Dear Mr. LuBien and Council Members:
Please let this letter serve as my appeal to the decision of the
Miami Shores Planning & Zoning Bouard. I feel that I have a
legitimate request for a variance and have stated the fact that
I can not use my property to its fullest extent. The property
is located on a corner even though one street is dedicated but
unpaved. Because of this fact I do not have the advantage that
a corner lot offers, by being able to have access from two sides,
even though I am required to abide by the set back limits of a
house located on a corner lot. Also there is no service alley
behind the property, so I only have access from the one street.
The house appears to be on an inside lot and not on a corner.
because of the unpaved street and houses that are located to
the south of my property. I would like to build an oversize
garage to house my two (2) cars - and a boat that is 24' long.
The boat is over the legal limit allowable by the Village,
to be parked in my yard. If I am not granted a variance.1
will not be able to keep my boat at my house or be able to
build an oversize garage to allow me extra storage I very
much need.
There are several homes in the area, some with recent additions
where the house sits on a corner and the rear yard is not 15 - feet
as required by the code. I do not understand how they are allowed
to build an addition closer than 15' from the rear property line
and I am not.

Dear Mr. Lu Bien:
We own the property at the above referenced address located in Miami Shores.
The house on this property was built in the early 1920's. it is now over sixty (60)
years old. before any strict ordinances regulating building and zoning codes were
in effect: therefore. the initial property owner built the house with a setback of
13.75 6. 17.5 feet, which are not in compliance with current codes.
The original layout of the property consisted of a main house and two (2) detached
cottages. one in the back of the main house (west side) and the other the north
side of the property. These cottages are wooden frame buildings. not CBS
construction. and therefore non - compliant according to present codes. In 1971
the party from whom we bought the property obtained a variance for the purpose
of building an addition connecting two of the buildings, the main house and the
west cottage.
We are in the process of making optimal use of the property. In trying to obtain
permits to build a garage. wooden decks, concrete wall with wood or wrought
iron panels. re- stucco or put siding on the wood frame structure. driveways and
a swimming pool with its surrounding fence as required by law. We have been
informed by the Miami Shores Building and Zoning Department that the house
is not in compliance with current building codes and we would have to apply
for a variance. We are hereby submitting plans for the changes that we want to
make to the property and respectfully request that you grant us the necessary
variances in order to implement them. Please take into consideration that
all of the non - compliant features of the property were instituted some sixty (60)
years ago. long before zoning codes existed in the area and that we are now being
unjustly penalized for errors not of our own making. Also to our understanding
these features have been grandfathered in.

We believe that the changes we are planning will enhance the value and aesthetic
beauty of' the property. which in turn will contribute to the improvement of the
vicinity as a whole. These changes will serve for constructive purposes as well.
The garage will give added security to our motor vehicles: on two (2) occasions.
Oct. 4, 1987 and May 14. 1987. we were vandalized and our cars broken into
resulting in the loss of valuable stereo equipment and slashed canvas top.
Secondly. Rigo Martinez. one of the owners suffers from a back problem and
he has been ordered by his physician to incur in regular swimming exercises as
part of his therapy. As evidence for your perusal, enclosed is a copy of a letter
from Mr. Martinez's physician explaining this matter in detail.
We would appreciate your giving this matter proper consideration, and expecting
a favorable decision on our behalf, we remain.

Our Miami Shores Police Department records show you were the victim of
a crime in our Village during the past month. I know how upsetting that can
be and am sorry it happened to you.
We are very concerned about the safety of our residents, and always are
looking for effective ways to fight crime in our neighborhoods.
I would appreciate your help. Is there anything that could have been
done by the Village that would have reduced the chance of your becoming the
victim of a crime? Is there anything you could have done, something we could
pass along through our Crime Watch program?
We must all work together to protect the quality of life we enjoy here in
