2023-06-01 CEB Minutes REVISEDCODE ENFORCMENT BOARD MEETING MINUTES DATE: 6-1-2023 TIME: 6:00 PM COUNCIL CHAMBERS 1) CALL TO ORDER Chairperson Huber called the meeting to order. Swearing in of the Witnesses by Attorney Marlon Hill: Will everyone that is going to testify tonight please raise your right hand and swear to tell the truth, the whole truth and nothing but the truth. 2) ROLL CALL Present: Board member Vickers Board member Gromadzki Board member Perl Chairperson Huber Absent: Board member Cohen - Excused Board member Buenconsejo — Excused Boardmember McGuire- Unexcused Also, present: Marlon Hill, Attorney for the Code Board Mike Orta, Manager Mariana Gracia - Code Board Secretary 3) FIRST HEARING - NOTICES OF VIOLATION Summary Adjudication for first Hearings: Case(s) 001399-2022; 001458-2022. The officer, Mike Orta, testified that Affidavits of Non -Compliance and evidence of violation exist in each of the files. Motion: I move for summary adjudication of all such cases to include a finding of fact and conclusion of law that a violation exists as charged in the respective notice of violations issued therein and that, in each such case, the offending party shall correct the violation within time period specified and immediately notify the Code Enforcement Officer when the property is brought into compliance. In each such case, if the violation is not brought into compliance within such time period, the Code Enforcement Officer may report this fact back to the Board in accordance with the Board's Rules and Regulations at which time a fine is hereby authorized to be automatically assessed against the violator. In the respective daily amounts specified in staff's recommendations for tonight's hearing, retroactive to the original compliance deadline. Further, with respect to each such case, costs in the amounts specified in Staff's recommendations for tonight's hearings are hereby assessed in order to recoup the Village's expenses in prosecuting the violations to date." Motion by Board member Perl, Seconded by Board member Gromadzki. Motion was approved 4-0 roll call vote. 4) PENALTY HEARING - ENFORCEMENT ORDERS Summary Adjudication for Penalty Hearings: Case Ws: 02-23-70; 03-23-125; 03-23- 85; 03-23-89; 03-23-91; 03-23-93; 03-23-96; 03-23-98. The officer, Mike Orta, testified that Affidavits of Non -Compliance and evidence of violation exists in each of the files. Motion: I move that, in each case currently remaining on the penalty docket for tonight's hearing, each respective violator be ordered to pay the irrevocable and irreplaceable fine previously adjudicated and authorized to be imposed against them by prior order of the Board, retroactive from the day the violation was to have been corrected, that upon recording, the Board's Order in this regard will constitute a lien on the property of the violator. Moved by Board Member Perl, seconded by Board Member Vickers. Motion was approved by a 4-0 roll call vote. Summary Adjudication for Penalty Hearings: Case Ws: 001239-2022; 001465-2022; 01- 23-30; 02-23-62; 04-23-138. The officer, Mike Orta, testified that Affidavits of Non -Compliance and evidence of violation exists in each of the files. Motion: I move that, in each case currently remaining on the penalty docket for tonight's hearing, each respective violator be ordered to pay the daily fine previously adjudicated and authorized to be imposed against them by prior order of the Board, retroactive from the day the violation was to have been corrected, that upon recording, the Board's Order in this regard will constitute a lien on the property of the violator. Moved by Board Member Perl, seconded by Board Member Gromadzki. Motion was approved 4-0 roll call vote. 5) REQUEST FOR RELIEF 5. A Request for Relief Adam Shepard 295 NE 95 Street Mr. Adam Shepard was present and testified. He has been a resident since 2013. He works in sales of commercial kitchen equipment. The issue with the fence started due to FPL box at his property. Mr. Shepard testified that he hired Henry's fence to fix the issue with the fence. He elaborated as to how he brought the violation into compliance. The Board Asked questions. The final offer is $650.00 payable in 30 days. Motion to approve the amount of $650.00 payable in 30 days by Board member Perl, seconded by Board member Vickers and the Motion was approved 4.0 6) MINUTES 6. A Approval of the Minutes for the Code Board: May 4, 2023; April 13, 2023; March 2, 2023 and December 1, 2023. Motion to approve the minutes for December 1, 2022 by Board member Perl, seconded by Board member Gromadzki and the Motion was approved 4-0. Motion to approve the minutes for March 2, 2023 by Board member Perl, seconded by Board member Gromadzki and the Motion was approved 4-0. Motion to approve the minutes for April 13, 2023 by Board member Perl, seconded by Board member Vickers and the Motion was approved 4-0. Motion to approve the minutes for May 4, 2023 by Board member Perl, seconded by Board member Gromadzki and the Motion was approved 4-0. 7) DISCUSSION Chairperson Huber had a brief conversation with the Board members regarding the use of the microphones when speaking for recording purposes. He also spoke about the Board members adhering to the attendance policy. 8) ADJOURNMENT Motion to adjourn by Board member Perl, seconded by Mr. Vickers and the Motion was approved 4-0. The hearing adjourned at 6:32 PM.
