The factual information in this letter is intended to address those factors set forth in Article VII, Section 702, of the Miami Shores Code of Ordinances relating to requests for hardship variances. We hereby request a limited variance in order to install a standard sized swimming pool in the rear yard of the property. As discussed in more detail below, the requested variance would provide us with nothing more than an opportunity that is currently available to all other property owners in the surrounding area. For the reasons set forth in more detail below, we respectfully request that the Director of Building and Zoning be authorized to grant the variance requested herein. A. Background Information. Frank H. Henry 710 N.E. 93rd Street Miami Shores, FL 33138 November 1, 1999 REQUEST FOR HARDSHIP VARIANCE The property at 710 N.E. 93rd Street is a single- story, single - family residence constructed in 1939 and 1940. The property is bordered on its eastern side and southern side by a concrete -block wall. The western side is bordered by a chain -link fence. The rear of the property is enclosed on its northern side by a wood fence. The property is located adjacent to a parking lot to a multifamily site containing a two -story townhome complex. It is separated from that area by an alley and trees that serve as a buffer to the noise caused by the traffic activity within the complex. The townhome complex fronts Biscayne Boulevard. According to a recent appraisal of the property, the townhome complex creates an "external obsolescence" which affects the value of the property. The townhome complex includes an in- ground swimming pool. The property is bordered on its western side by a single - story, single family residence. The rear of the property abuts the garage of the property on its western side. We have entered into a contract with Essig Pools, Inc., to construct a swimming pool 80 feet in linear perimeter. Essig Pools is the largest pool contractor in Florida. The contract to construct the pool on our property is contingent on the variance requested herein. B. The peculiar and unusual conditions affecting the property. The eastern wall of the property is 165.12 feet that runs at an angle of 51 degrees from the front of the property. The house is located 17.75 feet from the western property line. The rear of the house is located 38.65 feet from the southern property line. The rear (southern) wall of the property is 22 feet long. The house is located 9.6 feet from the eastern property line. The following is redacted version of the survey of the property displaying its peculiar configuration: 2 The configuration of the property creates a triangular back yard. The side wall of the property cuts across the back yard diminishing the length of the back wall. Thus, even though the front of the property is 125 feet in width, the back wall of the property is only 22 feet in width. C. The reasons why such conditions make it impossible strictly to apply specified provisions of the ordinance to the property. Based on the configuration of the home, there is only one area suitable for the construction of a swimming pool — the rear of the property. The applicable building codes require a 7.5 foot setback from the rear of the property to the waterline, and 12.5 foot from each side of the property to the waterline. Strict application of the applicable setbacks allows for a swimming pool triangular in shape and approximately 14 feet in maximum width and length, with a total perimeter space of less than 56 feet. The minimum perimeter linear feet for a standard pool package is 80 feet. Thus, within the applicable building codes, the back yard of the property allows for a swimming pool only seventy percent (70 %) of the standard builder's package. Nonetheless, pool contractors' costs of construction are somewhat fixed regardless of the size of pool under construction and, therefore, the cost of constructing a pool 56 feet in diameter is the same as the cost of constructing a pool 80 feet in diameter. The requested variance would allow us to do nothing more than build a standard sized swimming pool in the rear of the property. D. The variance in such strict application that the applicant believes to be necessary in order to enable him to make a reasonable use of the property. The requested variance is necessary in order to make a reasonable use of the property. The appearance and condition of the rear yard of the property make clear that it has never been a focal point for improvement for any of the owners of this property. There has never been any significant landscaping, the lawn has never been well - maintained and the walls and fences forming the perimeter of the property have been allowed to deteriorate. As discussed above, the rear of the property is bordered by an external obsolescence — three multiunit apartment buildings. The level of automobile traffic to and from these buildings adds significantly to the traffic noise which would otherwise be present in any other property in the surrounding area, making the rear of the property unattractive in comparison to the front of the property. In other words, we do not currently use the back yard of the property for anything. The addition of a swimming pool would provide us an opportunity and an incentive to greatly improve the appearance and utility of the rear of the property. 3 E. The reasons why the variance would be in harmony with the intent and purpose of the ordinance, would not be detrimental to the existing use or prospective development of property in the vicinity, and would not give to the applicant an advantage with respect to the use of his property that is not enjoyed by the owners of similarly situated property. The purpose of the ordinance is to place controls on construction in order to maintain the appearance, quality and value of the properties located in Miami Shores Village. The proposed variance would allow for the construction of a standard -sized swimming pool in the back yard of the property. The proposed variance will increase the aesthetic beauty of the property and increase the market value of the property. Moreover, as part of the construction of the swimming pool, we intend to demolish and replace a significant portion of the wall bordering on the eastern side of the property. That wall has greatly deteriorated since its original installation and is in need of repair. This construction will provide a convenient opportunity to significantly improve the appearance and integrity of that wall. In addition, as part of the construction of a swimming pool, we intend to significantly add to the landscaping of the back yard. We seldom currently use the back yard due to the external obsolescence bordering its eastern and southern sides. However, we intend to significantly improve the foliage in the back yard coincident with the installation of a swimming pool in order to improve the appearance of the entire property and improve the level of privacy in the rear of the property. Finally, the installation of a swimming pool will not provide us an advantage not available to other property owners in the same area. Indeed, the properties on the eastern and western sides of the property both have substantial swimming pools. We are at a disadvantage due to the peculiar configuration of our property. The requested variance will do nothing more than allow us an opportunity to improve our property — an opportunity that is currently available to other similarly situated property owners in the area without a variance. We trust that the foregoing adequately addresses the factors set forth in Section 702 of Article VII of the Miami Shores Code of Ordinances.
