2025-10RESOLUTION NO. 2025 - 10 A RESOLUTION OF THE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, APPROVING AN OFF -SYSTEM CONSTRUCTION AND MAINTENANCE AGREEMENT FM# 447827-1-52-01 WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) FOR THE MAINTENANCE AND IMPROVEMENT OF OFF -SYSTEM ROADWAYS; PROVIDING FOR AUTHORIZATION AND IMPLEMENTATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Florida Department of Transportation ("FDOT") has jurisdiction and authority over the state transportation system and works in partnership with local governments to maintain and improve public roadways and transportation infrastructure; and WHEREAS, certain roadways within the jurisdiction of the Miami Shores Village (the "Village") are classified as off -system roadways, and they are not part of the state highway system but are eligible for improvement or maintenance through an agreement with FDOT; and WHEREAS, the Village recognizes the need to ensure the safety, functionality, and sustainability of these off -system roadways for the benefit of its residents and the traveling public; and WHEREAS, FDOT has proposed an Off -System Construction and Maintenance Agreement FM# 447827-1-52-01 (the "Project') to outline the respective roles, responsibilities, and funding obligations of the parties in maintaining and improving the identified off -system roadways; and WHEREAS, the Project location is SR 5/US-1/Biscayne Boulevard from SR 915/NE 6th Avenue to NE 105th Street; and WHEREAS, FDOT and the Village ("the Parties") agree that it is in the best interest for FDOT to undertake and to complete all aspects of the Project, including but not limited to the design, construction, construction inspection, maintenance during construction, utilities, easements, and other associated tasks; and WHEREAS, the Village agrees to perform normal maintenance operations for the preservation of the roadway improvements which shall include but is not limited to, roadway surfaces, shoulders, roadside structures, drainage, signing and pavement markers, lighting, and such traffic control devices as are necessary for the safe and efficient use of the local roadway; and WHEREAS, by entering into this agreement with FDOT it is in the best interest of the Village and its residents, as it will facilitate cooperative efforts to enhance transportation infrastructure and promote public safety; and WHEREAS, the Public Works Director recommends approval of the Agreement; and WHEREAS, the Mayor and Council find it to be in the best interest of the Village to authorized the Villager Manager to execute the Off -System Construction and Maintenance Agreement (FM 447827-1-52-01) with FDOT, a copy of the Agreement in substantially final form being attached hereto and made a part hereof by reference; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Village Council of Miami Shores Village, Florida that: Section 1. Recitals Adopted. The foregoing recitals are true and correct. Section 2. Approval. The Off -System Construction and Maintenance Agreement with the State of Florida Department of Transportation ("FDOT") for the design, construction, construction inspection, maintenance during construction, utilities, easements, and other associated tasks; and in substantially the form attached as Exhibit A, FM# 447827-1-52-01 for the Project is hereby approved. Section 3. Authorization and Implementation. The Village Manager or designee is hereby authorized to enter into an Off -System Construction and Maintenance Agreement (FM# 447827-1-52-01) with the Florida Department of Transportation (FDOT) subject to approval as to form and legal sufficiency by the Village Attorney and take any action necessary to implement its terms. Section 4. Effective Date. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 18th day of March, 2025.
