detailed list of all the problems and discrepancies in the structure, but suffice to say that this building cannot be repaired, or rebuilt. It is necessary for this building to be demolished. I have taken preliminary steps toward the condemnation of the building. This process is quite lengthy and expensive for all parties concerned, Therefore, I request that you authorize Miami Shores Village to demolish this building, remove the debris, and bill you for the cost. I am enclosing a copy of the complaint from Dade County and my response. Please let me know as soon as possible of your decision to allow us to demolish the building. Petitions with 30 signatures were turned over to the Dade County Unsafe Structures Board last week requesting that the two properties, which have three buildings, be razed. "I don't want to look at it when I wake up in the morning," said one -year resident Charlie Smith. "The place is falling in." Multiple units One property at 969 NE 92nd St. has been divided into multiple units with kitchens and bath- rooms that violate building codes. The house and a building in the back were rented out to several families until about six months ago when at least 15 people were living at both sites, neighbors say. Jose Lanz moved next door last year but did not know the house was not a single -family home. "I didn't know that house had multiple apartments being rented out to undesirable people," said Lanz. "I may not have even bought this house. It's incredible that a village like Miami Shores would let something hate this hap- pen." " 5 trips to court Village manager Gail Macdon- ald said she has taken the owner to court five times in the hopes of `I may not have even bought this house. It was grandfathered in as a multi- family structure because it was built before village zoning laws were in effect, Macdonald said. The village revoked the own- er's occupational license in December. But it has not taken any further action because the property is in foreclosure, Mac- donald said. "The village is on hold until the foreclosure suit is completed," she said. Owner Adventino Silva did not return phone calls. The other house at 830 NE 92nd St. has been vacant for about 10 years. While the village maintains the lawn, the wooden - frame home is falling apart. The roof is caving in, several windows are missing and the floor has holes. She said the owner is in New Jersey and pays the village to maintain her property. No specific rule The village handles vacant properties case -by -case, Macdon- ald said. There is no specific rule on how to pursue these incidents because they don't happen often, she said. The village does not have the authority to demolish an abandoned property unless the county condemns it or the owner consents to demolition, she said. Charles Danger, the county's chief code compliance officer, said the village will have 14 days to report to him on the status of both homes. If no action is taken by the village, the Unsafe Structures Board will order the properties to either be fixed or demolished. Danger said this is the first time complaints about properties in Miami Shores have ever been brought to his attention. 'Twaa - surprised to see these two houses," he said. Frank LuBien, Director FL:gm Building & Zoning By CINDY YCAZA Herald Staff Writer For years, Stashia Soltis has paid Miami Shores to occasionally mow her yard and remove brush from around her dilapidated cottage at 830 NE 92nd St. Now the village is asking Soltis, a New Jersey resident, for permission to demolish the cottage and bill her for it. Thirty neighbors petitioned the village last fall to have the eye- sore removed. Village Building Director Frank LuBien says the cottage is too dan- gerous and decayed to be repaired. The village is preparing to take the legal action required to tear it down — without Soltis' permission. The process, however, could take months. And, in the long run, it could cost the village money. The village is still paying for upkeep on the only other private lot it has had cleared. A structure at 469 NE 91st St. was demolished in 1989 after neighbors complained. Village liens on the property — which include the costs for demoli- tion and maintenance — are now $19,000. Then she will begin the proceedings to have the city tear down the cottage. "She has always paid her taxes and her garbage fees when she's gotten billed," Macdonald said.
