CODE ENFORCEMENT BOARD MEETING MINUTES
OCTOBER 3, 2024 6:00 PM COUNCIL CHAMBERS
1) CALL TO ORDER
Chairperson Huber called the meeting to order at 6:04 PM.
Chairperson Huber provided opening statements.
Introductory Statement: Village Attorney Jose Arango, provided introductory remarks and
administered the oath to the residents present.

Neighborhood Services Director Orta indicated the Village property file does not have images.
Attorney Roy Weinfeld was present and testified on behalf of Maria Del Carmen Suzuki Takata. The
violation is for unauthorized construction and expired permits. Chairperson Huber stated case
details, the amount of the fine ($111,450) and the amount proposed by the requestor ($1,000).
Neighborhood Services Director Orta indicated there was a permit that was closed. He closed the
case retroactively when the permit was closed on 02-15-2019.Attorney Weinfeld stated that the
permit, though closed, was still accruing fees. After hearing the testimony from Mr. Weinfeld, the
Board asked pertinent questions, followed by Chairperson Huber asking Mr. Weinfeld if that was his
best and final offer.
Motion to accept the amount of $1000 payable in 30 days by Boardmember Vickers, seconded
by Boardmember Rodriguez. The motion passed 4-0.

Aaron Mussali was present and testified. Chairperson Huber stated case details, the amount of the
fine, $3,450 and the amount proposed by the requestor, $1,000. The violation is for unauthorized
construction and expired permits. There was an error with the case which is actually for a dirty roof
and sidewalk. After hearing the testimony from Mr. Mussali, the Board asked pertinent questions,
followed by Chairperson Huber asking Mr. Mussali if that was his best and final offer.
Motion to accept the amount of $1,000 payable in 30 days by Boardmember Rodriguez,
seconded by Boardmember Vickers. The motion passed 4-0.

BARBARA GRAHAM

Ms. Wyn Graham Bradley was present and testified on behalf of her mother Barbara Graham, who
is incapacitated. Chairperson Huber stated case details, the amount of the fine, $36,500 and the
amount proposed by the requestor, $150. The violation is for deteriorated parking area. Barbara
Graham pulled a permit to have gravel and ribbon replaced in the driveway. The permit was never
closed and finalized by the contractor. The daughter became aware of the issue last July and has
been attempting to assist her mother with the notice of lien which had been issued. She stated that
the City signed off on the permitted work done at the property and closed the permit on site. The
permit was reopened and closed out by the daughter.
Neighborhood Services Director Orta indicated the $30 admin fee was paid by Barbara Graham.
Chairperson Huber indicated the amount should be based off $36,500. The fine was back dated to
when the permit was originally closed in 2012. After hearing the testimony from Ms. Bradley, the
Board asked pertinent questions, followed by Chairperson Huber asking Ms. Bradley if that was her
best and final offer.
Motion to accept the amount of $150 payable in 30 days by Boardmember Rodriguez,
seconded by Chairperson Huber. The motion passed 4-0.

USA RODRIGUEZ

Usa Rodriguez was present and testified. A permit was pulled but was never closed by the
contractor in 2022. It was discovered by the property owner that a lien was on the property for an
open violation. Usa indicated the new contractors started project from scratch and remodeled the
original project. The expense to close the open permit is $6,800. The original permit cost was
$4,300. After hearing the testimony from Mr. Rodriguez, the Board asked pertinent questions,
followed by Chairperson Huber asking Mr. Rodriguez if that was his best and final offer.
Motion to accept the amount of $5,000 payable in 30 days by Boardmember Rodriguez,
seconded by Boardmember Cangiano. The motion passed 4-0.
6) MINUTES
There were no minutes to approve.
7) DISCUSSION
Boardmember Vickers indicated there were two cases why the homeowner has to call the Village to
close the violation. Neighborhood Services Director Orta indicated the NOV (Notice of Violation)
contains the proper language. Boardmember Vickers indicated the process should be automated.
Neighborhood Services Director Orta stated the Village is moving away from EnerGov permitting
system. Boardmember Vickers advocated for an automated message with a checkbox that prompts
people to close the permit.
