Dear Mr. Pedrahita:
I am in receipt of the e-mail you copied to me to the State of Florida. I would like to clarify several
items that we have mentioned to you numerous times, but you seem either to not understand or
unwilling to:
1. Mecias Construction is not known as Mecias Development. They are two separate
entities with two separate functions. In fact, Mecias Development has not even been
opened for business.
2. According to the contract that was signed between you and Mecias Construction
$8,000 was to be submitted upon signing of the contract to cover all the costs
associated with architect fees, plans, sketches, and all costs associated with the
preconstruction phase. As we also have mentioned to you, because of all the non
permitted work that you did before you contracted with our company, items that
would have been accepted with sketches such as kitchen cabinets and bathroom tiles,
we had to go back and add them to the ever growing list of full architectural plans.
Thereby, adding massive expenses of the difference which we have not recovered
from you. Please see attached list of costs.
3. In reference to the signed and sealed drawings, we had mentioned to you that the
drawings take anywhere from 4 -8 weeks depending on the architect and even with
the set backs of Hurricane Wilma we told you that we would have the signed and
sealed drawings ready for you by this past Friday which was 45 days from the signed
contract. So when you mention excuses, I fail to understand what you mean. We
have been clear with you from the beginning.
4. Then lastly, in yesterday's conversation with our Vice - President Juan Mecias, all he
wanted to assure was proper coordination with you because for some reason you
always seem to call someone else except for Mr. Mecias.
5. We have met with you on multiple occasions to not only help you with this problem,
but to also clear up your blatant mistakes that you had committed with Miami Shores
Inspectors. We still stand ready and able to perform this work for you. As
mentioned in the contract, we can only begin after the permits are ready and we will
not shortcut or deviate from the appropriate processes as you had mentioned to Mr.
Juan Mecias in order to reduce the contract.
6. Please be aware that providing false written statements is a criminal act. Your

Dear Ms.George,
I am enclosing a portion of the complaint I submitted to Tallahassee's mediation
department so you can get a better understand what has occurred.
I read Annie Mecias response to your letter and I am still confused. Maybe you can
help me understand what she is saying and explain it to me. I wrote their lawyer
and asked him this same question but as of yet there is no response.
Mr. Mecias claims he terminated our contract (and is keeping the deposit) for three
reasons
None of these reasons make any sense to me. Do they make any sense to you?
Reason # 1
REFUSAL TO ACCEPT RESPONSIBILITY FOR PRE EXISTING AND UNKNOWN CONDITIONS.
Tell him I accept all responsibility to pre existing conditions, whatever that
means, So will he now either do the work or give back the deposit? This is too
silly to comment on
Reason # 2
REFUSAL TO COOPERATE WITH CONTRACTORS ATTEMPT TO OBTAIN PERMITS
In what way am I refusing to cooperate? I gave him $8000.00. I went to building and
zoning and they feel it is because he has no architectural drawings. I spoke to the
chief inspector, Mr. Grande, and he has no idea what Mr. Mecias is referring to. He
said whenever he submits the drawings and pulls the permits he may start the job.
What more can I do?
Reason # 3
MISREPRESENTATION ABOUT THE SCOPE OF PRIOR WORK PERFORMED BY THE HOMEOWNER
This is the most interesting reason. Only after he began to hide and not return my
phone calls did he invoice me for 6 visits at $75.00 per visit. When he wanted the
job he came around for free. He never mentioned he charges $75.00 per visit. He
only made up this invoice after Hurricane Wilma arrived and destroyed many homes
which is the time he disappeared with my deposit. But lets put $75.00 per visit x
six times aside for one minute. He is admitting he came to my house 6 times. How
can I misrepresent the scope of the work? What am I getting for 75.00 per visit?
Ms. George it is obvious Mr. mecias walked away from the job because he decided to
work for more desperate homeowners. If other people are now willing to pay more
money than canceling our contract is unethical. but to keep someone's deposit is
simply criminal.
Since neither Mecias or his lawyer refuse to answer me I have no choice but to
request a mediation in Tallahassee and to report him to the BBB. If ever you find
out what he means by his three reasons for termination I would appreciate if you
let me know.

COMPLAINT DESCRIPTION
I was removing all my cabinets from my house when a city inspector drove by and asked if I had
a permit to do any work. I said no and he suggested I call a General Contractor. I was introduced
to Mr. Macias of Macias Construction CC # 123456 through an acquaintance who said he could
do remodeling and get permits. Macias and I wrote a list of work to be performed and agreed on a
$33,000.00 price with a $8000.00 deposit which I stupidly gave him. Just as he was about to
begin work hurricane Wilma arrived and Mr. Macias disappeared and stopped taking my phone
calls. Mr. Macias claims building and zoning will not approve any of the permits. I asked Claudio
Grande (chief inspector) at building and zoning about this problem and he is also confused why
Macias just walked away. He thinks the problem is with Macias's architectural drawings, sketches
are not acceptable.
I feel Mr. macias just took my deposit and then went off to do other jobs for more desperate
customers. I do not mind him leaving since he didn't even start the job, but keeping my deposit is
unacceptable.
Could you please assist in helping me get back my deposit, Mr. Macias refuses to take my calls

I received a letter from your client Mr.Macias who requests I direct all questions directly to you.
Your client "terminating our contract" and refuses to do any work or return an $8000.00
advance. He says he repeatedly told me why but no one at Building or Zoning or
myself understand what he is saying. Could you please ask your client to explain it to you and
then translate it to us. We requested a hearing /mediation with Tallahassee to get to the bottom of
this. Building and Zoning feels it is just a hurricane abuser case and he is fleecing a customers.

Upon consulting our attorneys please be aware that we are terminating the
contract dated September 30, 2005 between Mecias Construction Corp. and Juan
Pedrahita based on the following:
1. Refusal to accept responsibility for pre- existing and unknown
conditions.
2. Refusal to cooperate with contractor's attempts to obtain permits.
3. Misrepresentation about the scope of prior work performed by the
homeowner.

We are in receipt of your e -mail dated November 15 Honestly, I do not
know how many times I need to explain to you that we have the signed and sealed
drawings waiting for your response so that we can submit them to the city. As we
explained before, due to the work that you had done before on the house that was non
permitted which received a red tag before you signed the contract with us, we would
prefer for the city to go and inspect the house so those items could be added to the plans.
If you prefer not to do that, then we would need your response in writing that you take
responsibility for any delays and additional costs that may be incurred as a result of
these unpredictable items. We have told you that we stand ready and able to perform the
work, but if you do not make a decision and respond back we are at a stand still and we
cannot proceed.
I don't understand why you continue placing roadblocks and obstacles when all we
wanted to do was finish the work and be of assistance to you. We told you from the
beginning that we could not begin the work until the permits were ready. In spite of all
the false accusations that you have written about us, we stand ready and able to perform
the contract which we signed. We wait to hear from you.

1 am in receipt of the e-mail you copied to me to the State of Florida. I would like to clarify several
items that we have mentioned to you numerous times, but you seem either to not understand or
unwilling to:
1. Mecias Construction is not known as Mecias Development. They are two separate
entities with two separate functions. In fact, Mecias Development has not even been
opened for business.
2. According to the contract that was signed between you and Mecias Construction
$8,000 was to be submitted upon signing of the contract to cover all the costs
associated with architect fees, plans, sketches, and all costs associated with the
preconstruction phase. As we also have mentioned to you, because of all the non
permitted work that you did before you contracted with our company, items that
would have been accepted with sketches such as kitchen cabinets and bathroom tiles,
we had to go back and add them to the ever growing list of full architectural plans.
Thereby, adding massive expenses of the difference which we have not recovered
from you. Please see attached list of costs.
3. In reference to the signed and sealed drawings, we had mentioned to you that the
drawings take anywhere from 4 -8 weeks depending on the architect and even with
the set backs of Hurricane Wilma we told you that we would have the signed and
sealed drawings ready for you by this past Friday which was 45 days from the signed
contract. So when you mention excuses, 1 fail to understand what you mean. We
have been clear with you from the beginning.
4. Then lastly, in yesterday's conversation with our Vice - President Juan Mecias, all he
wanted to assure was proper coordination with you because for some reason you
always seem to call someone else except for Mr. Mecias.
5. We have met with you on multiple occasions to not only help you with this problem,
but to also clear up your blatant mistakes that you had committed with Miami Shores
Inspectors. We still stand ready and able to perform this work for you. As
mentioned in the contract, we can only begin after the permits are ready and we will
not shortcut or deviate from the appropriate processes as you had mentioned to Mr.
Juan Mecias in order to reduce the contract.
6. Please be aware that providing false written statements is a criminal act. Your
decision to want to 12re ?cb the contract, ,awe shortly thereafter we suggested that,

you allow the City of Miami Shores Inspectors to inspect your house before
submitting the final drawings to the city so they could clarify your red tag items. If

inspection from the City of Miami - Shores. We have wasted enough time and money
on this situation.

I have attached a copy of the termination letter that I am sending Mr. Piedrahita via
certified mail as well as a copy of his last e -mail to my company. I will be sending an
original copy to you as well. I just wanted to make sure to communicate and that it is in
file in the City of Miami Shores that we will no longer be the General Contractor for the
job and will not be responsible for anything done at the address of 925 NE 91 Terrace.
Please let me know if there is any paperwork I would need to fill out or if this notice is
