A RESOLUTION OF THE COUNCIL OF MIAMI SHORES
VILLAGE, FLORIDA, RESCINDING RESOLUTION NO.
2024-17; DETERMINING NOT TO MOVE FORWARD WITH
FLORIDA LOCAL AGENCY PROGRAM ("LAP")
AGREEMENT WITH THE STATE OF FLORIDA
DEPARTMENT OF TRANSPORTATION ("FOOT") FOR
THE NE 6TH AVENUE (SR-915) PEDESTRIAN
PROMENADE . PROJECT; PROVIDING FOR
IMPLEMENTATION; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on June 18, 2024, Miami Shores Village (the "Village") adopted
Resolution No. 2024-17, approving execution of a Florida Department of
Transportation ("FOOT") Local Agency Program ("LAP") Agreement, FM No.
446054-1-58-01 / 68-01, for the NE 6th Avenue (SR-915) Pedestrian Promenade
project between NE 96th Street and NE 107th Street (the "Project"); and
WHEREAS, the LAP Agreement provided for FOOT participation in the
funding of the Project, including construction and construction engineering and
inspection ("CEI") services; and
WHEREAS, following further evaluation of the Project, including design
development, interagency coordination, constructability considerations, and overall
project feasibility, the Village has determined that it is no longer in the Village's best
interest to proceed with the Project under the existing LAP Agreement; and
WHEREAS, the Village desires to formally rescind Resolution No. 2024-17
and to discontinue further advancement of the Project.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Village Council of
Miami Shores Village, Florida, that:
Section 1. Recitals Adopted. The foregoing recitals are true and correct
and are incorporated herein by reference.
Section 2. Rescission of Resolution 2024-17. Resolution No. 2024-17,
attached as Exhibit "A," is hereby rescinded in its entirety, as the Mayor and Village
Council have determined not to move forward with the NE 6th Avenue (SR-915)
Pedestrian Promenade Project due to, among other things, feasibility concerns.
Section 3. Implementation. The Village Manager or designee is hereby
authorized and directed to provide written notice of this Resolution to FOOT and to
execute any correspondence, certifications, or close-out documents necessary to
implement this Resolution, including coordination regarding any eligible costs
incurred, if applicable.
Section 4.
