Section 509.211, Paragraph 4. Before the erection or remodeling of any building for use as a public lodging or public food service
establishment is begun, the registered architect's plans or registered engineer's plans, with detailed specifications, shall be approved by the
supervising architect or engineer of the hotel and restaurant commission; all plans, specifications and drawings submitted for the purpose of
securing building permits from any state, county or municipal building inspector, or other officer having like jurisdiction, shall bear the sig-
nature and seal of the architect or engineer and supervising architect or engineer of the hotel and restaurant commission before said building
permit is issued; when such plans and specifications are submitted to the supervising architect or engineer of the hotel and restaurant com-
mission for approval, they shall be accompanied by a remittance of an amount equal to the license fee prescribed for an establishment of
such size as provided in this chapter, provided that new construction or remodeling costing ten thousand dollars ($10,000.00) or Less need not
be accompanied by plans of a registered architect or engineer but scaled drawings shall be submitted to the hotel commission's architect or
engineer for approval as a condition precedent to securing a building permit.
Section 509.251, Paragraph (2) (b). Provided, that all hotels, apartment houses, rooming houses or other structures in course of construc-
tion shall be subject to and required to pay the same schedule of license fees for inspection during construction as they are required to pay
for inspection when in operation as such.

construction shall be subject to and required to pay the same schedule of license fees for inspection during construction as they are required

Dear Mr. Perry:
I am in receipt of your letter of June 28, 1972, requesting
confirmation of the matters stated in that letter.

Matters stated in your letter do not conform to my recollection
of our telephone conversation in all particulars and do not
conform to my intentions in that discussion. I am sorry that
there was apparently some misuderstanding between us in that
conversation.
It is correct that I informed you that Mr. Rosen and I would
make every reasonable effort to obtain a letter from Dixie
Williams stating that she claimed no commission in connection
with the pending transaction, being convinced that her assumption
that I had disclosed the property to Kenneth Rosen as a result
of her presenting it to me for purchase was incorrect. I also
told you that I felt that if it were possible to get such a
letter it would nevertheless undoubtedly state that'Dixie Williams
felt that Mr. Wolz had by reason of their relationship some moral
or other obligation to her notwithstanding the fact that the
property had been sold independently by other brokers. I informed
you that I had no knowledge of what the transactions between
Mr. Wolz and Miss Williams had been and that 1 could expect at the
most a letter of the type above mentioned.

I also informed you that I felt that Mr. Wolz must be made to
understand very clearly that he did not have an option to cancel
this deal, irrespective of any disputes and problems which he
might have with Dixie Williams.
I further informed you that 1 was willing to execute an affidavit
as would Mr. Rosen attesting under oath the fact that the property
had never been mentioned by me to Mr. Rosen or to any employee
or associate of his prior to his calling me and advising that he
had reached an agreement for its purchase with Mr. Wolz and asking
to arrange an appointment to have that agreement reduced to a
deposit receipt contract. Mr. Rosen and I are still willing to
execute such affidavits.
As to whether an action of interpleader is appropriate or required
in these circumstances is in my opinion most doubtful. However,
Mr. Rosen and I wish to be as cooperative as is reasonable in
resolving this matter and in protecting the interests of Mr. Wolz
and the corporations with which he is associated from any unjust
claim. However, I am sure that you are aware that I do not re-
present Galpin Realty and accordingly cannot make any commitment
or agreement for that firm.
I am hopeful that problems which Mr. Wolz is presently experiencing
with Dixie Williams will be resolved insofar as the pending trans-
action is concerned before closing. Mr. Rosen and I are making
every effort to do that on behalf of Mr. Wolz, although we of
course had no legal responsibility in that regard. Please assure
Mr. Wolz of our present and continuing cooperation. Insofar as
Mr. Rosen and I are concerned we have done nothing which would
give rise to any valid claim by Dixie Williams. I am sure that
this matter will be resolved on a just basis.
As I have previously informed you I am leaving town on July 3rd,
and will not return until the last week of July. My partner,
Donald S. Rosenberg, whom you will find to be extremely competent
and cooperative will handle the transaction for this office in my
absence.

been requested by the Mortgage Lender to obtain certification
from the appropriate authorities of the Village of Miami Shores,

1. The present use of the improvements as apartment
dwellings and its continued use for that purpose
complies with the applicable zoning regulations,
building code provisions and ordinances of the
Village of Miami Shores.
2. The ordinances and regulations of the Village of
Miami Shores would not prevent the submission of the
