Dear Mr. Lu Bien:
The property located at 93rd. St. and N.E. 9th. Ave. was
built in 1925 and is 65 years old with many non - compliant
features which have been grandfathered in. 93rd. St. is
dedicated, but unpaved so the house appears that it is not
a corner house but located on an inside lot.
The original layout of the property consisted of a main house
and two (2) detached cottages, one on the west side of the
main house and the other on the north side of the property.
The cottage on the north side is wood frame, not CBS construction.
In 1971 the party from whom we bought the property obtained a
variance for the purpose of building an addition connecting
two of the buildings, the main house and the west cottage.
We are in the process of making optimal use of the property.
In trying to build an oversized 3 car /boat garage by tearing
down the wood structure that sits on the north side of the
property, which now is 5' from the property line, we will have
to build any new structure 15' from the property line,
because of current building codes. Due to some large live
oak trees growing behind the location of the garage, plus the
septic tank and drain field an extra deep garage can not be
built to accomidate a boat which is over 20' in length.
Miami Shores only allows boats under 20' to be parked in a
yard.
We have been told by Miami Shores building & Zoning that we
can not do anything to the presnet detached structure at the
rear (north side) of the property. It can only be left as it
is or torn down. The structure is basically useless.
We believe that the changes we are planning will enhance the
value and aesthetic beauty of the property, which will in
turn contribute to the improvement of the vicinity as a whole.
These changes will serve for constructive purposes as well.
The garage will give added security to our motor vehicles;
on (4) occasions Oct. 4, 1987, May 14, 1987, Aug. 1989 and
one other ocassion we were vandalized and our cars broken
into resulting in the loss of valuable stereo equipment,

slashed top, car parts, trim and tires.
The property located to the north of our house has a side
yard of 18'9" from our adjoining property line. The required
side set back is only 10'. The present structure on our
property is only 5' from the adjoining property line. If we
built at 10' there would be visually 28'9" between houses which
would give a more open feeling than present. There are many
homes in the immediate area which are built closer to property
lines than allowed. We feel that allowing us to build closer
to our property line, will still be in harmony with the
neighborhood since our home appears to be an inside lot rather
than a corner and we will be replacing the old structure, which
is 5' from the property line with a new structure 10' from the
property line. Also with crime in the area we will feel secure
about our cars and boat which is presently not stored at our
property because it exceede.s the allowable 20' length and fear
of our boat being vandilized. Many evenings a plain clothes
Miami Shores policeman has been parked next to our house on
93rd. St. & N.E. 9th. Ave. hoping to catch a burglar that has
been breaking into homes in the area. Also recently the
Priest from St. Martha's (which is located to the west of our
house) addressed the board about the crime in the area.
Driving around the area I have found many homes that have
simular set backs as we are requesting. The properties
are listed below:
