RE: Request for assistance at 1060 NE 92 Street:
I contacted Mrs Cecelia Jones of 1060 NE 92 street, phone
758 -5118, at 4:55 PM this date. She escorted me to the rear
of her property which abuts the property of Mr. Arthur Dukette
of 1037 NE 91 Terr. phone 758 -0860. I looked at the property
survey of Mrs Jones that shows the easement as being the
property in question. At this time Mr. Dukette does not have
any trash on the real property of Mrs Jones, except for a black
rubber cord that is attached to the fence of the house west of
Jones and extends eastward across the easement behind the
Jones property. The house west of Mrs Jones is owned by a
William Lindsley and is 1020 NE 92 street. Mr. Dukette has by
his own admission placed trash against the fence of Lindsleys
which again is on the utility easement. I did not get to speak
with Mr. Lindsley on this matter.
I spoke with Mr. Dukette who came to the easement from his
property. It appears that talking with Mr. Dukette is a losing
proposition. I tried to advise him that 22 feet of the easement
was given up by his neighbors behind him and that the total of
5 feet between properties belonged to the utility companies.
He then began to try to pull out a large hedge that is in the
rear of the Jones property and has been maintained by the Jones
family since they have lived there. This hedge is on the
easement side of the Jones property. I told Mr. Dukette not
to remove any of the hedge.
Mr. Dukette is using the rear of his property as a storage
area for junk and trash. I advised him that he should try and
clean it up and that as neighbors they should try and get along.
Dukette claims he is being accused of being senile by his
neighbors. I advised Mrs Jones to call Florida Power and Light
as to trash in the easement and that she should give you a call
when she gets a chance.
I think you should take a look at the rear of the Dukette
residence in regards to the trash pile up that he is accumulat-
ing.

Be tty M. & Nancy Usher of the Village of Miami Shores,
County of Dade and State of Florida, being duly sworn, doth depose and say,
that under the provisions of Ordinance No. 185, dated June 15, 1948, amend-
ing paragraph (d) of Section B -368 of Ordinance No. 97 of the Building Code
of Miami Shores Village, he desires to build a single family residence
on Lot ,El, _ - Block. - of RappAnba eene n Subdivision,
that he is the owner of said property, and will be the owner of said
residence , that he will do the work personally, and that
he will, at such tunes as are required by the Zoning and Building Director: -
1, File plans and specifications and obtain approval of the
Planning Eoard and the Building Inspector.
2. Apply for and secure a Permit.
3. Pay the required fees.
4, Execute the 'work in accordance with the provisions of this
Code.
5. Apply for inspections.
6. File with the Building Inspector certificates that provision
has been made to carry the necessary Vorkunen's Compensation,
Public Liability and Property Damage Insurance.
7. File with the Building Inspector as the job progresses certi-
ficates showing the payment required by the Federal Social
Security Act to the State of Florida or the United States of
America.
8. Assume the responsibility of not employing other than properly
licensed contractors by Irliami Shores Village for any hart or
portion of the work.
9. 40t set himself up as a "contractor ".
10. Sign an affidavit before commencing 'work to .the effect that
he has read this Article and will do the work personally and
observe all of the requirements of the Building,. Electrical,
Plumbing and Zoning Codes of Miami Shores Village. Such
affidavit to be properly notarized upon blanks to be supplied
by the Building Inspector.
11. In order to prevent abuses and subterfuge the right of such
owner - builder as herein provided, is limited to but one
owner - builder permit each 2 years, and where an owner- builder
has once exercised the privilege herein conferred no second
application for owner-builder permit shall be granted in lest
than 2 years, unless the applicant is qualified as a licensed
General Contractor under the applicable Ordinances of said
Village.
