Moreover, please be advised that this is an area in unincorporated North Dade County surrounded by various Municipalities such as Miami Shores immediately to our North and City of Miami to the South. Thus, creating an area frequently referred to as an enclave. In any event, for many years an area along Northeast 88 Street just east of Biscayne Blvd. /US 1 along an alley way in Miami Shores jurisdiction or city limits a wall has existed in order to be in compliance with Dade County Code Section 33 -245 which calls for a barrier wall to divide commercial from residential zoning districts. However, back in April much to our dismay this aforementioned wall was knocked down and subsequently never rebuilt. As you may imagine this has caused many safety issues to arise as well as unwanted criminal activity. Many homeowners and people in the community feel that the only way to correct this matter is to rebuilt the wall which was, again I repeat, already there prior to the work done back in April of 1997. Moreover, Mr. Michael Couzzo, City Manager of Miami Shores has expressed to us that they will be willing to help us rebuilt the wall, but need an okay from your department in order to do so. Furthermore, we are fully aware of the need to have access and the possibility that Water and Sewer Department may demolish said wall should ever the need arise; but due to the fact that there are no meters involved and the pipes are for sewage your department realistically should not really need access at least not for many years, especially since the pipes are brand new. In conclusion, we are confidant that after closer review your department should have no difficulty granting us the ability we so rightfully deserve. Rock excavation and excavation of other underground obstructions. • Access panels. • Patching of walls, floors, ceilings, roofs, driveways, etc. NOT IN CONTRACT (continued): Terms and Conditions of Sales ► Air conditioning condensate drainage (unless specifically listed above). ► Utility hook up fees. • Setting of equipment supplied by others. ► Kitchen equipment or related trim (faucets, gas regulators, strainers, etc.). ► Sod or grass replacement. • Temporary utilities. ► Equipment and personnel hoisting. ► Fire stopping of floors, walls or ceilings (unless specifically listed above). ► Toilet room accessories (grab bars, soap dispenser, paper holder, etc.). ► If concrete is to be removed under this contract it will be specifically listed. Should concrete removal be included in this bid it was based on a 4" slab. Should a thicker slab be encountered additional charges will apply. Should a Building Official or Customer require or request: presence at the job site of the Company master(s), journeyman(men), or other ancillary personnel who were not, as a normal course, to be originally assigned to this job; and /or any upgrading; and /or work other than the scope of that specifically listed on the face of this contract, all additional charges incurred (including any and all fees) shall be considered extras and therefore will be charged in addition to the original contract and will be paid for b the customer as extras. Delays caused by other than Empire Plumbing will result in additional charges lb the customer, Empire Plumbing will not, under any circumstances, be responsible for any labor, 't materials, services, fixtures, or work of any kind provided by other than Empire Plumbing. Unless otherwise stated on the reverse side there is no warranty or guaranty of merchantability, or fitness for any particular purpose, or of any other kind express or implied, with respect to the services performed or parts furnished by us, and we do not, of course, make any guaranty with respect to any other breakdown or failure for either parts or labor. Should additional labor, materials, or leak/pipe detection be required, charges will be rendered separately for equipment usage, parts, and labor. It is the customer's responsibility to be present for, and allow access to the premises for Empire Plumbing employees and /or any government or building official. Should any charges, fees, or penalties be assessed by any governmental authority, regardless of the reason, the customer shall be responsible for payment of same. These monies are in excess of the contract amount. Deposits shall be considered as eamed by Empire Plumbing when issued by the customer, and are not refundable. All payment arrangements are C.O.D. unless otherwise indicated. The Customer by, his/her signature accept responsibility for full payment as agreed. If not paid in full when due then interest at the maximum legal rate shall be calculated from the original contract date and shall be added to the net principal balance due. Calculations shall continue on the current balance and interest shall continue accruing in like fashion until payment is affected in full. The customer, in the event of any litigation, shall pay all legal and /or collection fees. Under no circumstances will the liability of Empire Plumbing exceed the face value of this invoice. When signed, the customer acknowledges and agrees to: all charges as indicated, and all of the Terms and Conditions of Sales of this contract.
