We would like to install a concrete fence around our back yard that we believe would improve the security and appearance of our home as well as security and appearance of the neighborhood. The reason I am writing this letter is to request a compromise with regard to the height of the fence. Specifically, we would like the fence to be six feet tall. Our back yard is adjacent to a bus stop where both city buses and school buses regularly pick up and deliver passengers. Consequently, a six -foot fence would lessen the noise as well as the noxious diesel fumes that our children would be exposed to. In the six years we have lived here, we have had a bicycle and a lawn mower stolen from inside our yard. In both instances, the thieves were able to enter and exit our yard with heavy items in spite of the four -foot chain link fence that is there now. In 2004, a police chase ended up in our front yard. After plowing through both of our cars, the passenger shot his way out of the car and ran through our back yard. While the fence we plan to install may not have helped our cars, it would have deterred the gunman from running through our yard. In January, our neighbor from across the street found a small group of school kids lounging in our back yard, so she asked them to leave. They left and I did not notice anything missing, but the fact that they found our back yard so accessible as to invite themselves in, bothered me. I know that a six foot fence would discourage this type of behavior. a a Despite the medians that have been placed on NE 10 Avenue, we still get a significant amount of speeding cars racing down this street. The fact that our house is right on 10 Avenue increases the likelihood that one of these cars could crash into our yard and endanger my family (God forbid). The barrier we plan to install would lessen the possibility of such a disaster. Finally, I know that other homeowners in our area have been granted variances with regard to the five -foot rule. The houses listed below are just a few of the houses my wife and I have seen while walking around the neighborhood with fences exceeding the five foot limit.
