Pursuant to Article X, Section 1001(c) of the Miami Shores Village Code,
please consider this letter as our Petition to Expand the S -1 District
Usage to include on- premise consumption of beer and wine, as a College
Use, on Barry University campus.
In addition, Article V, Section 501(b) of the Miami Shores Village Code
needs to be amended to add at the end of this Section the words, "or in
an S -1 District, College Use, for Beer and Wine on Barry University Campus ".
As President of Barry, I must assure supervision and security for students
who come here to live and study. I feel that by obtaining a wine and beer
license for the University, I will have a controlled, central place for
students to meet. By providing this place on campus, I hope to eliminate
students driving home from questionable establishments that I cannot super-
vise or secure.
I believe this request is a way I can best fulfill my obligation to students
and the community by removing a potential vehicle hazard to the community,
while providing better supervision and security for students' leisure time.
Enclosed is a check in the amount of $90.00 to cover the initial costs for
the above Petition.

This is in response to your letter of September 10 concerning your
request for a "limited wine and beer license" at Barry University. Miami
Shores does not issue licenses for the on- premise consumption of beer and
wine. This is a function reserved to the State of Florida. However, the
State will not issue such licenses unless the area in which they are to be
used is zoned for that use by the municipality. Thus, since on- premise
consumption of beer and wine is not a permitted use in the S -1 zone in which
Barry University is located you must obtain a change in our zoning ordinance.
I have attached a copy of Section 501 (b) of Appendix A- Zoning to
the Miami Shores Code of Ordinances. This permits the on- premise con -
sumption of alcoholic beverages only on premises occupied by a country club
or in an S -2 district. Since your purpose is somewhat more limited, that
is the authorization of consumption of beer and wine only, some language
would have to be developed to change this ordinance that would permit an
exception for the consumption of beer and wine in an S -1 district. I believe
it would be appropriate to have your attorneys look at this matter and devise
some very clear and concise language to accomplish the specific objective
you have in mind. Once that is done you then need to petition the Planning
Board for a change in zoning ordinance. This procedure is outlined in Article
X, Amendments to Appendix A-Zoning. Section 1001 (c) is specifically per-
tinent. A copy of Article X is attached for your information.
You will note that Article X requires public hearings by the
Planning & Zoning Board and it also requires that the property owners who
have petitioned for a change in zoning pay a fee of not less than $90.00,
plus whatever additional costs are incurred to process the application.
Normally the Board meets with the petitioner prior to a formal public hear-
ing to insure any possible misunderstandings are resolved.
Therefore, as the property owner seeking a change in the zoning
ordinance you should submit a petition to the Planning & Zoning Board

specifying the specific change you wish to have made in the zoning ordinance,
along with the reasons therefor and a check for $90.00 to cover the initial
costs. On receipt of that petition we will schedule the necessary meeting
and hearing with the Planning & Zoning Board. The hearing will require
notification of adjacent property owners and publication in the Village
bulletin or similar media exposure. If the Planning & Zoning Board acts
favorably on your request the matter will then go to the Village Council as
a proposed ordinance change. This will require an advertised meeting with
the Council to determine if they will accept the proposed change followed
by two public hearings if they decide to proceed to an ordinance change.
If the Planning & Zoning Board does not favorably consider your
request the matter can be appealed to the Village Council but will then
require an extraordinary majority of four members of the Council to override
the adverse decision of the Planning & Zoning Board.
I am sorry to have to impose all of these bureaucratic requirements
on you. However, it is important that this be done correctly to insure that
whatever the decision of the Planning Board and Council may be it is not
subject to a legal challenge at some future date. If I can be of any assist-
ance please do not hesitate to call me.
