Please be advised that this firm represents Mr. Rice in con-
nection with the performance of your contractor's services in
connection with remodeling his residence. Reference is made to
the contract between yourself and Mr. Rice dated March 21, 1985.
In connection therewith, Mr. Rice believes that you are in
default under the terms of said contract for the following
reasons:
1. You are substantially beyond the time permitted for
completion as for the terms of the contract. The contract pro-
vided for completion in 80 days, which would have been the end of

3. Large bathroom.
(a) Tile on floor not acceptable - installation is
defective. In addition, the mortar between the tiles is not even
and the tile in the floor was never cleaned.
(b) Tile around the toilet sloaps.
(c) Cabinet is not finished - Formica on cabinet stand
never finished.
(d) The formica board ont the sink is too long and has
to be made shorter.
4. General Matters.
(a) New door in master bedroom was damaged by your
installation man. Painters spent hours trying to adjust the door
because it has already been painted. The strip your men put
was split when the nails went in and the door has to be replaced
and painted. '
(b) The sliding door between the kitchen and the dining
room is too loose.
(c) The new floor has to be raised to match the
existing habitable area. The floor, according to the plan, has
to be constructed of 1/2 inch plywood on number 15 on 3/4 inch
plywood on 2 x 8 - 16" - O.C.
(d) Angle irons have to be bolted to the CBS block and
2 x 4 placed in the frame and 1/2 inch only plywood use for
flooring. The floor cracks and pops when walked upon. The
cracking and popping has not stopped despite your representations
to the contrary.
(e) The door on the side entrance has a large crack
causing air leakage.
(f) The tiles on the floor in the new vestibule is an
uneven and was cut wrong. It is improperly done and has to be
done over.
(g) The contract call for window in front of the new
room. You raised the height when installing the window.

Franklin Grau, the architect who drew the plans, has informed
Mr. Rice that the raising of the window has caused structural
damage to the house and should not have been done.
(h) The plan called for tiles in the windows. Wood was
placed instead. The wood is pine and there are hammer marks
where the nails were driven in. Concrete now is showing. The
painter tried to cover up this mess but he couldn't make it look
good. He said the job should be done over.
(i) The plan calls for 8 inch glass block in the front
wall of the new vestibule. Mr. Rice asked for front color glass
but was told that only came in clear. The clear block was
installed and came out very uneven. This has to be done over.
(j) The drywell on the other walls in the vestibule are
not correct and have to be changed.
(k) The front entrance door in the plans were to be
solid wood. Instead lid doors were purchased. The glass in the
side panel was'cracked by your men the door in the side

(1) All the work in the vestibule has to be done over
and I understand that you have refused to finish the ceiling in
the vestibule.
(m) The plans call for a proof covered raised porch and
all existing interior and exterior services which are affected by
construction are to be patched and repaired to match existing
conditions and materials. The roof installed by you does not
need the above specifications that have to be done over.
In general, I understand from Mr. Rice that you have refused
to follow the plans as agreed upon and in addition have taken a
significant amount of time doing the job. In addition, to make
matters worse, I understand that Mrs. Rice slipped and injured
herself on one of the blocks that was temporarily placed in front
of one of the entrance doors. This was clearly your respon-
sibility since the block was negligently placed in the entrance
way and the front door entrance was not usable at that time.
Enclosed please find copies of the doctors' bill totalling
approximately $500.00. Mr. Rice believes that you are respon-
sible to pay these bills since the cause of Mrs. Rice's injury
was as a result of your negligent placement of the block in front
of the entrance way.

I understand from Mr. Rice that you have refused to do any
more work on the premises. This matter is confirmed by your
recent letter to Mr. Rice's attention. In addition, you have
indicated that the sum of $6,362 are now due and payable.
Mr. Rice has already paid you the sum of $9,769. In addition,
many of the extras you are charging for were not agreed upon and
are significantly overcharged. Furthermore, as noted above, the
job has not been properly performed as to the installation, nor
have the plans and specifications been followed. Accordingly
Mr. Rice intends to engage a new contractor to perform services
on the house and hold you responsible for all damages in connec-
tion therewith.

the South Florida Building Code, this Notice of Acceptance or the

Metro Roof Tile, Inc. has fated with this office the required and acceptable test data to
support renewal and revision of their Spanish "S" concrete roof tile for both Nail -On and
Mortar -Set systems which expired on September 11, 1992.
The tile shall be installed on a solid nailable roof deck of 5/8" thick plywood for all new
construction or to 1/2" plywood deck - on re- roofing.
NAIL. -ON 4:12 M SLOPE
Tice nailable deck shall covered with a minimum 43 # basesheet applied with 1" roofing
nails thru tin cap twelve (12) inches o.c. along top and within 2" of edge and end lap. plead lap of
base sheet shall be 3" to 6" and end laps shall be 6 ", all sealed with plastic cement. have drip shall
be attached over 43 # basesheet with 1" roofing nails 4" o.c. and sealed over with membrane and
asphalt plaster cement.
Each field tile and rake tile providing a 3" head lap shall be attached to the prepared deck
with two, 2 1 /2" long by 0.130" diameter annular ring shank (twenty rings per inch) corrosion
resistant nails. A noiiiinal 1/2" diameter weephole shall be incorporated at the bottom of each
mortar closure below each cave course tile. This nail -on system may be installed up to 35 feet
:above grade.

The prepared deck shall consist of an underlayment (anchor sheet) conforming to No. 30
Type 11 (ASTM D -226) and tin capped 6" o.c, on all laps, 12" o.c. in the field and 4" on drip edge
over this, a hot - chopped 90 # ASTM D -249 granular surface cap sheet by Tamko, or equal is
applied.
The tile shall be applied with a 2" head lap to the roof with mortar consisting of Rinker Roof Tile ,
Cement mixed with sand conforming to ASTM C -144 for a 3:1 dm,

3.01 Inspection ,

A.) Start tit eave edge and apply 90 lb, tolled roofing horizontally along
roof line over base ply lapping end joints minimum 6". Apply hot
asphalt (type IV) or approved equal between plies of roofing felt so
that no felt touches felt. Back nailing using tin-tags and roofing nails or
round cap nails maxhnum 12" o.c. approximately 1" from top edge Of
felt.
B.) Apply each succeeding course in the same manner, allowing minimum
2" headlap.
C.) Overlap hip and ridge minimum 6".
D.) Insure weave pattern in valley or trim maximum 4" past nail
penetrations.
E.) I lot mop or cold process all metal flashing and roof protrusions to
insure weather tightness. Do not mop over plastic roof cement
F.) Trim any felt crverhanging at cave and gable.
G,) Cut any fislanouths and seal with plastic roof cement and mentbrane.
H.) Apply plastic roof cement or hot asphalt along entire edge of felt
wherever it meets wall bases.

NOTE: This system utilizes preformed valley and metal flashings,
paper head lap, 6" aide lap and minimum 3" tile head lap. It is not
necessary to seal paper laps or tile nail penetrations with this system.
A. Single -Ply Underlayment — Organic typo 1 commonly called 43 lb. base
sheet , conforming to A.S.T.M D-2626.
1. Single -Ply (43 Lb. Base)
a.) Apply a 36 " wide strip of underlayment down center of valley- Tut
and secure underlaymcnt max 24 " o.c. along edge of base sheet.
b.) Start at cave edge and apply
one course of underlayment horizontally
along roof line, lap side laps min. 6 ".
c.) Tin -cap and secure undetiay meet approximately 12" o.c. along top of
edge of base sheet.
d.) Apply each succeeding course in same manner allowing minimum 2"
headlap.
e.) Insure weave pattern at an valleys.

g.) Extend underlayrnent 4" up abutting walls and other protrusions.

C.) Continue With lead on both sides of curb working up toward ridge. (trim

E.) Install ridge end of curb with a minimum of 24" width of lead extending
over the course of tile at the top of the curb or extend lead under both
courses of tile at the top of t he curb. Fold lead to create a 1" water
diverter at the top and both sides of 24" lap saddle.

This aproves a corrugated and a flat concrete roof tile to be
installed as a mortar -on system and as a nail -on system. The
mortar application shall be in accordance with Section 3404 of the
South Florida Building Code, The flat tile may be installed up to
150 feet above grade and the corrugated tile may be installed up to
55 feet above grade. All installations shall be in accordance with
the South Florida Building Code, this Notice of Acceptance or the
manufacturer's recommendations, whichever is most restrictive.
2. Tiles shall be installed over solid wood deck with an underi yment
as set forth in Section 3404 of the South Florida Building Code for
mortar -.on and 43 pound asphalt for the nail on system.
3. The nail -on system shall be installed as follows:
Minimum slope shall be 4" to 12" horizontal.
The roof riles and accessories shall be installed on a minimum of
1/2" thick plywood sheathed wood framed deck with rafters spiced
24" o.c. maximum..
A single ply of 36" wide 43 lbs. asphalt impregnated felt shall be
installed on the deck with enough roofing nails and tin caps to
hold the felt in place until the battens are installed. The felt
shall be turned down vertically 1" at the eave and rake. The felt
shall be installed with 2" head laps and 6" side laps.
The valley flashing shalile 26 gage galvanized steel and shall be
24" wide incorporating a 1 1/2" high standing seam splash diverter
and 3/4" wide.flanges. The flashing shall be attached to the deck
with roofing .nails and 26 gage galvanized steel clips spaced 12"
o.c. at each flange. .
