In addition, the mortar between the tiles is not even and the tile in the floor was never cleaned. (b) Tile around the toilet sloaps. (c) Cabinet is not finished - Formica on cabinet stand never finished. (d) The formica board ont the sink is too long and has to be made shorter. 4. General Matters. (a) New door in master bedroom was damaged by your installation man. Painters spent hours trying to adjust the door because it has already been painted. The strip your men put was split when the nails went in and the door has to be replaced and painted. ' (b) The sliding door between the kitchen and the dining room is too loose. (c) The new floor has to be raised to match the existing habitable area. The floor, according to the plan, has to be constructed of 1/2 inch plywood on number 15 on 3/4 inch plywood on 2 x 8 - 16" - O.C. (d) Angle irons have to be bolted to the CBS block and 2 x 4 placed in the frame and 1/2 inch only plywood use for flooring. The floor cracks and pops when walked upon. The cracking and popping has not stopped despite your representations to the contrary. (e) The door on the side entrance has a large crack causing air leakage. (f) The tiles on the floor in the new vestibule is an uneven and was cut wrong. It is improperly done and has to be done over. (g) The contract call for window in front of the new room. Besola July 5, 1985 Page -3- Franklin Grau, the architect who drew the plans, has informed Mr. Rice that the raising of the window has caused structural damage to the house and should not have been done. (h) The plan called for tiles in the windows. Wood was placed instead. The wood is pine and there are hammer marks where the nails were driven in. Concrete now is showing. The painter tried to cover up this mess but he couldn't make it look good. He said the job should be done over. (i) The plan calls for 8 inch glass block in the front wall of the new vestibule. Mr. Rice asked for front color glass but was told that only came in clear. The clear block was installed and came out very uneven. This has to be done over. (j) The drywell on the other walls in the vestibule are not correct and have to be changed. (k) The front entrance door in the plans were to be solid wood. Instead lid doors were purchased. The glass in the side panel was'cracked by your men the door in the side s, . • .• - • • e one over. (1) All the work in the vestibule has to be done over and I understand that you have refused to finish the ceiling in the vestibule. (m) The plans call for a proof covered raised porch and all existing interior and exterior services which are affected by construction are to be patched and repaired to match existing conditions and materials. The roof installed by you does not need the above specifications that have to be done over. In general, I understand from Mr. Rice that you have refused to follow the plans as agreed upon and in addition have taken a significant amount of time doing the job. In addition, to make matters worse, I understand that Mrs. Rice slipped and injured herself on one of the blocks that was temporarily placed in front of one of the entrance doors. This was clearly your respon- sibility since the block was negligently placed in the entrance way and the front door entrance was not usable at that time. Enclosed please find copies of the doctors' bill totalling approximately $500.00. Mr. Rice believes that you are respon- sible to pay these bills since the cause of Mrs. Rice's injury was as a result of your negligent placement of the block in front of the entrance way.
