ARCHITECTURE PLANNING ,NFERIOR DESIGN Dear Members of the Planning and Zoning Board: Barry University is contemplating further development on its Miami Shores campus. This development involves several student - oriented programs and facility expansion for the Graduate School of Medical Sciences. Overall the development will begin to draw together the new properties, recently acquired by the University, into a cohesive campus serving the students, faculty and staff at Barry. Starting with changes proposed on the eastern most parcel of land bounded by NE 2 "d Avenue on the east and North Miami Avenue on the west. The University is proposing a 35,000 square foot expansion at Wiegand Hall. This expansion will include classrooms, labs, faculty offices and student support facilities for the Graduate School of Medical Sciences. At North Miami Avenue our proposal involves a roadway revision to incorporate principles of "traffic calming" within the south to north boundaries of the campus. Along with this roadway improvement will be a second level crossing of North Miami Avenue. Starting at the second level of Lehman Hall, this crossing will provide space for student services and serve as an entry point to the new Student Union. On the campus parcel located west of North Miami Avenue, extending to North West 2" Avenue, Barry University is planning the new Student Union. This facility will parallel North Miami Avenue. It will be designed to focus on activity courtyards similar to those located on the existing Barry University Campus. This two -story development will contain approximately 100,000 square feet of student activity and support spaces. On this same parcel of land Barry University will build 350 beds of new student residence facilities. These new facilities will be located north of the existing Health & Sports Center with entrance being located on NW 115 Street. Extending east to west just south of the new Residence Facilities and just north of the new Student Union will be a Linear Park. This park will serve as a pedestrian way linking all campus elements. Parking displaced by the new Student Union will be accommodated on property located west of NW 2" Avenue on the former site of the Biscayne Kennel Club. The Linear Park will extend to this new Parking Grove and will create a pathway for an inter - campus shuttle serving commuters and users of the Barry University facilities. The previously mentioned Parking Grove will provide 954 spaces under a canopy of mahogany trees. The mahogany is a native species that is fast growing, non - staining and has a root system that is compatible with adjacent paving. This will account for the replacement of 772 spaces that are moved to accommodate the new Student Union and Student Residence facilities. 182 additional spaces include those needed to meet zoning requirements for planned, multi - purpose facilities, a theater containing 150 seats and 12,500 square feet of retail space in the new Student Union. Parking for residents of the new student housing facilities will be located immediately adjacent to the new three -story development. Staff parking associated with the Student Residences will be included in the adjusted total for the Parking Grove. Adjustments to parking near the new School of Graduate Medical Sciences will provide 83 new spaces even though the school will serve the same student enrollment that it currently does. These new spaces will provide greater access for faculty and staff near academic facilities. However, 1 note that the very recently published corrected Agenda lists as Item #5 a review of preliminary site plans for Barry University. Because of the very short notice upon which this matter is being brought before the Board and various other unique circumstances, including the pending administrative appeal brought against the Village by Barry University concerning the former dog track site, it is reasonable to anticipate that the Board may have legal questions to direct to the Village Attorney. This memo is an attempt to respond in advance to those anticipated questions. 1. Thning. I am aware that this matter has been placed on the Board's Agenda on relatively short notice. While I understand that staff usually tries to afford the Board (and the public) approxirnarely 10 days advance notice of the matters to be considered at the upcoming meeting, I am not aware of any formal requirement in this regard. I understand the only formal requirement to be that "reasonable" advance notice be provided. I am somewhat concerned about the short period of time between posting notice of consideration of this issue and the meeting, particularly in light of the importance and complexity of the issue and the fact that the meeting is being held on a different day than that on which the Board has historically met. The Pending Litigation. As you may or may not know, the Comprehensive Plan adopted by the Village when the dog track was still in existence essentially provided that the dog track property would be zoned for single family residential use in the event the then existing dog track use every ceased. Of course, the owners of the dog track did cease using the property in that fashion and brought an administrative appeal against the Village challenging this zoning. This appeal is still pending. When the property was sold to Barry University, Barry took over the appeal. The Village is currently involved in sensitive settlement negotiations with Barry but no agreement to resolve this issue has yet been reached. It appears that there are two potential outcomes that could arise from this litigation. If the Village prevails, the dog track property would remain zoned residential. If, for any reason, Barry were to prevail in the litigation, the residential designation would be overturned and the property would revert back to its commercial zoning for dog track purposes. Under neither scenario would it appear that the property would properly zoned for the uses which I understand Barry is proposing. I believe that the zoning for the property currently being used by Barry University adjacent to the dog track property is S -1 zoning which includes colleges and buildings and uses customarily appurtenant thereto. Because of these circumstances, and while the Board is certainly free to review the preliminary site plan, asks questions and gather information with respect thereto, an argument could be made that it would be premature at this juncture for the Board to vote upon and make any determination either in favor or against approval of these preliminary site plans. For example, a vote at this time which disapproved the preliminary site plan because it appears to transfer existing parking (necessary to support existing buildings) to the dog track property where such parking facilities would be inconsistent with existing residential zoning, might be premature in the event that the University is successful in negotiating a resolution of the existing litigation that could potentially lead to re-zoning of the dog track property. Similarly, a vote at this time which approves the preliminary site plan could also be viewed as premature and detrimental to the ongoing negotiations for many of the same reasons. 3 . Disclosure of this Communication. This memo to you is, of course, a public record and should be included in the staffs files for this matter. Moreover, in accordance with the Village's ordinance concerning ex -parte communications, each member of the Board who reviews this memorandum should announce that fact at the meeting and a copy of this memorandum should be made available, upon request, to any member of the public at the meeting who wishes to review it. Of course, the applicant, or anyone else holding an opposing view to the matters contained herein, should be given the opportunity to present their views at the meeting before any action is taken. Mr. Crutchfield seconded the motion and the vote was unanimous in favor. ITEM #2 REQUEST FOR APPROVAL OF PLANS FOR CANVAS AWNINGS & CANOPY. ANJ Future Investment 650 N.E. 88° Terrace Mr. LuBien offered background information and the fact that changing the exterior of a building in the B-2 zoning district requires Board approval A motion was made and seconded to consider Items 2 and 3 jointly but upon further consideration, the motion and second were withdrawn and the hems considered separately. The property owner, Mr. Ibrahim was present and provided the Board with some of the details regarding the requested awnings Mr. LuBien confirmed that canvas awnings were wed in the B-2 Zone, and Mr. Ibrahim confirmed that there are no plans to back -light the awnings or to use the awnings as sign sots. Mr. McCoy and Mr. Crutchfield indicated that they had driven by the property and that the awnings were already installed at this particular address. A discussion regarding the permitting of the project ensued. Mr. McCoy moved to accept the application for installation of the awnings at 650 N.E. 88` Terzace.
