You are hereby notified that you have failed to comply with the notice of violation issued on May
16, 2017. An inspection of the above premises revealed that the buildings upon this property is,
in the opinion of the Building Official and as defined under section 8-5 of the Miami Dade
County Code, unsafe. Some of the reasons for this conclusion include, but are not limited to the
following: A portion of the roof is missing, open doors and windows, accumulation of debris,
performing work without permits and the concrete beam supporting the roof system has cracks.
The building upon the property constitutes a fire and windstorm hazard and meets the physical
criteria for demolition.
Type of Violation: Unsafe Building. Section 8-5 (a)(2)(3)(4), (b)(1)(2)(3), and (f)
Attached to this notice we have provided certain provisions of section 8-5 of the Miami Dade
County Code for your assistance.
REQUIREMENTS FOR CORRECTION:
1. Obtain demolition permits by September 8, 2018 and proceed promptly with demolition.
2. Pass required inspections by November 27, 2018
FAILURE TO COMPLY:
Failure to comply with this notice by correcting these violations by the dates provided (absent
extension) may result in the Building Official presenting this matter to the Unsafe Structure
Board to request an order for demolition that could expose the property owner to substantial
expenses, liens and liability.
APPEALS:
If you disagree with the above findings, you may appeal to the Miami Dade County Unsafe
Structural Board by contacting.

Sec. 8-5. - Unsafe Structures.
(a) General.
(2) Buildings or structures that are, or hereafter
shall become, unsafe, unsanitary or deficient,
facilities with inadequate means of egress, or which
constitute a fire or windstorm hazard, or are
otherwise dangerous to human life or public
welfare by reason of illegal or improper use, occupancy or maintenance, or which
have been substantially damaged by the elements, acts of God, fire, explosion or
otherwise, shall be deemed unsafe structures and a permit shall be obtained to
demolish the structure or where specifically allowed by this section, to bring the
building into compliance with the applicable codes as provided herein.
(3) Incomplete buildings commenced without a permit or for which the permit has
expired, or completed buildings commenced without a permit or for which the permit
has expired, prior to completion and no Certificate of Occupancy has been issued,
shall be presumed and deemed unsafe and a permit shall be obtained to demolish
the structure or bring the building into compliance with the applicable codes as
provided herein.
(4) Buildings which meet the physical criteria of unsafe structures set forth in this
section, and are ordered to be repaired by the Building Official, an Unsafe Structures
Appeal Panel or the Unsafe Structures Board, in the manner more particularly set
forth below, which are not completed or repaired and brought into full compliance
with the Building Code within the reasonable time allowed by the Building Official or
the Unsafe Structures Board, will be demolished.
(b) Physical criteria.
(1) A building shall be deemed a fire hazard and/or unsafe when:
(i) It is vacant, unguarded and open at doors or windows.
(ii) There is an accumulation of debris or other material therein
representing a hazard of combustion.
(2) A building, or part thereof, shall be presumed to be unsafe if:
(i) There is a falling away, hanging loose or loosening of any siding,
block, brick, or other building material.
(ii) There is a deterioration of the structure or structural parts.
(iii) The building is partially destroyed.
(iv) There is an unusual sagging or leaning out of plumb of the building
or any parts of the building and such effect is caused by deterioration
or over -stressing.
(3) A building, or part thereof, shall be presumed to be unsafe if:
(iii) The building or structure is vacant and abandoned, and covered at
doors or windows with materials not previously approved by the
Building Official, or for a period exceeding the maximum limitations
set forth in this Section.
(v) The building or part thereof meets the physical criteria of an
unsafe structure set forth above and has not been repaired and
brought into compliance with the Building Code following the
expiration of the reasonable periods allowed by the Building Official,
an Unsafe Structures Appeal Panel or the Unsafe Structures Board for
such repairs.
(f) Emergency action.
When in the opinion of the Building Official, there is actual or immediate danger of
the failure or collapse of a building or structure, or there is a health, windstorm or fire
hazard, he may order the occupants to vacate, temporarily close for use or occupancy
the rights -of -way thereto, sidewalks, streets or adjacent buildings or nearby area and
institute such other temporary safeguards, including securing the building or
structure, as he may deem necessary under the circumstances, and may employ the
necessary labor and materials to perform the required work as expeditiously as
possible. In such event, the operation of the notice and hearing requirements of this
Section shall be suspended as reasonably necessary in the opinion of the Building
Official to redress the emergency situation. Costs incurred in the performance of such
emergency work shall be paid by the appropriate governmental authority and upon
the recording in the public records of this county a certificate executed by the
Building Official, certifying the amount so expended, the same shall become a lien
against the property involved.

(2) A building, or part thereof, shall be presumed to be unsafe if:
(i) There is a falling away, hanging loose or loosening of any siding,
block, brick, or other building material.
(ii) There is a deterioration of the structure or structural parts.
(iii) The building is partially destroyed.
(iv) There is an unusual sagging or leaning out of plumb of the building
or any parts of the building and such effect is caused by deterioration or
over -stressing.
(3) A building, or part thereof, shall be presumed to be unsafe if:
(iii):The building or structure is vacant and abandoned, and covered at
doors or windows with materials not previously approved by the
Building Official, or for a period exceeding the maximum limitations set
forth in this Section.
(v) The building or part thereof meets the physical criteria of an unsafe
structure set forth above and has not been repaired and brought into
compliance with the Building Code following the expiration of the
reasonable periods allowed by the Building Official, an Unsafe
Structures Appeal Panel or the Unsafe Structures Board for such repairs.
(f) Emergency action.
When in the opinion of the Building Official, there is actual or immediate danger of the
failure or collapse of a building or structure, or there is a health, windstorm or fire
hazard, he may order the occupants to vacate, temporarily close for use or occupancy
the rights -of -way thereto, sidewalks, streets or adjacent buildings or nearby area and
institute such other temporary safeguards, including securing the building or
structure, as he may deem necessary under the circumstances, and may employ the
necessary labor and materials to perform the required work as expeditiously as
possible. In such event, the operation of the notice and hearing requirements of this
Section shall be suspended as reasonably necessary in the opinion of the Building
Official to redress the emergency situation. Costs incurred in the performance of such
emergency work shall be paid by the appropriate governmental authority and upon
the recording in the public records of this county a certificate executed by the Building
Official, certifying the amount so expended, the same shall become a lien against the
property involved.
REQUIREMENTS FOR CORRECTION:
1. Obtain demolition permits by April 24, 2020
2. Pass required inspections by July 24, 2020

YOU ARE HEREBY NOTIFIED that the certificate of occupancy for this building is here by
suspended. An inspection of the above premises revealed that the building located 19 NW 109
St. Miami Shores, Florida 33168 is in the opinion of the Building Official unsafe and in violation
of the Florida Building Code. The building may not be occupied until the building is repair and
or rebuild and a certificate of completion or certificate of occupancy is obtained. You are also
required to provide temporary protection while permits are obtained and construction is
completed.
Type of Violation: Unsafe Building
As prescribed under section 111.4 of the 6tb Edition to the 2017 Florida Building Code the
undersigned building official has determine that the building or structure is in violation of
the requirements of the code.
REQUIREMENTS FOR CORRECTION
Provide plans with details and specifications as required under section 107.2 of the 6TH Edition of
the 2017 Florida Building Code and chapter 8-10 of the Miami Dade County Code to bring the
building into compliance with the requirements of the 2017 Florida Building Code Residential or
obtain permits to demolish the building.

Therefore, you are hereby directed that on or before Monday, June 11, 2018 you are to correct
said VIOLATION and NOTIFY THE UNDERSIGNED BUILDING INSPECTOR that the
VIOLATION has been corrected. Failure to make the correction(s) will result in one or more of
the following actions: Disconnect utilities services, issuance of a ticket(s) in the amount of
$500.00 or more, filing of a civil suit or criminal charges against you or initiation of an unsafe
structures case requiring demolition of the structure. Also, failure to comply with this notice may
result in the department withholding issuance of other permits to you, referral of this matter to
the appropriate licensing board or the filing of a lien against your property in the amount of any
unpaid ticketing fines. In accordance with the provisions of Section 8-17 of the Code of Miami -
Dade County, you are also responsible for the reasonable costs and expenses incurred by the
Building Official in enforcing the provisions of the Building Code.
