2023-07-06 CEB MinutesCODE ENFORCMENT BOARD MEETING MINUTES DATE: 07-06-2023 TIME: 6:00 PM COUNCIL CHAMBERS 1) CALL TO ORDER Chairperson Huber called the meeting to order at 6:01 PM. Swearing in of the Witnesses by Attorney Roger Poe: Will everyone that is going to testify tonight please raise your right hand and swear to tell the truth, the whole truth and nothing but the truth. 2) ROLL CALL Present: Board member Gromadzki Board member Perl Boardmember Buenconsejo Boardmember McGuire arrived at 6:07 PM. Chairperson Huber Absent: Board member Cohen - Excused Board member Vickers- Excused Also, present: Roger Poe, Attorney for the Code Board Mike Orta, Manager Vivian Yao — Acting Code Board Secretary 3) FIRST HEARING - NOTICES OF VIOLATION Summary Adjudication for first Hearings: Case(s) 001399-2022; 001458-2022. The officer, Mike Orta, testified that Affidavits of Non -Compliance and evidence of violation exist in each of the files. Motion: I move for summary adjudication of all such cases to include a finding of fact and conclusion of law that a violation exists as charged in the respective notice of violations issued therein and that, in each such case, the offending party shall correct the violation within time period specified and immediately notify the Code Enforcement Officer when the property is brought into compliance. In each such case, if the violation is not brought into compliance within such time period, the Code Enforcement Officer may report this fact back to the Board in accordance with the Board's Rules and Regulations at which time a fine is hereby authorized to be automatically assessed against the violator. In the respective daily amounts specified in staff's recommendations for tonight's hearing, retroactive to the original compliance deadline. Further, with respect to each such case, costs in the amounts specified in Staff's recommendations for tonight's hearings are hereby assessed in order to recoup the Village's expenses in prosecuting the violations to date." Motion by Board member Perl, Seconded by Board member Buenconsejo. Motion was approved 5-0 4) ENFORCEMENT ORDERS - There were no enforcement orders. 5) REQUEST FOR RELIEF 5. A Elizabeth Giraldo 9801 N. Miami Avenue Miami Shores, FL 33150 Mr. Elizabeth Giraldo was present and testified, indicating personal tragedy which led to her ex-husband Marcos Urqueta assisting her with getting the funds to make the necessary repairs to her property. The final offer is $1,000.00 payable in 90 days. Motion to approve the amount of $1,000.00 payable in 90 days by Chair Huber, seconded by Board member Buenconsejo and the Motion was approved 5-0 roll call vote. 6) MINUTES 6. A Approval of the Minutes Chair Huber noted the June 2023 meeting minutes were not presented to the board. Mr. Orta indicated he is short on staff; however, such meeting minutes will be presented to the board at the August 2023 meeting. 7) DISCUSSION Chairperson Huber and Boardmember Buenconsejo noted they will not be present for the August board meeting. Chairperson Huber encouraged the board clerk to determine quorum at least two weeks in advance in light of the excused absences. 8) ADJOURNMENT Motion to adjourn by Board member Buenconsejo, seconded by Chairperson Huber and the Motion was approved 5-0. The hearing adjourned at 6:22 PM.
