ROLL CALL Present: Mr. Brady Chair Bolton Mr. Spirk Mr. O’Hara Mr. Nappier III Also, present: Chanae Wood- Village Attorney Eddy Nuñez- Interim Planning and Zoning Director (Corradino Group) Joseph Corradino- Consultant (Corradino Group) 3. ORDER OF BUSINESS - (Additions, Deletions, and Deferrals) 4. PUBLIC COMMENTS - 2-Minute Time Limit (Non-Item Specific) Carol Respondek thanked the board for their due diligence and asked board to reconsider front and rear setbacks. Elizabeth Cowen spoke in support of upholding the charm of Miami Shores. Maria McGuinness referenced section 100 of the zoning code. Janet Goodman echoed the comments expressed by residents with respect to pervious area. Carmen Renick asked the board to ensure the charm of the Village is upheld. Toni McCormick asked the board to address parking requirements. Pat Toomey echoed the comments shared by other commenters, noting the impact of setting precedent. He further spoke in opposition to congestion. Stephanie spoke in opposition to traffic. 578 NE 112 St offered an alternative to parking congestion 5. LEGISLATIVE ITEM – DISCUSSION & POSSIBLE ACTION 6:22 PM 5.A. Ordinance - Establishing Division 25 - Community Residential "CR" District Mr. Bolton asked Joseph Corradino to introduce the item, noting the draft document summarizes the requested changes. He asked the board to walk through the remaining items that have to be considered. Mr. Corradino noted the final draft will be presented to the board. Mr. Corradino asked the board from the ordinance. Spirk proposed the board work from the staff report instead of the ordinance. Chairperson Bolton concurred with Spirk. Proposed Code Changes: -add 2 or more units on page 2 - add the sentence "egress/ingress from multi-family dwelling shall only be allowed along 115 street" 181-184 -public vs private streets (discussion ensued regarding who maintains the road.) Bolton asked board to resolve street grid and public versus private roads components. There was consensus for roads to be public. Discussion ensued on integrated street grid. There was consensus on street grid that approximates what is in the Village, supporting street grid system (not allow driveways to open onto on peripheral road with the exception of multi-family dwellings) 204.D - Spirk asked staff to check the acres (28.8) j- removed along with L- discussion ensued on raising the percentage of site that can be developed as common open space, specifically net versus gross consideration. Consensus to change it to 35%, adding net M- P-add language "No roof decks are permitted." V- insert "not less than 2.5" X- replace will with shall AA- minimum 15 feet or minimum 20 feet such that no more than 2 adjacent units in a row within any group can be at the same front yard setback. Discussion ensued regarding the diagram provided by Spirk, depicting 10-foot rear setback illustration of Chevy Suburban vehicle. Consensus: Recess at 8:20 PM and resumed at 8:22 PM. T- was not included in staff report; Spirk recommended 48 inches instead of 60; can't exceed 33% of the frontage. Spirk asked about Loading Spaces. If one-way streets are established, loading space will be provided. Line 201- Review Criteria- required frontage- remove common open spaces Line 227- remove "Though private main roads may not contain landscaping" Perimeter buffers line remove "where required" and add "shall" remove last line Line 235-Public Hearing- Under Criteria- remove ii sentence iii- remove "frontage to a public street." Section 204AA-mirror language for front yard, min 7.5 and max 10 Add Comp Plan Provision Stormwater management- retentionary shall not be used towards common spaces. Mr. Corradino proposed moving meeting to special call on 1/30 or meeting on 1/23 and adding 1/30 special meeting. There was consensus to have one meeting on 1/30. Attorney noted the final version will not include strike-throughs. 6. PUBLIC COMMENT(S)- 2-Minute Time Limit (Non-Item Specific) Maria McGuinness circulated the building configuration chart as prepared by the Corradino Group, indicating that 54% of respondents preferred a minimum rear setback of 10 feet, as opposed to the proposed 7.5 feet. Dennis Leyva spoke in favor of the board raising the bar for future development. Angela Marinas advocated for the neighboring properties, opposing the proposed Lennar development. 7. BOARD MEMBER COMMENTS Mr. Spirk revisited 10% single-family homes discussion. Mr. Corradino noted he will double-check how it can be accomplished. 8. ADJOURNMENT Chair Bolton moved to adjourn the meeting. Mr. Brady seconded the motion which carried a 5-0 voice vote. There being no further business before the Planning and Zoning Board, the meeting adjourned at 9:51 PM. The Planning and Zoning Board may consider and act upon such other business as may come before it. In the event this agenda must be revised, such revised copies will be available to the public at the Village Council meeting.
