Please be advised that a warrant far Mr. Richard's
arrest was issued some weeks ago but as he apparently in tempor-
arily residing at Melbourne, we have been amble to serve the
warrant without going to considerable expense.
There is a copy of a letter concerning the situation
an file in the municipal offices of X1 Portal which was written
by Mr. John 1. 'Mood, realtar, an June 14, 1948. Please be
assured that we expect to correct this violation of building and
zoning regulations.

Referring to the matter of the shack on the rear
of the property, 120 N. E. 91st Street, belonging to Mr.
Boyd Richards, for whom we act as Agent, wish to say that
whereas the shack is not in keeping with the restrictions
of both the Village of Miami Shores and El Portal and should
be eliminated, I beg the indulgence of the municipalities for
the time being, or until the Fall, when Mr. Richards will make
some provision for the elderly man who now occupies the premi-
ses as his only home.
I am assured by Mr. Cushman, living in the Richards
house temporarily, that the man is a respectable person who
is employed by the surrounding residents as gardener and that
the shack is clean and sanitary. I would say further that the
shack is entirely concealed from public view by trees and
shrubbery and I believe I can promise the matter will be satis-
factorily disposed of in the Fall.

Shores Building Code (Ordinance 97, Dec. 12, 1939), prohibiting
the construction of wooden buildings in single-family residence
Zones R -1.to R -12 inclusive; we quote:
"SECTION Z -36 (ZONING CODE):
"CONSTRUCTION, WALLS: All exterior walls in all
districts excepting RF -1 and RF -2 Districts shall be
constructed of concrete or glass blocks, poured
concrete, stone, brick, hollow tile, (without wooden
facings) and all masonry surfaces, excepting those of
vitrified brick, stone, or glass shall be stuecoed,
painted and /or water- proofed."
"SECTION Z -37 (ZONING CODS):
"CONSTRUCTION, ROOF:
"(a) In all residential Districts all roofs shall be
pitched excepting that where "Modernistic design" is used
a flat roof may be constructed of fire resistant material
and covered with standard fire resistant roofing.
"(b) The roof covering of all pitched roofs shall
be of non - combustible materials excepting in RF - and
RF -2 Districts where frame construction is permitted the
roof covering shall be of approved firs resistant materials."

"SECTION B -374 (BUILDING CODE):
"Any person, firm or corporation who shall violate

ordinance shall be punished by a fine not exceeding
Five Hundred ($500) Dollars or imprisonment at hard
labor on the streets or other works of the Village for
a term not exceeding sixty (60) days, or both. Each
day that a violation is permitted to exist shall
consti tt}te a separate offense."

the wooden structures, and all other structures on your property
above referred to which violate the Miami Shores Ordinances,
