Sub - paragraph 4501.3 (d) (3) of the South Florida Building Code provides for a 30 day maximum approval only in an
URGENT NECESSITY for electric current exists. Necessity shall include the use of current for irrigation, security,
humidity control, emergency power and lighting, such as for testing or construction purposes, provided the Electrical
Contractor and owner do hereby agree to assume the responsibility of maintaining the installation in such a manner that
there is no hazard to life and property.
Such approval is in no event to be considered a release of said structure for purposes of use and occupancy, and no
occupancy shall be granted or permitted until final inspections have been called for and approved by the inspection
divisions concerned, and an occupancy permit obtained.
The undersigned also understand that the temporary- electric approval is subject to rescission and cancellation, and
electric power can be cut off at the discretion of the Build rig and Zoning Department and will be disconnected if the
building concerned is occupied before final inspections are approved and occupancy permit obtained.

Dear Members of the Planning and Zoning Board:
Barry University is contemplating further development on its Miami Shores campus.
This development involves several student - oriented programs and facility expansion for
the Graduate School of Medical Sciences.
Overall the development will begin to draw together the new properties, recently
acquired by the University, into a cohesive campus serving the students, faculty and
staff at Barry.
Starting with changes proposed on the eastern most parcel of land bounded by NE 2 "d
Avenue on the east and North Miami Avenue on the west. The University is proposing a
35,000 square foot expansion at Wiegand Hall. This expansion will include classrooms,
labs, faculty offices and student support facilities for the Graduate School of Medical
Sciences. At North Miami Avenue our proposal involves a roadway revision to
incorporate principles of "traffic calming" within the south to north boundaries of the
campus. Along with this roadway improvement will be a second level crossing of North
Miami Avenue. Starting at the second level of Lehman Hall, this crossing will provide
space for student services and serve as an entry point to the new Student Union.
On the campus parcel located west of North Miami Avenue, extending to North West 2"
Avenue, Barry University is planning the new Student Union. This facility will parallel
North Miami Avenue. It will be designed to focus on activity courtyards similar to those
located on the existing Barry University Campus. This two -story development will
contain approximately 100,000 square feet of student activity and support spaces. On
this same parcel of land Barry University will build 350 beds of new student residence
facilities. These new facilities will be located north of the existing Health & Sports Center
with entrance being located on NW 115 Street. Extending east to west just south of the
new Residence Facilities and just north of the new Student Union will be a Linear Park.
This park will serve as a pedestrian way linking all campus elements. Parking displaced
by the new Student Union will be accommodated on property located west of NW 2"
Avenue on the former site of the Biscayne Kennel Club. The Linear Park will extend to
this new Parking Grove and will create a pathway for an inter - campus shuttle serving
commuters and users of the Barry University facilities.
The previously mentioned Parking Grove will provide 954 spaces under a canopy of
mahogany trees. The mahogany is a native species that is fast growing, non - staining
and has a root system that is compatible with adjacent paving.

Parking for this new development includes the 954 spaces in the Parking Grove. This
will account for the replacement of 772 spaces that are moved to accommodate the new
Student Union and Student Residence facilities. 182 additional spaces include those
needed to meet zoning requirements for planned, multi - purpose facilities, a theater
containing 150 seats and 12,500 square feet of retail space in the new Student Union.
Parking for residents of the new student housing facilities will be located immediately
adjacent to the new three -story development. Staff parking associated with the Student
Residences will be included in the adjusted total for the Parking Grove. Adjustments to
parking near the new School of Graduate Medical Sciences will provide 83 new spaces
even though the school will serve the same student enrollment that it currently does.
These new spaces will provide greater access for faculty and staff near academic
facilities.
We look forward to presenting this material, in greater detail, at the meeting of the
Planning & Zoning Board at your meeting of July 14, 1999.

Because of my Vermont vacation I will not be able to attend the Planning Board Meeting
on July 14 1999. However, 1 note that the very recently published corrected Agenda lists as
Item #5 a review of preliminary site plans for Barry University. Because of the very short notice
upon which this matter is being brought before the Board and various other unique circumstances,
including the pending administrative appeal brought against the Village by Barry University
concerning the former dog track site, it is reasonable to anticipate that the Board may have legal
questions to direct to the Village Attorney. This memo is an attempt to respond in advance to
those anticipated questions.
1. Thning. I am aware that this matter has been placed on the Board's Agenda on
relatively short notice. While I understand that staff usually tries to afford the Board (and the
public) approxirnarely 10 days advance notice of the matters to be considered at the upcoming
meeting, I am not aware of any formal requirement in this regard. I understand the only formal
requirement to be that "reasonable" advance notice be provided. I am somewhat concerned about
the short period of time between posting notice of consideration of this issue and the meeting,
particularly in light of the importance and complexity of the issue and the fact that the meeting
is being held on a different day than that on which the Board has historically met. If any of these
issues arise and are troublesome to any members of the Board an appropriate motion could be
made to table the matter either indefinitely or to the next scheduled meeting.

2. The Pending Litigation. As you may or may not know, the Comprehensive Plan
adopted by the Village when the dog track was still in existence essentially provided that the dog
track property would be zoned for single family residential use in the event the then existing dog
track use every ceased. Of course, the owners of the dog track did cease using the property in
that fashion and brought an administrative appeal against the Village challenging this zoning. This
appeal is still pending. When the property was sold to Barry University, Barry took over the
appeal. The Village is currently involved in sensitive settlement negotiations with Barry but no
agreement to resolve this issue has yet been reached.
It appears that there are two potential outcomes that could arise from this litigation. If the
Village prevails, the dog track property would remain zoned residential. If, for any reason, Barry
were to prevail in the litigation, the residential designation would be overturned and the property
would revert back to its commercial zoning for dog track purposes. Under neither scenario would
it appear that the property would properly zoned for the uses which I understand Barry is
proposing. I believe that the zoning for the property currently being used by Barry University
adjacent to the dog track property is S -1 zoning which includes colleges and buildings and uses
customarily appurtenant thereto.
Because of these circumstances, and while the Board is certainly free to review the
preliminary site plan, asks questions and gather information with respect thereto, an argument
could be made that it would be premature at this juncture for the Board to vote upon and make
any determination either in favor or against approval of these preliminary site plans. For
example, a vote at this time which disapproved the preliminary site plan because it appears to
transfer existing parking (necessary to support existing buildings) to the dog track property where
such parking facilities would be inconsistent with existing residential zoning, might be premature
in the event that the University is successful in negotiating a resolution of the existing litigation
that could potentially lead to re-zoning of the dog track property. Similarly, a vote at this time
which approves the preliminary site plan could also be viewed as premature and detrimental to
the ongoing negotiations for many of the same reasons.
3 . Disclosure of this Communication. This memo to you is, of course, a public record
and should be included in the staffs files for this matter. Moreover, in accordance with the
Village's ordinance concerning ex -parte communications, each member of the Board who reviews
this memorandum should announce that fact at the meeting and a copy of this memorandum should
be made available, upon request, to any member of the public at the meeting who wishes to
review it. Of course, the applicant, or anyone else holding an opposing view to the matters
contained herein, should be given the opportunity to present their views at the meeting before any
action is taken.
I apologize for having to miss the meeting but I hope this memo has been useful.

Mr. Crutchfield moved to approve the Minutes as amended, subject to ` tr. Fernandez being able to bring up his
proposed amendment to Item #4 at the next meeting. Mr. McCoy seconded the motion and the vote was
unanimous in favor.
Mr. Fernandez reiterated his request to amend the order of the Agenda. moving Items IA to the end of the Agenda
and Item 5 to the beginning of the Agenda, as it is his intention to table the Item based on the Village Attorney's
absence. This was agreed upon by the members of the Board.
ITEM #5 REVIEW OF PRELIMINARY PLANS.
Barry University 11300 N.E. 2 Avenue
Due to the short noticing of the Item, implications of future construction at Barry University, and issues raised in
Mr. Sarafan's memorandum, which all members of the Board received. Mr. Fernandez moved that without the
presence of the Village Attorney, Mr. Sarafan, it would be in the best interest for all concerned to table the Item.
Mr. Crutchfield seconded the motion and the vote was unanimous in favor.
ITEM #2 REQUEST FOR APPROVAL OF PLANS FOR CANVAS AWNINGS & CANOPY.

Mr. LuBien offered background information and the fact that changing the exterior of a building in the B-2 zoning
district requires Board approval A motion was made and seconded to consider Items 2 and 3 jointly but upon
further consideration, the motion and second were withdrawn and the hems considered separately. The property
owner, Mr. Ibrahim was present and provided the Board with some of the details regarding the requested awnings
Mr. LuBien confirmed that canvas awnings were wed in the B-2 Zone, and Mr. Ibrahim confirmed that there
are no plans to back -light the awnings or to use the awnings as sign sots. Mr. McCoy and Mr. Crutchfield
indicated that they had driven by the property and that the awnings were already installed at this particular
address. A discussion regarding the permitting of the project ensued. Mr. McCoy moved to accept the application
for installation of the awnings at 650 N.E. 88` Terzace. Mr. Fernandez second the motion and the vote was
unanimous in favor.
ITEM #3 REQUEST FOR APPROVAL OF PLANS FOR CANVAS VI ITGS & CANOPY.

Mr. LuBien confirmed that other than the number of awnings requested. there is no substantial difference between
this Item and Item #2. Mr. Fernandez moved to approve the application. Mr. McCoy seconded the motion and the
vote was unanimous in favor.

Mr. LuBien informed the Board that the property owner did not obtain a permit prior to the painting of his home.
He further indicated that the newly painted exterior color is not dppiupiiate. Three members of the Board
indicated
that they had driven past the property in question. Mr. LuBien indicated that Mr. Bernstein has now applied for a
painting permit, Mr. LuBien provided photos of the property for review to the Board. Mr. Fernandez expressed
his opinion that the color indicated in the photos does not accurately rerect the color of the home, as seen at
approximately 4:00 PM on a sunny day. Mr. McCoy moved to deny the appeal, upholding the Building Official's
denial Mr. Fernandez seconded the motion. _
Board Members discussed the various aspects they look at when consid: ing exterior colors, including general
neighborhood, landscaping, facade materials, v chility, etc. and the collective decision of the Board which in
essence creates the "community appeal".
Subsequent to these discussions, the motion was repeated. The vote was as follows: Mr. Powell. Mr. Fernandez.
Mr. Crutchfield and Mr. McCoy were in favor of the motion. Mr. Stir•. voted against. the .:lotion. The motion
to deny passed.
