Installation Instructions PLUMBING CONNECTIONS The MasterTemp heater has the unique capability of direct schedule 40 PVC plumbing connections. A set of bulkhead fittings is included with the MasterTemp heater to insure conformity with Pentair's recommended PVC plumbing procedure. Other plumbing connections can be used. See Figure 3 for plumbing connections. ACAUTION Before operating the heater on a new installation, turn on the circulation pump and bleed all the air from the filter using the air relief valve on top of the filter. Water should flow freely through the heater. Do not operate the heater unless water in the pool/spa is at the proper level. If a manual by-pass is installed, temporarily close it to insure that all air is purged from the heater. WATER CONNECTIONS The heater requires proper water flow and pressure for its operation. See Figure 5 for the recommended installation. The filter pump discharges to the filter, the filter discharges to the heater, and the heater discharges directly to the pool or spa. A manual bypass valve should be installed across the heater when the pump flow exceeds 120 GPM (454 LPM). See "WATER FLOW RATE" on page 13- Table I for setting of the manual by-pass valve. Make sure that the outlet plumbing from the heater contains no shut-off valves or other flow restrictions that could prevent flow through the heater (except for pool installations as noted below, or winterizing valves where needed). To switch flow between the pool and spa, use a divener valve. Do not use any valve that can shut off the flow. Install the chemical feeder downstream of the heater. Install a chemical resistant one-way check valve between the heater and the chemical feeder to prevent back -siphoning through the heater when the pump is off. FROM POOL PUMP 3-Way Valve NOTICE: If the heater is plumbed in backwards, it will cycle continuously. Make sure piping from filter is not reversed when installing heater. Connect the heater directly to 2" PVC pipe, using the integral unions provided. Heat sinks are not required. The low thermal mass of the heater will prevent overheating of the piping connected to the pump even if the heater shuts down unexpectedly. Occasionally a two -speed pump will not develop enough pressure on the low speed to operate the heater. In this case, run the pump at high speed only to operate the heater. If this does not solve the problem, do not try to run the heater. Instead, correct the installation. Do not operate the heater while an automatic pool cleaner is also operating. If the circulation pump suction is plugged (for example by leaves), there may not be adequate flow to the heater. Do not rely on the pressure switch in this case. Installation Instructions 13 VALVES When any equipment is located below the surface of the pool or spa. valves should be placed in the circulation piping system to isolate the equipment from the pool or spa. Check valves are reconiinended to prevent back -siphoning. Back - siphoning is most likely to occur when the pump stops, creating a pressure -suction differential. Do NOT sanitize the pool by putting chlorine tablets or sticks into the skimmer(s). When the pump is off, this will cause a high concentration of chlorine to enter the heater, which could cause corrosion damage to the heat exchanger. ©CAUTION Exercise care when installing chemical feeders so as to not allow back siphoning of chemical into the heater, filters or pump. When chemical feeders are installed in the circulation of the piping system, make sure the feeder outlet line is down stream of the heater, and is equipped with a positive seal noncorrosive "Check Valve", (P/N R172288), between the feeder and heater. MANUAL BY-PASS Where the water flow rate exceeds the maximum 120 GPM, a manual bypass should be installed and adjusted. After installing the valve, adjust the valve to bring the flow rate within the acceptable range. Then remove the valve handle or lock it in place to avoid tampering. See Figure 4, Model Min. Remove Handle. ---, Outlet to pool Inlet to heater BELOW POOL LEVEL INSTALLATION If the heater is below water level, the pressure switch must be adjusted. This adjustment must be done by a qualified service technician. See following CAUTION before installation. ©CAUTION BELOW OR ABOVE POOL INSTALLATION The water pressure switch is set in the factory at 3.00 PSI (± 0.75 PSI). This setting is for a heater installed at pool level. If the heater is to be installed more than V above or below, the water pressure switch must be adjusted by a qualified service technician. See page 35, Figure 29. FLOW SWITCH If the heater is installed more than 5' above the pool or more than 4' below the pool level, you will be beyond the limits of the pressure switch and a flow switch must be installed. Locate and install the flow switch externally on the outlet piping from the heater, as close as possible to the heater. Connect the flow switch wires in place of the water pressure switch wires. Rev. Installation Instructions GAS CONNECTIONS GAS LINE INSTALLATIONS NOTE: SEE PAGE 55 TO INSTALL THE GAS PIPE ESCUTCHEON. THIS ENSURES THE HEATER IS RODENT RESISTANT. Before installing the gas line, be sure to check which gas the heater has been designed to burn. This is important because different types of gas require different gas pipe sizes. The rating plate on the heater will indicate which gas the heater is designed to burn. The Table 2, shown on page 15, show which size pipe is required for the distance from the gas meter to the heater. The table is for natural gas at a specific gravity of .65 and propane at a specific gravity of 1.55. When sizing gas lines, calculate three (3) additional feet ofstraight pipe for every elbow used. When installing the gas line, avoid getting dirt, grease or other foreign material in the pipe as this may cause damage to the gas valve, which may result in heater failure. The gas meter should he checked to snake .cure that it will .supply enough gas to the heater and an other appliances that maybe used on the same meter. The heater requires a gas supply of not less than 4" (10.2 cm) we and not more than 14" (35.6 cm) we. Gas supply pressures outside of this range may result in improper burner operation. A minimum flowing or dynamic inlet pressure (while the heater is running) of4" (10.2cm) we is required to maintain input rating with no more than a 2" pressure drop between static and dynamic. The gas supply must be installed in accordance with the National Fuel Gas Code. ANSIZ22.1.1. or standard CSA B149.1, Natural Gas and Propane Installation Codes, as applicable and all applicable local codes. Install a manual shut-off valve and a sediment trap and union located outside the heater panels, see Figure 6. Do not use a restrictive gas cock. Tile following minimum gas pipe sizes are recommended for natural gas supply piping, see Table 2 on page 15. For low pressure LP gas, pipe size may be reduced by 1 / 4", with a minimum pipe size of 1 /2". Check for compliance with local codes. The heater and any other gas appliances must be disconnected from the gas supply piping system during any pressure testing on that system. (greater than 1/2 PSI). The heater and its gas connection must be leak tested before placing the heater in operation. Do not use flame to test the gas line. 1Jsc soapy water or another nonflammable method. NOTE A manual main shut-off valve must be installed externallv to the heater. ©WARNING DO NOT INSTALL THE GAS LINE UNION INSIDE THE HEATER CABINET. THIS WILL VOID YOUR WARRANTY. SEDIMENTTRAPS Install a sediment trap and union located outside the heater panels in accordance with National code requirements. Do not use a restrictive gas cock. The sediment trap shall be either a tee fitting with a capped nipple in the bottom outlet which can be removed for cleaning, as illustrated in Figure 6, or an other device recognized as an effective sediment trap. Do NOT use an open flame to test for leaks. Test all gas connections for leaks with soapy water or another non-flanunable method (see page 14). The heater and its individual shut-off valve must be disconnected from the gas supply piping system during any pressure testing of that system at test pressures in excess of 1 /2 psig (3.5 kPa). The heater must be isolated from the gas supply system by closing its individual manual shut-off valve during any pressure testing of the gas supply at test pressures equal to or less than 1 /2 psig (3.5 kPa). CHECKING THE GAS PRESSURE THROUGH THE COMBINATION GAS CONTROL VALVE AWARNING Risk of fire and explosion. Improper installation, incorrect adjustment, alteration, service, or maintenance of the Combination Gas Control Valve can lead to fire or explosion, causing loss of life, personal injury, and/or property damage. If it is necessary to adjust the gas valve, this must be done by only by a qualified service agency. These instructions are for the use of qualified service technicians only! This appliance is equipped with an unconventional gas control valve that is factory set with a manifold pressure of —.2" (-0.5cm) we. Installation or service must be performed by a qualified installer, service agency, or the gas supplier. If this control valve is replaced, it must be replaced with an identical control. For proper operation, the regulated pressure at the outlet manifold of the valve must be —0.2" (-0.5cm) we below the reference pressure at the blower mixer inlet, and the gas valve `VENT' tap must be connected to the end cap air orifice as shown in Figure 7. Do not attempt to adjust the gas input by adjusting the regulator setting. The correct gas regulator setting is required to maintain proper combustion and must NOT be altered. Rev. Installation Instructions ©CAUTION The use of Flexible Connectors (FLEX) is NOT recommended unless they are properly sized according to the supplier recommendations for the heater rating. Propane is heavier than air. Do not install the heater using propane in pits or other locations where gas might collect. Consult your local building code officials to determine installation requirements and specific installation restrictions of the heater relative to propane storage tanks and filling equipment. Installation must meet the requirements for the Standard for the Storage and Handling of Liquid Petroleum Gases, ANSI/NFPA58 (latest edition) in the U.S., or CAN/CSA 13149.2 (latest edition) in Canada. Consult local codes and fire protection authorities about specific installation restrictions. Locate the heater on a level surface in an open area that is protected from drainage or run-off. Install the heater in an area where leaves or other debris will not collect on or around the heater. To avoid damage to the electronic components in the heater, take care to prevent prolonged exposure to driving sources of water (such as lawn sprinklers, heavy roof runoff, hoses, etc.). Avoid operation in persistent, extreme, moist or salty environments. In extreme weather, shut down the heater and disconnect the power to it until the weather has moderated. In areas subject to hurricanes or very high winds, purchase the Bolt Down Bracket Kit, P/N 460738. HEATER CLEARANCES — OUTDOOR IMPORTANT! • In an outdoor installation it is important to ensure water is diverted from overhanging eves with a proper gutter/drainage system.The heater must be set on a level foundation for proper drainage. • This unit shall not be operated outdoors at temperatures below -200 F. If the heater is located under a roof overhang, there must be at least three (3) feet (1m) of clearance between the bottom of the overhang and the top of the heater exhaust vent, see Figure 8. if the heater is under a roof overhang, the space around the heater must be open on three sides. DO NOT, under any circumstances, install the heater under ANY deck. History.—s. 1, ch. 2000-143. 515.23 Legislative findings and intent. —The Legislature finds that drowning is the leading cause of death of young children in this state and is also a significant cause of death for medically frail elderly persons in this state, that constant adult supervision is the key to accomplishing the objective of reducing the number of submersion incidents, and that when lapses in supervision occur a pool safety feature designed to deny, delay, or detect unsupervised entry to the swimming pool, spa, or hot tub will reduce drowning and near -drowning incidents. In addition to the incalculable human cost of these submersion incidents, the health care costs, loss of lifetime productivity, and legal and administrative expenses associated with drownings of young children and medically frail elderly persons in this state each year and the lifetime costs for the care and treatment of young children who have suffered brain disability due to near -drowning incidents each year are enormous. Therefore, it is the intent of the Legislature that all new residential swimming pools, spas, and hot tubs be equipped with at least one pool safety feature as specified in this chapter. It is also the intent of the Legislature that the Department of Health be responsible for producing its own or adopting a nationally recognized publication that provides the public with information on drowning prevention and the responsibilities of pool ownership and also for developing its own or adopting a nationally recognized drowning prevention education program for the public and for persons violating the pool safety requirements of this chapter. (3) "Department" means the Department of Health. (4) "Exit alarm" means a device that makes audible, continuous alarm sounds when any door or window which permits access from the residence to any pool area that is without an intervening enclosure is opened or left ajar. (5) "Indoor swimming pool" means a swimming pool that is totally contained within a building and surrounded on all four sides by walls of or within the building. (6) "Medically frail elderly person" means any person who is at least 65 years of age and has a medical problem that affects balance, vision, or judgment, including, but not limited to, a heart condition, diabetes, or Alzheimer's disease or any related disorder. (7) "Outdoor swimming pool" means any swimming pool that is not an indoor swimming pool. (8) "Portable spa" means a nonpermanent structure intended for recreational bathing, in which all controls and water -heating and water -circulating equipment are an integral part of the product and which is cord - connected and not permanently electrically wired. (9) "Public swimming pool" means a swimming pool, as defined in s. 514.011(2), which is operated, with or without charge, for the use of the general public; however, the term does not include a swimming pool located on the grounds of a private residence. (10) "Residential" means situated on the premises of a detached one -family or two-family dwelling or a one - family townhouse not more than three stories high. (11) "Swimming pool" means any structure, located in a residential area, that is intended for swimming or recreational bathing and contains water over 24 inches deep, including, but not limited to, in -ground, aboveground, and on -ground swimming pools; hot tubs; and nonportable spas. (12) "Young child" means any person under the age of 6 years. History.—s. 1, ch. 2000-143. 515.27 Residential swimming pool safety feature options; penalties.— (1) In order to pass final inspection and receive a certificate of completion, a residential swimming pool must meet at least one of the following requirements relating to pool safety features: (a) The pool must be isolated from access to a home by an enclosure that meets the pool barrier requirements of s. 515.29; (b) The pool must be equipped with an approved safety pool cover; (c) All doors and windows providing direct access from the home to the pool must be equipped with an exit alarm that has a minimum sound pressure rating of 85 dB A at 10 feet; (d) All doors providing direct access from the home to the pool must be equipped with a self -closing, self - latching device with a release mechanism placed no lower than 54 inches above the floor; or (e) A swimming pool alarm that, when placed in a pool, sounds an alarm upon detection of an accidental or unauthorized entrance into the water. Such pool alarm must meet and be independently certified to ASTM Standard F2208, titled "Standard Safety Specification for Residential Pool Alarms," which includes surface motion, pressure, sonar, laser, and infrared alarms. For purposes of this paragraph, the term "swimming pool alarm" does not include any swimming protection alarm device designed for individual use, such as an alarm attached to a child that sounds when the child exceeds a certain distance or becomes submerged in water. (2) A person who fails to equip a new residential swimming pool with at least one pool safety feature as required in subsection (1) commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083, except that no penalty shall be imposed if the person, within 45 days after arrest or issuance of a summons or a notice to appear, has equipped the pool with at least one safety feature as required in subsection (1) and has attended a drowning prevention education program established by s. 515.31. (b) The barrier may not have any gaps, openings, indentations, protrusions, or structural components that could allow a young child to crawl under, squeeze through, or climb over the barrier. (c) The barrier must be placed around the perimeter of the pool and must be separate from any fence, wall, or other enclosure surrounding the yard unless the fence, wall, or other enclosure or portion thereof is situated on the perimeter of the pool, is being used as part of the barrier, and meets the barrier requirements of this section. (d) The barrier must be placed sufficiently away from the water's edge to prevent a young child or medically frail elderly person who may have managed to penetrate the barrier from immediately falling into the water. (2) The structure of an aboveground swimming pool may be used as its barrier or the barrier for such a pool may be mounted on top of its structure; however, such structure or separately mounted barrier must meet all barrier requirements of this section. In addition, any ladder or steps that are the means of access to an aboveground pool must be capable of being secured, locked, or removed to prevent access or must be surrounded by a barrier that meets the requirements of this section. (3) Gates that provide access to swimming pools must open outward away from the pool and be self -closing and equipped with a self -latching locking device, the release mechanism of which must be located on the pool side of the gate and so placed that it cannot be reached by a young child over the top or through any opening or gap. (4) A wall of a dwelling may serve as part of the barrier if it does not contain any door or window that opens to provide access to the swimming pool. (5) A barrier may not be located in a way that allows any permanent structure, equipment, or similar object to be used for climbing the barrier. History.—s. 1, ch. 2000-143. 515.31 Drowning prevention education program; public information publication.— (1) The department shall develop a drowning prevention education program, which shall be made available to the public at the state and local levels and which shall be required as set forth in s. 515.27(2) for persons in violation of the pool safety requirements of this chapter. The department may charge a fee, not to exceed $100, for attendance at such a program. The drowning prevention education program shall be funded using fee proceeds, state funds appropriated for such purpose, and grants. The department, in lieu of developing its own program, may adopt a nationally recognized drowning prevention education program to be approved for use in local safety education programs, as provided in rule of the department. (2) The department shall also produce, for distribution to the public at no charge, a publication that provides information on drowning prevention and the responsibilities of pool ownership. The department, in lieu of developing its own publication, may adapt a nationally recognized drowning prevention and responsibilities of pool ownership publication, as provided in rule of the department. History.—s. 1, ch. 2000-143. 515.33 Information required to be furnished to buyers. —A licensed pool contractor, on entering into an agreement with a buyer to build a residential swimming pool, or a licensed home builder or developer, on entering into an agreement with a buyer to build a house that includes a residential swimming pool, must give the buyer a document containing the requirements of this chapter and a copy of the publication produced by the department under s. 515.31 that provides information on drowning prevention and the responsibilities of pool ownership. (2) Stock ponds, storage tanks, livestock operations, livestock watering troughs, or other structures used in normal agricultural practices. (3) Public swimming pools. (4) Any political subdivision that has adopted or adopts a residential pool safety ordinance, provided the ordinance is equal to or more stringent than the provisions of this chapter. (5) Any portable spa with a safety cover that complies with ASTM F1346-91 (Standard Performance Specification for Safety Covers and Labeling Requirements for All Covers for Swimming Pools, Spas and Hot Tubs). Installation Instructions PLUMBING CONNECTIONS The MasterTemp heater has the unique capability of direct schedule 40 PVC plumbing connections. A set of bulkhead fittings is included with the MasterTemp heater to insure conformity with Pentair's recommended PVC plumbing procedure. Other plumbing connections can be used. See Figure 3 for plumbing connections. OCAUTION Before operating the heater on a new installation, turn on the circulation pump and bleed all the air from the filter using the air relief valve on top of the filter. Water should flow freely through the heater. Do not operate the heater unless water in the pool/spa is at the proper level. If a manual by-pass is installed, temporarily close it to insure that all air is purged from the heater. WATER CONNECTIONS The heater requires proper water flow and pressure for its operation. See Figure 5 for the recommended installation. The filter pump discharges to the filter, the filter discharges to the heater, and the heater discharges directly to the pool or spa. A manual bypass valve should be installed across the heater when the pump flow exceeds 120 GPM (454 LPM). See "WATER FLOW RATE" on page 13- Table 1 for setting of the manual by-pass valve. Make sure that the outlet plumbing from the heater contains no shut-off valves or other flow restrictions that could prevent flow through the heater (except for pool installations as noted below, or winterizing valves where needed). To switch flow between the pool and spa, use a diverter valve. Do not use any valve that can shut off the flow. Install the chemical feeder downstream of the heater. Install a chemical resistant one-way check valve between the heater and the chemical feeder to prevent back -siphoning through the heater when the pump is off. NOTICE: If the heater is plumbed in backwards, it will cycle continuously. Make sure piping from filter is not reversed when installing heater. Connect the heater directly to 2" PVC pipe, using the integral unions provided. Heat sinks are not required. The low thermal mass of the heater will prevent overheating of the piping connected to the pump even if the heater shuts down unexpectedly. Occasionally a two -speed pump will not develop enough pressure on the low speed to operate the heater. In this case, run the pump at high speed only to operate the heater. If this does not solve the problem, do not try to run the heater. Instead. correct the installation. Do not operate the heater while an automatic pool cleaner is also operating. If the circulation pump suction is plugged (for example by leaves), there may not be adequate flow to the heater. Do not rely on the pressure switch in this case. Installation Instructions 13 When any equipment is located below the Surface of the pool or spa, valves should be placed in the circulation piping system to isolate the equipment from the pool or spa. Check valves are recommended to prevent back -siphoning. Back - siphoning is most likely to occur when the pump stops, creating a pressure -suction differential. Do NOT sanitize the pool by putting chlorine tablets or sticks into the skimmer(s). When the pump is off, this will cause a high concentration of chlorine to enter the heater, which could cause corrosion damage to the heat exchanger. Exercise care when installing chemical feeders so as to not allow back siphoning of chemical into the heater, filters or pump. When chemical feeders are installed in the circulation of the piping system, make sure the feeder outlet line is down stream of the heater, and is equipped with a positive seal noncorrosive "Check Valve", (PIN R172288), between the feeder and heater. Where the water flow rate exceeds the maximum 120 GPM. a manual bypass should be installed and adjusted. After installing the valve, adjust the valve to bring the flow rate within the acceptable range. Then remove the valve handle or lock it in place to avoid tampering. See Figure 4. Model Min. This adjustment must be done by a qualified service technician. See following CAUTION before installation. • • :• '•� • The water pressure switch is set in the factory at 3.00 PSI (± 0.75 PSI). This setting is for a heater installed at pool level. If the heater is to be installed more than V above or below, the water pressure switch must be adjusted by a qualified service technician. FLOW SWITCH If the heater is installed more than 5' above the pool or more than 4' below the pool level, you will be beyond the limits of the pressure switch and a flow switch must be installed. Locate and install the flow switch externally on the outlet piping from the heater, as close as possible to the heater. Connect the flow switch wires in place of the water switch wires. Rev. Before installing the gas line, be sure to check which gas the heater has been designed to burn. This is important because different types of gas require different gas pipe sizes. The rating plate on the heater will indicate which gas the heater is designed to burn. The Table 2, shown on page 15, show which size pipe is required for the distance from the gas meter to the heater. The table is for natural gas at a specific gravity of .65 and propane at a specific gravity of 1.55. When sizing gas lines, calculate three (3) additional feet of straight pipe for every elbow used. When installing the gas line, avoid getting dirt, grease or other foreign material in the pipe as this may cause damage to the gas valve, which may result in heater failure. The gas meter should he checked to make sure that it trill slippy- enough gas to the heater and ant' other appliances that ntur be used on the same meter. The heater requires a gas supply of not less than 4" (102 cm) we and not more than 14" (35.6 cm) we. Gas supply pressures outside of this range may result in improper burner operation. A minimum flowing or dynamic inlet pressure (while the heater is running) of4" (10 2cm) we is required to maintain input rating with no more than a 2" pressure drop between static and dynamic. The gas supply must be installed in accordance with the National Fuel Gas Code, ANSM223.1, or standard CSA B149.1, Natural Gas and Propane Installation Codes, as applicable and all applicable local codes. Install a manual shut-off valve and a sediment trap and union located outside the heater panels, see Figure 6. Do not use a restrictive gas cock. The following minimum gas pipe sizes are recommended for natural gas supply piping, see Table 2 on page 15. For low pressure LP gas, pipe size may be reduced by 1/4", with a minimum pipe size of 1/2". Check for compliance with local codes. The heater and any other gas appliances must be disconnected from the gas supply piping system during any pressure testing on that system, (greater than '/2 PSI). The heater and its gas connection must be leak tested before placing the heater in operation. Do not use flame to test the gas line. tlse soapy water or another nonflammable method. Do NOT use an open flame to test for leaks. Test all gas connections for leaks with soapy water or another non-flammable method (see page 14). The heater and its individual shut-off valve must be disconnected from the gas supply piping system during any pressure testing of that system at test pressures in excess of 1 /2 psig (3.5 kPa). The heater must be isolated from the gas supply system by closing its individual manual shut-off valve during any pressure testing of the gas supply at test pressures equal to or less than 1 /2 psig (3.5 kPa). Avoid operation in persistent, extreme, moist or salty environments. In extreme weather, shut down the heater and disconnect the power to it until the weather has moderated. HEATER CLEARANCES — OUTDOOR IMPORTANT! • In an outdoor installation it is important to ensure water is diverted from overhanging eves with a proper gutter/drainage system.The heater must be set on a level foundation for proper drainage. • This unit shall not be operated outdoors at temperatures below -200 F. If the heater is located under a roof overhang, there must be at least three (3) feet (I in) of clearance between the bottom of the overhang and the top of the heater exhaust vent, see Figure S. History.—s. 1, ch. 2000-143. 515.23 Legislative findings and intent. —The Legislature finds that drowning is the leading cause of death of young children in this state and is also a significant cause of death for medically frail elderly persons in this state, that constant adult supervision is the key to accomplishing the objective of reducing the number of submersion incidents, and that when lapses in supervision occur a pool safety feature designed to deny, delay, or detect unsupervised entry to the swimming pool, spa, or hot tub will reduce drowning and near -drowning incidents. In addition to the incalculable human cost of these submersion incidents, the health care costs, toss of lifetime productivity, and legal and administrative expenses associated with drownings of young children and medically frail elderly persons in this state each year and the lifetime costs for the care and treatment of young children who have suffered brain disability due to near -drowning incidents each year are enormous. Therefore, it is the intent of the Legislature that all new residential swimming pools, spas, and hot tubs be equipped with at least one pool safety feature as specified in this chapter. It is also the intent of the Legislature that the Department of Health be responsible for producing its own or adopting a nationally recognized publication that provides the public with information on drowning prevention and the responsibilities of pool ownership and also for developing its own or adopting a nationally recognized drowning prevention education program for the public and for persons violating the pool safety requirements of this chapter. (5) "Indoor swimming pool" means a swimming pool that is totally contained within a building and surrounded on all four sides by walls of or within the building. (6) "Medically frail elderly person" means any person who is at least 65 years of age and has a medical problem that affects balance, vision, or judgment, including, but not limited to, a heart condition, diabetes, or Alzheimer's disease or any related disorder. (7) "Outdoor swimming pool" means any swimming pool that is not an indoor swimming pool. (8) "Portable spa" means a nonpermanent structure intended for recreational bathing, in which all controls and water -heating and water -circulating equipment are an integral part of the product and which is cord - connected and not permanently electrically wired. (9) "Public swimming pool" means a swimming pool, as defined in s. 514.011(2), which is operated, with or without charge, for the use of the general public; however, the term does not include a swimming pool located on the grounds of a private residence. (10) "Residential" means situated on the premises of a detached one -family or two-family dwelling or a one - family townhouse not more than three stories high. (11) "Swimming pool" means any structure, located in a residential area, that is intended for swimming or recreational bathing and contains water over 24 inches deep, including, but not limited to, in -ground, aboveground, and on -ground swimming pools; hot tubs; and nonportable spas. (12) "Young child" means any person under the age of 6 years. History.—s. 1, ch. 2000-143. 515.27 Residential swimming pool safety feature options; penalties.— (1) In order to pass final inspection and receive a certificate of completion, a residential swimming pool must meet at least one of the following requirements relating to pool safety features: (a) The pool must be isolated from access to a home by an enclosure that meets the pool barrier requirements of s. 515.29; (b) The pool must be equipped with an approved safety pool cover; (c) All doors and windows providing direct access from the home to the pool must be equipped with an exit alarm that has a minimum sound pressure rating of 85 dB A at 10 feet; (d) All doors providing direct access from the home to the pool must be equipped with a self -closing, self - latching device with a release mechanism placed no lower than 54 inches above the floor; or (e) A swimming pool alarm that, when placed in a pool, sounds an alarm upon detection of an accidental or unauthorized entrance into the water. Such pool alarm must meet and be independently certified to ASTM Standard F2208, titled "Standard Safety Specification for Residential Pool Alarms," which includes surface motion, pressure, sonar, laser, and infrared alarms. For purposes of this paragraph, the term "swimming pool alarm" does not include any swimming protection alarm device designed for individual use, such as an alarm attached to a child that sounds when the child exceeds a certain distance or becomes submerged in water. (2) A person who fails to equip a new residential swimming pool with at least one pool safety feature as required in subsection (1) commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083, except that no penalty shall be imposed if the person, within 45 days after arrest or issuance of a summons or a notice to appear, has equipped the pool with at least one safety feature as required in subsection (1) and has attended a drowning prevention education program established by s. 515.31. (b) The barrier may not have any gaps, openings, indentations, protrusions, or structural components that could allow a young child to crawl under, squeeze through, or climb over the barrier. (c) The barrier must be placed around the perimeter of the pool and must be separate from any fence, wall, or other enclosure surrounding the yard unless the fence, wall, or other enclosure or portion thereof is situated on the perimeter of the pool, is being used as part of the barrier, and meets the barrier requirements of this section. (d) The barrier must be placed sufficiently away from the water's edge to prevent a young child or medically frail elderly person who may have managed to penetrate the barrier from immediately falling into the water. (2) The structure of an aboveground swimming pool may be used as its barrier or the barrier for such a pool may be mounted on top of its structure; however, such structure or separately mounted barrier must meet all barrier requirements of this section. In addition, any ladder or steps that are the means of access to an aboveground pool must be capable of being secured, locked, or removed to prevent access or must be surrounded by a barrier that meets the requirements of this section. (3) Gates that provide access to swimming pools must open outward away from the pool and be self -closing and equipped with a self -latching locking device, the release mechanism of which must be located on the pool side of the gate and so placed that it cannot be reached by a young child over the top or through any opening or gap. (4) A wall of a dwelling may serve as part of the barrier if it does not contain any door or window that opens to provide access to the swimming pool. (5) A barrier may not be located in a way that allows any permanent structure, equipment, or similar object to be used for climbing the barrier. History.—s. 1, ch. 2000-143. 515.31 Drowning prevention education program; public information publication.— (1) The department shall develop a drowning prevention education program, which shall be made available to the public at the state and local levels and which shall be required as set forth in s. 515.27(2) for persons in violation of the pool safety requirements of this chapter. The department may charge a fee, not to exceed $100, for attendance at such a program. The drowning prevention education program shall be funded using fee proceeds, state funds appropriated for such purpose, and grants. The department, in lieu of developing its own program, may adopt a nationally recognized drowning prevention education program to be approved for use in local safety education programs, as provided in rule of the department. (2) The department shall also produce, for distribution to the public at no charge, a publication that provides information on drowning prevention and the responsibilities of pool ownership. The department, in lieu of developing its own publication, may adopt a nationally recognized drowning prevention and responsibilities of pool ownership publication, as provided in rule of the department. History.—s. 1, ch. 2000-143. 515.33 Information required to be furnished to buyers. —A licensed pool contractor, on entering into an agreement with a buyer to build a residential swimming pool, or a licensed home builder or developer, on entering into an agreement with a buyer to build a house that includes a residential swimming pool, must give the buyer a document containing the requirements of this chapter and a copy of the publication produced by the department under s. 515.31 that provides information on drowning prevention and the responsibilities of pool ownership.
