Dear Building Official
This is to address the delay owners arc experiencing in
obtaining local building permits for the installation of their
state_ certified buildings that bear the state Insignia of
approval.
In an effort to provide the manufactured buildings industry
with code uniformity and assure local government and owners that
the manufactured buildings are safe, sanitary, and structurally
sound, the 1971 Legislature passed the Manufactured Buildings
Act, Chapter 5t.;), fart IV, F.S.
The Act authorizes the Department to adopt and administer
the enforcement of uniform construction codes for all
manufactured buildings installed in Florida. All work produced
in the factory is the responsibility of the state while all site
related work (i.e., foundation, tie downs, utility connections,
set backs, etc.) must comply with the locally adopted codes.
Section 553.)7()) of the Act states in part that a
manufactured building bearing a state insignia of approval shall
be deemed to comply with the requirements of all ordinances or
rule enacted by any local government which governs construction.
f.ection 55J . )7 ('.;) , 1'.., states, in part, that a manufactured
building bearing an insignia of approval upon manufacture or
first sale shall not require an additional approval by the local
government in which the building is subsequently sold or
installed. 'Therefore, a local building department is exceeding
its authority by reviewing the plans and specifications of state
certified manufactured buildings beyond the site related issues.
Time delays due to inspections and reviews not .authorised by
statute are unwarranted.
Section 551.30(2), F.S., stipulates that the local
government can require permit fees for those inspections it
tactually performs for the installation of a state:cnrtiriod
building, providing the tees are equal to the amount charged for
similar inspections on conventional buildings. Therefore, Lees
charged for inspections and reviews not authorized by statute are
also not allowed.

1 am pleased to inform you that the Department of Community Affairs has granted Ted's
Sheds, Incorporated approval to manufacture commercial and residential lawn storage buildings
for installation throughout the State of Florida. Your agency informed the Department that the
structural integrity of Ted's Sheds buildings were upgraded enabling the buildings to be installed
throughout Florida.
On site installation requirements are specifically and entirely reserved to local authorities.
These requirements must be reasonable and uniformly applied, the same as for conventional
construction.
A copy of this letter must be attached to the approved plans when making application for
local building permits.

Under the systems approval, Ted Shed's, Inc. has approximately forty different size
and/or style lawn storage buildings. certified by the Department of Community Affairs (DCA).
It would be impractical to reflect the plan approval number for each option on the
state approval letter. Therefore, the Department has traditionally issued a generic approval
authorizing a manufacturing to fabricate buildings for installation in Florida.
